MORA TORIUM EXTENSION--ADUL T ORIENTED USES
Proposed Action.
Staff recommends the following motion: Move to approve Resolution RZ95-24 approving
Ordinance 95-761 for first reading. which will extend the moratorium on adult-oriented
businesses established by Ordinance No. 94-745.
Overview.
There is currently a moratorium on the establishment of adult-oriented businesses within the
City. The purpose of the moratorium is to allow the City time to study the issues and propose
amendments to the existing ordinances. This moratorium is scheduled to expire on April 18,
1995. Attached is an ordinance that will extend the moratorium to November 21, 1995. The
City can extend the moratorium for an additional 18 months.
. Staff feels that an additional six months should be sufficient to complete any necessary
revisions to amend the existing adult-oriented business ordinances. The City's attorney has
already prepared a draft amendment ordinance for Staff to review. The Zoning and Planning
Commission is scheduled to review this draft at their April 25 meeting. If the proposed
ordinance is not continued at the planning commission meeting, the City Council could
realistically review this draft for first reading at their May 2, 1995, meeting.

RESOLUTION EXTENDING THE MORATORIUM ON ADULT-ORIENTED
BUSINESSES ESTABLISHED BY ORDINANCE NO. 94-745
WHEREAS, there is a need for a study to be conducted so that the City can decide
whether to amend its existing regulation pertaining to adult-oriented businesses; and
WHEREAS, the study will address the land use and zoning issues associated with such
uses and may also address the City's licensing regulations regarding such uses; and
WHEREAS, there is a need to extend interim Ordinance 94-745 for the purpose of
protecting the planning process and the health, safety, and welfare of the citizens of the City and
to ensure that the City and its citizens retain the benefits of the City's comprehensive plan and
zoning ordinance until such study has been completed; and
. WHEREAS, there is a need to restrict adult-oriented businesses until the study has been
completed and modifications to the City's regulations have been adopted.
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Hopkins
hereby extends interim Ordinance 94-745 to November 21,1995.

AN ORDINANCE EXTENDING THE MORATORIUM ON ADULT-ORIENTED
BUSINESSES ESTABLISHED BY ORDINANCE NO. 94-745
THE CITY COUNCIL OF THE CITY OF HOPKINS ORDAINS:
Section 1. Findings.
1.01 By Ordinance No. 94-745, the City Council placed a moratorium on the
development of adult-oriented businesses in the City pending completion of a study and the
adoption of any amendments to the City's ordinances. The ordinance is scheduled to expire on
April 18, 1995.
1.02 The City is still in the process of completing its study and the matter is scheduled to
be considered by the planning commission on April 25, 1995, for review and recommendation to
the City Council.
1.03 It is necessary for the City Council to extend the moratorium in order to allow the
planning process to be completed.
. Sec. 2. Extension of Moratorium. The moratorium on the development of adult-oriented
businesses established by Ordinance No. 94-745 is extended until November 21, 1995, or such
earlier date as may be further adopted by ordinance. All other provisions of Ordinance No.
94-745 remain in effect.
Sec. 3. This ordinance shall be effective 20 days after its publication.
First reading: April 4, 1995
Second reading: April 18, 1995
Date of publication: April 26, 1995
Date ordinance is effective: May 17, 1995
