Proposed Action.
Staff recommends adoption of the following motion: Move that Council adopt Resolution 95-27.
Resolution Approvine. Petition for Storm Sewer Separation Proiect. Hopkins Plaza.
Adoption of this resolution will provide funding for a private improvement to separate storm sewer drains
from the City's sanitary sewer system and is the first step in a special assessment for the private
improvements.
Overview.
Council adopted certain ordinance revisions to more clearly define types of stormwater discharge and to
empower the City to more aggressively deal with illegal connections of storm sewer drains to the City's
sanitary sewer utilities. The Council also provided an additional section to the code to promote voluntary
disconnections by allowing such private project costs to be placed as a special assessment against affected
properties. The owners of Hopkins Plaza are approaching Council with a petition for such a project.
Primary Issues to Consider.
. Council Authority
. Section 429 of the State Statutes permits storm sewer separation improvements and the cost to be assessed
to benefited properties. The amount to be assessed would be the total cost of the project plus an
administrative fee of5% or $100.00, whichever is greater. Present policy is to charge 8% interest and to
assess over a ten-year period.
. Project details
The petitioner, Stuart Corporation, has received a proposal for separation of pipes, installation of new lift
stations and regrading of an alley. The bid total is $42,000, but the owner has petitioned for an additional
$8,000 for contingencies, making a potential total of $50,000 to be financed through the City. Council has
the discretion to accept the petition as submitted or to make revisions.

e PETITION AND WAIVER BY PROPERTY OWNER(S)
Stuart Nolan, hereinafter caUed the President of Stuart Corporation, states that he has oWnership interest
in property at 151 8th Ave. South, Hopkins, Minnesota, more commonly known as Hopkins Plaza
Apartments and particularly described as:
Lots 11 through 41 inclusive, and the south 30 feet of Lot 42, Block 3, West Mlnneapolis,
including adjoining vacated alleys, Section 24, Township 117, Range 22, Hennepin
County, :Minnesota.
Said President of Stuart Corporation hereby petitions the City of Hopkins to make the arrangements
necessary to:
1. Assess the costs of a private installation and connection of a storm sewer system at the
above property. The purpose of the system is to separate discharge of storm water from
the City's sanitary sewage disposal system. Materials and installation shall be in
accordance with attached specifications. The owner of the above property agrees to an
installation deadline of November ], 1995.
2. Allow the owner to contract privately for construction of the improvement per attached
cost estimates. The construction cost financed shall not exceed the cost estimates. The

per annum. Final payment by the City to the contractors shall be contingent upon receipt
ofIien waivers.
The President of Stuart Corporation hereby waives any right to notice or objection to said improvement
as provided in Chapter 429 of the Minnesota Statutes and any other provisions ofmunlcipal or state law
providing for notice or objections. The President of Stuart Corporation understands that the aforesaid
property will be assessed for the costs for the aforesaid work.

RESOLUTION 95-27
RESOLUTION APPROVING PETITION FOR AND ORDERING IMPROVEMENTS
WHEREAS, the owner of Hopkins Plaza Apartments, 151 8th Avenue
South, Hopkins, Minnesota, has petitioned for an improvement
consisting of the separation and installation of a storm
sewer system pursuant to Minnesota Statute No. 429.031,
Subd.3; and
WHEREAS, the petition and accompanying documents thereto comply
with the requirements of the aforementioned statute.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
HOPKINS, MINNESOTA:
1. Such improvement is hereby ordered as proposed and requested
in the petition.
2. That the Public Works Director be directed to review and
approve the plans and specifications accompanying the
petition for the construction and installation of the storm
e sewer system.
3. That said installation and construction be in conformance
with Minnesota statute Chapter 429 and all state and
municipal codes, ordinances and regulations pertaining
thereto.
4. That periodic inspections be conducted by the City of
Hopkins to assure compliance with said codes and
requirements.
Adopted by the city Council of the city of Hopkins this 18th
day of April, 1995.
