Staff recommends the following motion: Move to approve Resolution 95-1 approving a Comprehensive Plan change from High Density Residential to Medium Density Residential and Ordinance 94-752 which will rezone the property north of St. Therese from R-4 PUD to R-2 for first reading. At the Zoning and Planning meeting Mr. Hutchison moved and Mr. Day seconded a motion to approve Resolution RZ94-22, recommending approval of a zoning and Comprehensive Plan change for the Opus property. The motion carried unanimously. Overview. In an effort to reduce the number of potential multi family units within the City, the Planning Commission has begun a process to amend the Comprehensive Plan and Zoning Ordinance to reflect new goals for the City regarding multi-family sites. As part of this process the Planning Commission has also reviewed several sites in the City that are potentially available for development/redevelopment for multi-family housing projects. The staff is presently proposing that the Planning Commission hold a hearing at each of its e next several meetings to consider a zoning and/or land use change to one to two parcels per month. For this month staff is proposing that the Commission consider the vacant land north of St. Therese. The vacant lot north of St. Therese is zoned R-4 PUD, Medium High Density Multiple Family. The Comprehensive Plan has designated the area as High Density Residential. The Planning Commission has recommended as part of its previous review that this property is rezoned to R-2, Low Density Multiple Family and that the Comprehensive Plan is also amended to medium density multi-family. The zoning of the property is R-4, Planned Unit Development which allows multi-family dwellings. 0 What has the Comprehensive Plan designated the subject site? The Comprehensive Plan has designated the site as High Density Residential. 0 What are the new goals in the Comprehensive Plan? One of the goals in the Strategic Plan is to examine the multi-family zoned and guided properties within the City. As a result of this goal in the Strategic Plan, the Comprehensive Plan was amended. Earlier this year the City Council amended the Comprehensive Plan to reflect new residential neighborhood policies. The following are the new policies: 0 The City will work to assure a strong and well maintained neighborhoods in order to foster an overall positive economic development climate in Hopkins. 0 The City will work to provide an overall mixture of residential land use in the City. . 0 The City will work to correct the disproportional amount of multiple family land uses within the City. 0 The City will work to provide a balance of land uses within the City. 0 The City will seek to provide housing opportunities for people in all segments of the life cycle. 0 The stability and growth of neighborhoods is key to the success of any economic development efforts of a city. Neighborhoods provide employees for existing and potential business, a market for the retail sector, and create an image of the community which is a reflection upon the local business. Neighborhoods are also a reflection upon a community's social and economic standards of living and overall quality of life, which in turn impacts economic growth, 0 What are the surrounding uses? The subject site is surrounded by the following uses: 0 north - landfill/Westbrooke patio homes 0 south - St. Therese 0 east - Westbrooke patio homes 0 west - Greenfield apartments . - - ---------- . -- .---- CR 95-8 Page 3 . 0 What has the Planning Commission recommended for the site? In reviewing the site it was determined that because of the surrounding uses that a multiple family designation would be appropriate for the site, but that the density should be reduced, As a result of the proposed change the density will decrease from approximately 231 units to approximately 105 units, The Planning Commission in their preliminary review of the site has recommended that the site is rezoned to R-2 and the Comprehensive Plan is changed to medium density residential. The Planning Commission made this recommendation because the surrounding area is all multiple family and a lower density will reduce the number of units that could be constructed. 0 What is the staff recommendation? Staffwould concur with the recommendation of the Planning Commission. 0 What was the discussion at the Zoning and Planning meeting? Staff reviewed the proposed rezoning and Comprehensive Plan change. Staff noted that the owner of the property had been notified. The Planning Commission has reviewed this site before and made the recommendation to amend the Comprehensive Plan and to rezone the property. There was no one at the public hearing to speak on this item. . Alternatives 1. Approve of the Comprehensive Plan and zoning amendment. By approving the Comprehensive Plan and zoning amendment, the City Council action regarding the Comprehensive Plan will be forwarded to the Met Council for final approval. 2. Deny the Comprehensive Plan and zoning amendment. By denying the Comprehensive Plan and zoning amendment, the zoning and the Comprehensive Plan will remain as is, If the City Council considers this alternative, findings of fact will have to be stated that support this decision. 3. CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 95-1 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN APPLICATION TO AMEND THE COMPREHENSIVE PLAN AND REZONE THE OPUS PROPERTY WHEREAS, an application to ZN94-4 and COMP94-2, made by the City of Hopkins for an amendment to the Comprehensive Plan from High Density Multiple Family to Medium Density Multiple Family and a rezoning from R-4 PUD to R-2 for the vacant property owned by Opus, is approved. WHEREAS, the procedural history of the application is as follows: 1. That an application to amend the Comprehensive Plan and a rezoning was filed by the City of Hopkins on November 28, 1994. 2. That the Hopkins Planning Commission, pursuant to published and mailed notices, held a public hearing on the application and reviewed such application on December 27, 1994: all persons present at the hearing were given an opportunity to be heard. . 3. That the written comments and analysis of the City staff and the Planning Commission were considered. 4. A legal description of the subject property is as follows: Lot I Block I Opus Ninth Addition NOW THEREFORE, BE IT RESOLVED that the application ZN94-4 and COMP94-2 is hereby approved based on the following Findings of Fact: 1 That a goal in the City of Hopkins Strategic Plan for Economic Development is to review the multi-family zoned and guided property. 2. That a change in the zoning and Comprehensive Plan designation of the subject property will work to provide an overall mixture of residential land use the City 3. That a change in the zoning and Comprehensive Plan designation of the subject property wi11 help to reduce the disproportional amount of multiple family land uses within the City. . . CITY OF HOPKINS Hennepin County, Minnesota ORDINANCE NO. 94-752 AN ORDINANCE REZONING THE OPUS PROPERTY BE IT ORDAINED by the City Council of the City of Hopkins as follows: That the present zoning classification of R-4 POD upon the following described premises is hereby repealed and in lieu thereof the said premises are hereby zoned as R-2, Low Density Multiple Family: Lot 1 Block 1 Opus Ninth Addition That the presently existing Hopkins Zoning Map adopted as part of Hopkins Zoning Ordinance is hereby amended and changed in accordance with the above provision.
