RESOLUTION 95-17 AMENDING RESOLUTIONS 95-011 AND 94-074 - CREATING
HOUSING ADVISORY BOARDS
Proposed Action
Staffrecornmends approval of the following motion: Adopt resolution number 95-17 amending
resolutions 95-011 and 94-074 regarding the housing advisory board for the Meadow Creek
Condominium Association and the Westbrooke Patio Homes.
With this motion, members will be officially appointed to the Westbrooke Patio Home Advisory
Board, while clarifying that an advisory board for Meadow Creek Condominiums has not been
established.
Overview
The special legislation which authorizes the City of Hopkins to create residential service districts
within the City also states that the City may create housing advisory boards to advise the City in
connection with the planning and construction of housing improvements. Initially, staff felt that
advisory boards would be necessary for both of the Westbrooke associations and thus advised the
City Council to pass a resolution establishing such boards.
As the planning of the housing improvement areas has progressed, staffhas relied on the
. direction provided by the entire membership of Meadow Creek Condominiums (through general
membership meetings) and their property manager. Staff has felt comfortable that this method has
been most appropriate for their situation. In working with the Westbrooke Patio Homes in the
early stages of project development, it has been necessary to create an advisory board due to the
lack of a property manager and the scope of their project. However, it is also anticipated that the
Patio Homes will eventually put the entire list (and cost) of improvements to a general
membership vote.
In order to accurately reflect the status of the housing advisory boards and to officially appoint
the members to the Patio Home Advisory Board, bond counsel has prepared resolution 95-17.
Primary Issues to Consider
The proposed resolution was recommended by bond counsel in order to clarify the status of the
housing advisory boards, If it is determined that a housing advisory board is needed for the
Meadow Creek project at a future date, the City Council will still have the ability to appoint
members to such a board,

REGARDING THE HOUSING ADVISORY BOARD FOR THE
MEADOW CREEK CONDOMINIUM ASSOCIATION AND
THE WESTBROOKE PATIO HOMES
WHEREAS, the City of Hopkins has secured approval of legislation allowing for the
establishment of a residential special service district, namely, 1994 Minnesota Laws, Chapter 587,
Article 9, Sections 22 through 31 (the "Housing Improvement Act"); and
WHEREAS, the Housing Improvement Act allows the City Council to create an advisory
board in conjunction with the creation of a housing improvement area; and
WHEREAS, by Ordinance No,95-759 adopted March 21, 1995, the City Council has
created Housing Improvement Area No, I for the Meadow Creek Condominiums; and
WHEREAS, the City Council has previously approved Resolution 94-074, as amended by
Resolution No.95-01I, authorizing the establishment of a housing advisory boards for the
Westbrooke Patio Homes Association and the Meadow Creek Condominium Association, and
. specifYing criteria for membership of those advisory boards; and
WHEREAS, the City Council has determined that, in view of extensive cooperation with the
Meadow Creek Condominium Association, there is not currently a need to establish a housing advisory
board under the Housing Improvement Act in connection with Housing Improvement Area No, 1; and
WHEREAS, the City Council has also determined that such advisory board has not been
created in accordance with the Housing Improvement Act as of the date of this resolution; and
WHEREAS, the City Council has also determined to maintain the housing advisory board
authorized for the Westbrooke Patio Homes, subject to appointment of members thereon by the City
Council in accordance with the Housing Improvement Act.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hopkins,
Minnesota as follows:
), Resolution Nos, 94-074 and 95-011 are hereby modified by deleting the establishment of a
housing advisory board for the Meadow Creek Condominiums.
2. Resolution Nos. 94-074 and 95-011 are further modified by providing that the City Council
shall appoint the members of the housing advisory board for the Westbrooke Patio Homes, which
members shall otherwise meet the requirements specified in Resolution No, 94-074.

e 3. The City Council hereby appoints the persons listed on Exhibit A hereto as members of the
housing advisory board for Westbrooke Patio Homes, The term of office of each member of the
housing advisory board shall expire upon action by the City Council to appoint another person to fill
that office or otherwise modify the terms of that office, Vacancies on the advisory board shall be filled
by appointment of a replacement by the City Council.
4. The City Council reserves the right to create a housing advisory board for the Meadow
Creek Condominiums and Housing Improvement Area No. 1 if such board is found to be in the public
interest, in which case the City Council shall appoint the members of such board in accordance with
the Housing Improvement Act and the criteria specified in Resolution Nos, 94-074 and 95-011.

RESOLUTION APPROVING ESTABLISHMENT OF
HOUSING ADVISORY BOARD FOR
THE WESTBROOKE PATIO HOMES &
MEADOWCREEK CONDOMINIUM ASSOCIATION
WHEREAS, the City of Hopkins has secured approval of
legislation allowing for the establishment of residential special
service districts; and
WHEREAS, this legislation allows for the city council to
create an advisory board in conjunction with the creation of a
housing improvement area; and
WHEREAS, the City of Hopkins has been working with both the
MeadowCreek Condominium Association and the Westbrooke Patio
Homes Association concerning the creation of a special service
district.
NOW THEREFORE, BE IT RESOLVED by the city Council of the
. city of Hopkins that the following advisory boards are authorized
to be formed:
0 The Westbrooke Patio Homes Association special service
District Advisory Board;
0 The MeadowCreek Association Special service District
Advisory Board.
BE IT FURTHER RESOLVED that members to these advisory boards
shall be appointed by the individual respective association
board, that such members shall be property owners within their
respective associations, and that a majority be owner/occupants.
NOW BE IT FURTHER RESOLVED that said advisory board shall
act in an advisory capacity to both the city Council of the city
of Hopkins and their respective association board in connection
with the planning and construction of housing improvements
including, but not limited to, the following responsibilities:
0 recommending to the respective association board an
individual or firm to be hired as project manager;
0 assist in the physical inventory of property and
development of scope of work;
. 0 coordinate activities in conjunction with preparation
of a long range physical improvement plan;

. view and recommend award of construction bid; -

0 solicit support for creation of these special service
districts and coordinate petitioning process;
0 monitor construction and process contractor payments.
BE IT FURTHER RESOLVED that such groups shall cease to exist
on December 31, 1996 unless extended by action of the Hopkins
City Council.

THE HOUSING ADVISORY BOARD FOR THE

WHEREAS, the City of Hopkins has secured approval of legislation allowing for
the establishment of a residential special service district; and
WHEREAS, this legislation allows the City Council to create an advisory board
in conjunction with the creation of a housing improvement area; and
WHEREAS, the City Council has previously approved Resolution 94-074,
approving establishment of housing advisory boards for both the Westbrooke Patio
Homes Association and the Meadow Creek Condominium Association, and that
members to these advisory boards shall be appointed by the respective
. association boards, and that such members shall be property owners within their
respective associations, and that a majority be owners/occupants; and
WHEREAS, in discussions with the Meadow Creek Condominium Association it
has been determined that it will not be possible to meet the requirement that the
majority of advisory board members be owners/occupants, as the majority of the
owners are presently investor-owners.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Hopkins,
that Resolution 94-074 is amended to allow the majority of the members of the
Meadow Creek Association Special Service District Advisory Board to be 60 percent
investor-owners and 40 percent owner-occupants.
