CR 95-58 Beer License - Hopkins Jaycees , 1 D ,. m .~ _. -~,~~~t 4' .J (::J , '" iJ P K \ April 12, 1995 Report No. 95-58 3.2 BEER LICENSE - HOPKINS JAYCEES Proposed Action: Staff recommends adoption of the following motion: Move that the Hopkins City Council approve the 3.2 beer license for the Hopkins Jaycees for Mainstreet Days, with the condition that no beer be served after 12:30 a.m. Overview: The Hopkins Jaycees have applied for a 3.2 beer license for Mainstreet Days, Friday, May 19th and Saturday, May 20th. The Police Department has reviewed the application and can . find no reason to deny. Primary Issues to Consider: 0 Limit on the number of temporary licenses. state law sets limits on cities when issuing temporary liquor licenses. An organization is limited to three temporary licenses in a calendar year. This 1S the first temporary license for the Hopkins Jaycees in 1995. 0 Time limits on sales. Staff recommends the following motion: Move to approve first readinq of ordinance number 95-765 an ordinance arnendinq section 400 of the Hopkins City Code and adoptina the latest edition of the State Buildinq Code. Approval of this motion will approve a first reading of an ordinance that will update the city's building code to the latest standards required by state statutes. OVerview. Minnesota statutes require that all communities that enforce a building code use the state Building code. Communities cannot be more or less restrictive than the state Code. The state from time to time updates the code to incorporate the latest edition of the Uniform Building Code and includes new state standards that take into account the latest building technology. The state code was recently updated to include the . 1994 Uniform Building Code. The code must be adopted by the City to be properly enforced. Included in the 1994 Uniform Building Code is an updated fee schedule. This fee schedule will increase permit fees about 40%. The city can modify this schedule. Hopkins Building permit fees have not increased since 1985 and staff feels the new schedule appropriate. The city of Hopkins currently uses the 1988 Uniform Building Code Table 3-A as its fee schedule. The fees in this table were based on a study of actual code enforcement costs nationwide in 1983 and first printed in the 1985 Uniform Building Code. The fees published in the 1985 code Table ]-A have not been updated until the recent printing of Table I-A (formally 3-A) in the 1994 Uniform Building Code. The fee in the 1994 code was based on a nationwide study of the costs of proper code enforcement in 1992. A majority of the communities surveyed in Minnesota, two years ago, used table 3-A for the fees they charged on building permits. Most communities I talk to are intending or already have adopted the new table 1-A. A few are planning to phase in the fees over the next couple years. When the fee study was put together in 1992, I was Chairman of the Code Development Committee that studied these fees. I did a fee comparison on Hopkins with respect to our actual enforcement costs. The data was included in the nationwide study. The fee study I did of Hopkins indicated that in order for us to cover our enforcement costs an increase would be appropriate when the 1994 code table became available. 4It Staff believes the increase to the new table I-A is justified and should be adopted without modification. Adoption of this ordinance will reaffirm and adopt all of the Mandatory provisions of the state code and further, adopt optional chapters 31 and 33. Chapter 31 establishes standards and permits for membrane structures (air inflated) and chapter 33 excavation and grading. optional Minnesota rule 1306, commonly referred to as Appendix E optional Fire Sprinkler provisions, is Not included. Following this course of action may make the city's building code unenforceable 1n court . e ------ ------- - ~ Ordinance No. 95-765 AN ORDINANCE RELATING TO BUILDING, HOUSING AND CONSTRUCTION REGULATIONS AMENDING SECTION 400 OF THE HOPKINS CITY CODE BE IT ORDAINED by the Council of the City of Hopkins as follows: SECTION 1. That Hopkins City Code is amended by revising sections 400.03 to read as follows: 400.03 Adoption of Minnesota State Buildino Code. Subdivision 1.Building Code. The Minnesota Sate Building Code, one copy of which is on file in the offices of the city Clerk, has been adopted by Minnesota statutes, section 16B.59 to 16.B7~~ as a Uniform Building Code for the State. The state Building Code is hereby confirmed as the building code of the city and is incorporated in this chapter as completely as if set out in full. Subd.2 Adoption bv reference.
