May 11, 1995 o P K \ ~ PINES MOBILE HOME PARK Proposed Action, Staff recommends approval of the following motion: Move to approve the extension of the time period to complete the required improvement at the Pines Mobile Home Park in accordance with Hennepin County District Court File 93050019 for a period of 90 days following written notice to the property owner or December L 1995, whichever comes first. Overview. The Hopkins City Council passed an ordinance in 1990 requiring owners of manufactured home parks to take certain actions and make certain improvements to their parks within a specified period oftime. The owner of the Pines Mobile Home Park, Gerald Hartman, H & H Pines Park I Partnership, was notified in February 1993 that he was not in compliance with this ordinance, as various required improvements had not been completed in the park. In July 1993 a criminal complaint was filed in Hennepin County District Court against Mr. Hartman. In May 1994, Mr. Hartman plead guilty and was required to undertake one of the . following. . Provide a closure notice to the residents of the park by January 1, 1995. . Complete all required improvements as set forth in the Hopkins City ordinances by August 19, 1995. In October 1994, H & H Pines entered into a purchase agreement with the Oaks of Mainstreet, Inc. The prospective buyer is interested in redeveloping this property with a townhouse project. The buyers are requesting an extension on the time period for completion of necessary improvements to the park to give them additional time to facilitate this redevelopment project. Upgrade electrical service to the park, including under-grounding to individual units. . Prepare and submit to the City a plan detailing the size and location of the park's water and sewer piping system. None of these improvements required under City ordinance is a major health/safety concern, except for construction of a storm shelter, which has already been completed. 0 What is the reason for the proposed action? On October 30, 1994, the owner of the Pines executed a purchase agreement with a developer, Since that time the developer has been exploring various alternatives to facilitate a residential redevelopment project on this property. It is Staff's understanding that since the purchase agreement has been executed, the developer has undertaken the following. . Contracted with a financial advisor to evaluate various financing alternatives. . Contracted for completion of a market study. . The developer is requesting the proposed action in order to secure an extension on his purchase agreement with the owner of the Pines, which expires in the near future. This will allow the developer additional time to address the various steps necessary to facilitate the proposed project. One of these steps will involve discussing the overall development concept with the City Council at an upcoming meeting. This is tentatively scheduled for June 6. 0 What are the specifics of the proposed development project? The developer has stated that he is considering a townhouse project. A total of 60 units is being contemplated. In discussing the project, it appears that a fairly significant level of public involvement may be required, The developer is proposing to discuss the project specifics with the Council on June 6. Prior to that meeting, the developer may be scheduling individual meetings with the Council members, 0 What is the impact of this action? The only impact of approving the proposed action is to extend the time period for which the required improvements, in accordance with City ordinance, are required to be completed by the park owner. . . # Council Report 95-89 Page 3 e Alternatives The City Council has the following alternatives regarding this matter: 1. Approve the action as recommended by Staff With this action it is assumed that an extension to the purchase agreement will be provided to the developer by the property owner. 2. Continue the matter for further information. 3. Deny the request. In order to complete negotiations to acquire and develop the property as Townhomes, we need an extension of the purchase agreement (see attached. extension). A3 a condition of granting that . extension, the seller requires that the cities requirement that certain improvements to the park be c;ompleted no later than August 19} 1995 be extended to December 1~ 1995. We are writing to request that the City agree to forebear exercising any of its rights and remedies against the owner of the subject property relating to the condition of the operation ofthe subject property fOI a period of 90 days following written notice to the owner but in no case beyond December 1, 1995. The additional time is necessary to complete our negotiations to accomplish a townhouse redevelopment project bn the site of the existing trailer park.
