CR 95-100 Approval of Second Amendment To the Joint And Cooperative Agreement June 1, 1995 ~ Council Report 95-100 e APPROVAL OF SECOND AMENDMENT TO THE JOINT AND COOPERATIVE AGREEMENT ProDosed Action Staff recommends that the Council approve the fonowing motion: Move that the Hopkins City Council approve the second amendment to the Joint and Cooperative Agreement. Adoption of this motion will authorize the Southwest Suburban Cable Commission (SWSCC) to adopt bylaws and other polices and procedures relating to its own governance and operations. Overview This is a housekeeping matter. The Commission, at its retreat, discussed changes that it wanted to make in the way it conducted meetings, etc. The Commission's attorney recommended that an amendment be made to the Joint and Cooperative Agreement which would authorize the Commission to take these actions. This action is unrelated to the proposed transfer of the cable system. e The Joint and Cooperative Agreement is the agreement among the cities of Hopkins, Edina, Eden Prairie, Minnetonka and Richfield which created the Southwest Suburban Cable Commission. Article VII, Section 3, to add a new paragraph T to read as follows: VII. Powers and Duties of the Commission and Parties. Section 3. Powers and Duties of the Commission. Subject to the provisions of Section 2, the following powers and duties are delegated by the . Parties to the Commission: T. Procedures Relating to the Governance of Commission Operations. Notwithstanding any provision contained in this Agreement, with respect to the operating procedures of the Commission, the Commission is hereby authorized to establish from time to time bylaws or other policies and procedures relating to its own governance and operations including procedures relating to meetings, dates of meetings, agendas, information contained on agendas and the functions of the Operating Committee and Commission.
