Accept Petition for Private Improvement
Jaycees Property 10 6th Ave. N.
Proposed Action.
Staff recommends the following motion: Move that Council adopt
Resolution 95-48. Resolution Approvina petition for Private
Imorovement at 10 6th Avenue North.
This action approves of private parking lot improvements at the
Jaycees property and sets in motion the process to levy the costs
of such improvements as a special assessment against the
property.
Overview.
Upon approaching the Jaycees organization for an easement
regarding the proposed alley improvements adjacent to their
property, that organization gave verbal approval. The
organization stated its intent to make parking lot improvements
adjacent to the alley and requested that costs of such work be
allowed as a special assessment against their property. The
Jaycees have submitted a petition to that effect.
e Primary Issues to Consider.
. Is the petition valid in form and principle?
Staff has examined the petition and found it accurate in
form. It is also valid in principle in that it falls within
MS 429 guidelines as an assessable project.
. Staff recommendation
considering the Jaycees willingness to grant an easement for
the City's alley reconstruction project without demand for
compensation, staff finds no difficulty in recommending
approval of the petition.

e PETITION AND WAIVER BY PROPERTY OWNER(S)
Hopkins Area Jacyees, Inc., hereinafter caned the Owner, states that it has ownership interest in property
at 6 Sixth Ave. North, Hopkins, Minnesota, particularly described as:
Lot 9, induding one-half of adjacent vacated alley, Block 65, West Minneapolis
Second Division, according to the plat on file and of record in the office of the
County Recorder, Hennepin County, Minnesota.
Said Owner hereby petitions the City of Hopkins to make the arrangements necessary to:
1. Remove existing deteriorated bituminous surface from a parking lot adjacent to the Jaycees
building at 6 Sixth Ave. North, regrade the lot, provide an aggregate base and resurface with a 3"
thick bituminous surface. This work should be done in conjunction with planned alley
improvements.
2. Arrange to place the cost of the parking lot improvements as a special assessment on the property
at a rate of 8% over 10 years.
e The Owner hereby waives any right to notice or objection to said improvement as provided in Chapter
429 of the Minnesota Statutes and any other provisions of municipal or state law providing for notice or
objections. The Owner understands that the aforesaid property will be assessed for the costs for the
aforesaid work.

RESOLUTION APPROVING PETITION FOR PRIVATE IMPROVEMENT
10 6TH AVENUE NORTH
WHEREAS, the owners of property located at 10 6th Avenue North,
Hopkins, Minnesota, have petitioned for an improvement
consisting of the reconstruction of a parking lot pursuant
to Minnesota Statute No. 429.031, Subd. 3 . and
,
WHEREAS, the petition and accompanying documents thereto comply
with the requirements of the aforementioned statute.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
HOPKINS, MINNESOTA:
1. Such improvement is hereby ordered as proposed and requested
in the petition.
2. That the Engineering Superintendent be directed to include
the plans and specifications for construction and
installation of the parking lot in the bid documents of the
e pending alley reconstruction project.
3 . That said installation and construction be in conformance
with Minnesota Statute Chapter 429 and all state and
municipal codes, ordinances and regulations pertaining
thereto.
Adopted by the city Council of the city of Hopkins this 6th day
of June, 1995.
