Proposed Action.
staff recommends adoption of the following motion: Move that
Council adopt Resolution 95-47, Resolution Approvina petition for
a Fire Protection System, 821 Mainstreet.
Adoption of this resolution will provide funding for a private
sprinkler system and fire door at 821 Mainstreet.
OVerview.
The owners of property at 821 Mainstreet are proposing to install
automatic sprinklers and a fire door. They wish to finance the
cost of this installation under the city's current fire
protection program where funds are made available to commercial
ventures for such protection. The owners have submitted a
petition and proposals that total $10,865.00.
MS 429 permits installation of fire safety related devices and
. equipment to be installed and assessed to benefited properties.
The amount to be assessed would be the total cost of the project
plus an administrative fee as outlined in the city's Legislative
Policy. Present policy is to charge 8% interest and to assess
over a ten-year period.
Primary Issues to Consider.
. Should Council approve the petition?
The petition and proposal meet all policy and code criteria
and staff recommends approval.
. Are adequate funds available?
This is the first 1995 project of this nature. By policy the
City sets aside $200,000 for a given calendar year for fire
protection petitions. Ample funds are available.

Todd Johnson and David Swanson, hereinafter caned the Owners, state that they have ownership interest
in property at 821 Mainstreet, Hopkins, Minnesota, particularly described as:
Lot 13, Block 57, West Minneapolis Second Division
Said Owners hereby petition the City of Hopkins to make the arrangements necessary to:
1. Place the cost of a fire protection system and fire door at 821 Mainstreet as a special assessment
against the property.
2. Assess the costs over ten years at 8% per annum.
3. Charge an administrative fee of 5% or $100.00, whichever is greater.
Owners hereby waive any right to notice or objection to said improvement as provided in Chapter 429 of
the Minnesota Statutes and any other provisions of municipal or state law providing for notice or
objections. Owners understand that the aforesaid property will be assessed for the costs for the aforesaid
work.

RESOLUTION APPROVING PETITION FOR A FIRE PROTECTION SYSTEM
WHEREAS, the owners of property located at 821 Mainstreet,
Hopkins, Minnesota, have petitioned for an improvement
consisting of the installation of a fire protection system
pursuant to Minnesota Statute No. 429.031, Subd. 3 . and
,
WHEREAS, the petition and accompanying documents thereto comply
with the requirements of the aforementioned statute.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
HOPKINS, MINNESOTA:
1- Such improvement is hereby ordered as proposed and
requested in the petition.
2 . That the Engineering Superintendent and Fire Marshal be
directed to review and approve the plans and
specifications accompanying the petition for the
construction and installation of the fire protection
. system.
3. That said installation and construction be in
conformance with Minnesota Statute Chapter 429 and all
state and municipal codes, ordinances and regulations
pertaining thereto.
4. That periodic inspections be conducted by the city of
Hopkins to assure compliance with said codes and
requirements.
Adopted by the City Council of the City of Hopkins this 6th day
