RELEASE OF EASEMENT
ELMO PARK ADDITION
Proposed Action.
Staff recommends adoption of the following motion: "Move that Council
authorize the Mayor and City Clerk siqnatures to a quit claim deed
releasinq certain snow fence easements over Elmo Park Addition
(Brentwood Townhomes) .11
Overview.
In April 1986 MNjDOT conveyed ownership of North Service Drive,
paralleling T.H. 7, to the City of Hopkins. To that conveyance were
attached certain easements over adjacent properties. These easements
were acquired by MN j DOT over the years. One of the easements,
acquired in 1932, was a snow fence easement over property now
developed as the Brentwood Townhomes. The owner of that property is
requesting a release of that easement in order to complete a
refinancing transaction.
Primary Issues to Consider
o
Is the snow fence easement needed?
The need for snow fences hearkens to an era when open spaces and
very little development was found along metro highways. Existing
conditions render a snow fence easement, especially at Brentwood
Townhomes, a moot issue.
o Ramifications of Council action?
The owner of the Brentwood Townhomes faces a closing within the
next two weeks in which he anticipates the refinancing of the
property. Council action now in releasing the easement would
help greatly ln making the property marketable from a title
standpoint.
