CR 95-120 Temporary Beer License For Hopkins Slowpitch June 30, 1995 e ~ Council Report 95-120 TEMPORARY 3.2 BEER LICENSE FOR THE HOPKINS GIRLS SLOWPITCH ASSOC. Pronosed Action Staff recommends that the Council approve the following motion: Move that the Hopkins City Council continue action on a temporary 3.2 beer licenses for the Hopkins Girls Slowpitch Assoc. Adoption of this motion will allow the Chemical Health Commission an opportunity to review this license request. Overview Mr. Bob Beckers, of the Hopkins Girls Slowpitch Assoc., has approached the city for permission to hold a "Blues, BBQ FestivaP' on August 5th and 6th. Mr. Beckers plans to have 12 hours of Blues music plus a tent where beer and BBQ would be sold. The purpose of this festival is to raise money for the Hopkins Girls Slowpitch Assoc. Mr. Beckers has submitted a Special Event permit and applied for a temporary 3.2 beer license. Because this is not one of the pre-approved special events, Mr. Beckers would have to reimburse the city for any assistance that was provided during the course of this festival. . Primary Issues to Consider · What concerns exist regarding this event? Staff has a number of concerns regarding this event.: ]) possible complaints from the neighborhoods regarding noise; 2) selling beer in connection with an event for youth; 3) possible parking problems. . Should the beer license be reviewed by the Chemical Health Commission? The Chemical Health Commission has requested that they be given an opportunity to review temporary beer and alcohol applications, especially when they are issued in conjunction with events involving youth. The Chemical Health Commission will be meeting on July 10. lfthe City Council waits for the Chemical Health Commission's review, the Council will not be able to act on the beer license until its July 18 meeting. Mr. Beckers has indicated that this is too late for planning his Festival. · Have the various city departments reviewed these applications? The police department is reviewing the beer license application. The Special Event permit is currently being reviewed by the street department, parks, and police department. Staff will have these . applications back from these departments prior to the City Council meeting. . Alternatives 1. Continue this item until the July 18 meeting and request that the Chemical Health Commission review the beer license application. This action will give the Chemical Health Commission time to review the application. However, Mr. Beckers has stated the delaying a decision until July 18 would make it very difficult to organize this festival. 2. Approve the 3.2 beer license and authorize the holding of this festival in Central Park. This action would allow Mr. Beckers to proceed with his plans to hold the festival. 3. Deny the 3.2 beer license but authorize the holding of this festival in Central Park. This action would allow the festival to proceed but without the sale of beer. Mr. Beckers, however, has indicated that without the sale of beer very little money could be raised. 4. Deny the 3.2 beer license and holding this festival in Central Park. POLICY 5-D SPECIAL EVENTS POLICY 1. PURPOSE 1.01 The purpose of this policy is to set forth procedures to be followed by organizers of Special Events who wish to use city property and/or require city services. 2. DEFINITIONS 2.01 Basic Services include the setting up and removal of barricades and the portable stage, and access to electric outlets. 2.02 Special Events are defined as any parade, race, procession, carnival, community picnic, celebration, fund raiser, dance, concert, large assembly, or other special event on City property (except parkland) within the corporate limits of the City of Hopkins 2.03 City Sponsored Activities are special events sponsored wholly or in part by the City of Hopkins. The City both insures and provides Basic Services without charge for these events. 2.04 Pre-Approved Activities are special events for which the City provides Basic Services without charge. Pre-Approved Activities include: a. Music In the Park activities b. St. Patrick's Day Parade c. Raspberry Festival d. Homecoming Parade e. Sleigh Rides f. Christmas in the Park g. Mainstreet Days h. Farmer's Market i. Heritage Days 3. REGULA TIONS AND PROCEDURES 3.01 Any person or organization wishing to sponsor a Special Event must obtain a Special Event Permit. Legislative Policy Manual -- Chapter 5- D Page 1 3.02 Application for the permit shall be made not less than forty-five (45) days before the special event. e 3.03 Applications for a permit for a Special Event wi11 be available at the City Clerk's office, and when approved, shall become a part of the permit. 3.04 A permit fee in the amount of$25.00 shall accompany the application. 3.05 Special Events which are not sponsored by the City will require Liability Insurance naming the City of Hopkins as additional insured. 3.06 Special Events which are not sponsored by the City or Pre-Approved may require a deposit of not less than $200. 3.07 The cash deposit will be calculated based on the anticipated and potential cost to the City of Hopkins, and shall be submitted no less than twenty (20) days before the special event. 3.08 The return of the deposit is conditioned upon the applicant having not requested nor received services which are a cost to the City of Hopkins and the applicant causing no damage to the public or private property in the City of Hopkins, and further conditioned upon the fact that the applicant will remove all dirt, paper, litter, or other debris generated by its operations, from the site of the event and the adjoining premises upon completion of the event. 3.09 The amount of the cash deposit shall be determined by the City Manager. . 3.10 Issuance of a Special Event Permit does not constitute a waiver of any Federal, State or Local laws. Applicants are responsible for complying with all applicable Federal, State, and Local laws. 3.11 Issuance of a Special Event Permit does not, in any way, imply City sponsorship of the Special Event.
