ProDosed Action.
Staff recommends adoption of the following motion: Move that
Council adoot Resolution 95-85. Resolution for AdoDtion of
Assessment Roll. 1995 Miscellaneous and Certain Private
Imcrovements Soecial Assessments.
Overview.
The proposed special assessments as described in Exhibit A are
for delinquent utility, tree removal, false alarm, debris/refuse
removal, and mowing invoices. Also included are parking ramp
maintenance and several private improvements. Notices of this
hearing have been published, and both notices and assessment
statements have been mailed to all affected owners.

NOTICE OF ASSESSMENT HEARING
NOTICE IS HEREBY GIVEN that the city Council of Hopkins,
Minnesota, will meet in the Council Chambers of the Hopkins city
Hall, 1010 1st Street South, Hopkins, Minnesota at 8:00 p.m. on
Tuesday, October 3, 1995, to pass upon the proposed special
assessments of costs of certain private improvements in the city
of Hopkins; for the costs of delinquent utility, tree removal,
false alarm, debris/refuse removal, and mowing bills; and for the
costs of maintenance of a parking ramp, all more particularly
described in Exhibit A hereto attached and hereby made a part
hereof.
(EXHIBIT A)
All persons who wish to be heard, or to object with
reference to this matter may present their cases at this hearing
either orally or in writing. No appeal may be taken as to the
amount of any assessment adopted unless a written objection
signed by the property owner is filed with the Assessment Clerk
prior to the assessment hearing or presented to the presiding
officer at the hearing. Even though appeals are due by the
hearing date on October 3, 1995, the city Clerk strongly
recommends that appeals be submitted to the Assessment Clerk1s
office by September 27, 1995. Appeal forms will be available at
the assessment hearing or at the Assessment Clerk's office at the
Hopkins City Hall, 1010 1st street South, Hopkins, Minnesota.
An owner may appeal an assessment to district court pursuant
to MSA Section 429.081 by serving notice of the appeal upon the
Mayor or City Clerk of the city of Hopkins within thirty (30)
days after the adoption of the assessment and by filing such
notice with the district court within ten (10) days after service
upon the Mayor and city Clerk.
Under provisions of Minnesota statutes Section 435.193 to
435.195 the City may, at its discretion, defer the payment of
assessments for any homestead property owned by a person 65 years
of age or older for whom it would be a hardship to make the
payments. The procedures to apply for such deferment are
available from the Assessment Clerk. Deferment applications
should be submitted to the Assessment Clerk by September 27,
1995.

The following information shall also apply:
1. The property owner shall have the right to prepay the
entire assessment. Your assessment may be paid without interest
from October 3, 1995 to November 2, 1995, to the Assessment Clerk
at City Hall, 1010 1st street South, Hopkins, Minnesota. You may
at any time thereafter, pay to the Assessment Clerk the entire
amount of the assessment remaining unpaid, with interest accrued
to December 31 of the year in which such payment is made. Such
payment must be made by November 30, 1995 or interest will be
charged through December 31 of the succeeding year.
2. Partial prepayment of the assessment in excess of 25
percent of the total assessment has been authorized by ordinance.
A partial prepayment can only be made prior to November 30, 1995
with interest accrued to the payment date, except that no
interest shall be charged if such partial payment is made by
November 2, 1995.
3. In the case where accrued interest applies, the rate of
interest to be accrued, if the assessment is not prepaid within
the required time period, is proposed to be 8 percent commencing
on the date of adoption by the city Council.
4. The amount to be specially assessed against your
property is shown on the statement of assessment sent to you by
ma i 1 .
This is an important hearing because this is your last
opportunity to be heard on the matter of this assessment which
affects your property. If you have any questions regarding this
assessment, please call the Engineering Department or the
Assessment Clerk at 935-8474.

RESOLUTION NO. 95-85
ADOPTION OF THE ASSESSMENT ROLL
1995 MISCELLANEOUS AND CERTAIN PRIVATE
IMPROVEMENTS SPECIAL ASSESSMENTS
WHEREAS, pursuant to property notice duly given as required
by law, the City Council has met and heard and passed upon all
objections to the proposed assessment for miscellaneous projects,
delinquent utility bills, and delinquent invoices, all as more
fully set forth and described in Exhibit A as attached to this
resolution, and has amended such proposed assessment as it deems
just,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
HOPKINS, MINNESOTA:
.
1. Such proposed assessment, as amended, a copy of which is
attached hereto and made a part hereof, is hereby accepted and
shall constitute the special assessment against the lands named
therein, and each tract of land therein included is hereby found
to be benefited by the proposed improvement in the amount of the
assessment levied against it.
2. Such assessments shall be payable in equal, annual
installments extending over the periods of years set forth in
Exhibit A, the first of the installments to be payable on or
after the first Monday in January, 1996. Any deferred
installments shall bear interest at the rate set forth in said
Exhibit A from the date of the adoption of this assessment
resolution. To the first installment shall be added interest on
the entire assessment from October 3, 1995 until December 31,
1996. To each subsequent installment when due shall be added
interest for one year on all unpaid installments.
3. It is hereby declared to be the intention of the Council
to reimburse itself in the future for the portion of the cost of
this improvement paid for from municipal funds by levying
additional assessments, on notice and hearing as provided for the
assessments herein made, upon any properties abutting on the
improvement but not made, upon any properties abutting on the
improvement but not herein assessed for the improvement, when
changed conditions relating to such properties make such
assessment feasible.

4. To the extent that this improvement benefits nonabutting
properties which may be served by the improvement when one or
more later extensions or improvements are made, but which are not
herein assessed, therefore, it is hereby declared to be the

intention of the council, as authorized by Minnesota statutes
section 420.051, to reimburse the city by adding any portion of
the cost so paid to the assessments levied for any of such later
extension or improvements.
5. The clerk shall forthwith transmit a certified
duplicate of this assessment to the County Auditor to be extended
on the property tax lists of the county, and such assessments
shall be collected and paid over in the same manner as other
municipal taxes.

One appeal is also attached. A summary of the appeal and staff's
recommended action follow below:
Appeal Request:
Owner of property at 329 15th Avenue South has requested a
cancellation of assessment by reason that the City failed to
respond properly to the owner's request for scheduling a
water meter change.
staff Recommendation:
staff recommends denial of the appeal on the basis that
staff consistently followed established policies and codes
in handling the issue of a water meter change and that the
owner's appeal statement is at variance with staff's
recollection and recording of events.
