Proposed Action.
Staff recommends adoption of the following motion: Move that
Council Adopt Resolution 95-62, Resolution Approvinq Petition for
Fire Protection SYstem, 619 14th Ave. South.
Adoption of this resolution will provide funding for a private
sprinkler system.
Overview.
The owner of property at 619 14th Avenue South is proposing to
install a 6" water main extension, to replace an existing
domestic water line, and install a fire protection sprinkler
system complete with monitoring devices. He wishes to finance
the cost of this installation under the City's current fire
protection program in which funds are available to commercial
businesses for such protection. The owner has submitted a
petition and proposal that totals $23,955.00.
. MS 429 permits installation of fire safety related devices and
equipment to be installed and assessed to benefited properties.
The amount to be assessed would be the total project cost
together with an administrative fee outlined in the City'S
Legislative Policy #8C. Present policy is to charge 8% interest
over a ten-year term.

The petition and proposal meet all policy and code criteria,
and staff recommends approval.
0 Are adequate funds available?
This is the second 1995 project of this nature. By policy
the City sets aside $200,000.00 for a given calendar year for
fire protection petitions. Ample funds are available.

Gary Ouellette, hereinafter caned the owner, states that he has ownership interest in property at 619 14th
Ave.So., Hopkins, Minnesota, more commonly known as Hopkins Tire and Auto Service and particularly
described as:
Lot 8, Block 1, Mason Industrial Addition, induding the adjoining 26.3 feet of the vacated 14th
Ave. South lying north of the westerly extension of the south line of Lot 8, Mason Industrial
Addition and southerly of the Soo Line Railroad Company right-of-way.
Said owner hereby petitions the City of Hopkins to make the arrangements necessary to:
1. Place the cost ofa fire protection system at 619 14th Avenue South as a special assessment
against the property.
2. Assess the costs over 10 years at 8% per annum.
3. Charge an administrative fee of5% or $100.00, whichever is greater.
Owner hereby waives any right to notice or objection to said improvement as provided in Chapter 429 of
the Minnesota Statutes and any other provisions of municipal or state law providing for notice or
e objections. Owner understands that the aforesaid property win be assessed for the costs for the aforesaid
work.

RESOLUTION APPROVING PETITION FOR A FIRE PROTECTION SYSTEM
619 14TH AVENUE SOUTH
WHEREAS, the owner of property located at 619 14th Avenue South,
Hopkins, Minnesota, has petitioned for an improvement
consisting of the installation of a fire protection system
pursuant to Minnesota Statute No. 429.031, Subd. 3 . and
,
WHEREAS, the petition and accompanying documents thereto comply
with the requirements of the aforementioned statute.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
HOPKINS, MINNESOTA:
1- Such improvement is hereby ordered as proposed and
requested in the petition.
2. That the Engineering superintendent and Fire Marshal be
. directed to review and approve the plans and
specifications accompanying the petition for the
construction and installation of the fire protection
system.
3. That said installation and construction be in
conformance with Minnesota Statute Chapter 429 and all
state and municipal codes, ordinances and regulations
pertaining thereto.
4. That periodic inspections be conducted by the city of
Hopkins to assure compliance with said codes and
requirements.
Adopted by the city Council of the city of Hopkins this 1st day
of August, 1995.
