REZONING AND COMPREHENSIVE PLAN CHANGE--SIXTH TO EIGHTH A VENUES
Proposed Action.
Staff recommends the foHowing motion: Move to approve Resolution 95-64 approving a Comprehensive
Plan amendment from Medium Density Residential to Low Density Residential and Ordinance 95-774 for a
rezoning from R-4 to R-I-A for the area between Sixth and Eighth Avenues North. south of First Street
North and north of the railroad right-of-way for first reading.
At the Zoning and Planning meeting, Mr. Gleeson moved and Mr. Blair seconded a motion to approve
Resolution RZ95-20 recommending a Comprehensive Plan amendment and a rezoning.
Overview.
In an effort to reduce the number of potential multi-family units within the City, the Planning Commission
has previously undertaken a process of amending the Comprehensive Plan to reflect new goals for the City
regarding multi-family sites. One of the goals in the Strategic Plan for Economic Development details for
Staff to review the potential multi-family sites and recommend changes. In conjunction with this process,
the Planning Commission has also reviewed several sites in the City that are either zoned or guided for
multi-family to determine if a change is appropriate.
The single family area between Sixth and Eighth Avenues North, south of First Street North and north of
e the railroad right-of-way, is currently zoned R-4, Medium High Density Multiple Family, and guided for a
medium density residential use. The existing uses are single family. This change will accomplish the
following.
0 Reduce the number of potential new multi-family units.
0 Bring the existing uses in conformance with zoning and the Comprehensive Plan.
0 Allow the Comprehensive Plan and zoning to be in agreement as relates to the future reuse of this area.

The zoning of the property is R-4, Medium High Density Multiple Family.
0 What has the Comprehensive Plan designated the subject site?
The Comprehensive Plan has designated the site as Medium Density Residential.
0 What types of uses are in this area?
The subject area contains single and two family homes, an apartment building, and one commercial
building. The surrounding uses are multi-family home, single family homes and businesses.
0 What has the Planning Commission recommended for the site?
The Planning Commission, in a previous discussion, recommended that the Comprehensive Plan
designation be changed from Medium Density Residential to Low Density Residential and rezoned from
R-4 to R-I-A. This recommendation is based on the following.
0 Interest to preserve single family houses.
. 0 Reduce the amount of potential additional multi-family units in the City (67-174 units could be added
with medium density residential zoning).
0 What is Staff recommendation?
Staff would also recommend that the Comprehensive Plan designation be changed from Medium Density
Residential to Low Density Residential and the zoning from R-4 to R-I-A.. This is the zoning and
Comprehensive Plan designation of the majority of the existing uses.
0 What is the impact of this change?
The single family homes will become conforming with the proposed land use designation of R-I-A. The
apartment building will become legal non-conforming and will be allowed to remain in accordance with the
requirements of the zoning ordinance. The commercial use is legal non-conforming now and will continue
to be legal non-conforming. However, if these lots were redeveloped, only single and two family homes
could be constructed.
0 What occurred at the Zoning and Planning meeting?
Staff reviewed the area that the Comprehensive Plan change would amend and the rezoning
Representatives of the estate of 44 Sixth Avenue North appeared before the Commission. They were
. concerned that the rezoning would affect the property to be sold as a duplex. Staff stated that the
proposed changes would not affect the sale of the home as a duplex. It was noted that there is a 17 unit
apartment building in is area and a commercial use. Both uses will be legal non-conforming.

. Alternatives.
L Approve the Comprehensive Plan amendment and rezoning. By recommending approval of the
Comprehensive Plan amendment and rezoning, the area wi11 be rezoned to a lower density.
2. Deny the Comprehensive Plan amendment and rezoning. By recommending denial of the
Comprehensive Plan amendment and rezoning, the area will not be rezoned. Findings of fact will have
to be stated that supports this alternative.
3. Continue for further information. If the City Council indicates that further information is needed, the
item should be continued.

ORDINANCE NO. 95-774
AN ORDINANCE REZONING AN AREA NORTH OF MAINSTREET BETWEEN SIXTH
AND EIGHTH A VENUES NORTH
BE IT ORDAINED by the City Council of the City of Hopkins as follows.
That the present zoning classification ofR-4, Medium High Density Multiple Family, upon
the following described premises is hereby repealed, and in lieu thereof the said premises is hereby
zoned as R-I-A, Single and Two-Family High Density.
Lot I, Block 67 West Minneapolis Second Division
Lots 17-19, Block 66, West Minneapolis Second Division
Lots 1-5, Block 66, West Minneapolis Second Division
Lots 13-19, Block 65, West Minneapolis Second Division

RESOLUTION MAKING FINDINGS OF FACT
APPROVING AMENDMENTS TO THE ZONING ORDINANCE
AND THE COMPREHENSIVE PLAN FOR AN AREA BETWEEN
SIXTH AND EIGHTH A VENUES NORTH
WHEREAS, an application for a rezoning, ZN95-11, has been made by the City of Hopkins; and
WHEREAS, the procedural history of the application is as follows.
1. That an application for a rezoning and Comprehensive Plan Amendment ZN95-11 was made
by the City of Hopkins on June 30, 1995.
2. That the Hopkins Planning Commission, pursuant to published and mailed notices, held a
public hearing on the application and reviewed such application on July 25, 1995: all persons
present were given an opportunity to be heard.
. 3. That the written comments and analysis of City Staff were considered.
NOW THEREFORE, BE IT RESOL VED that the application for a rezoning and Comprehensive Plan
Amendment ZN95-11 is hereby approved based on the following Findings of Fact.
1. That a goal in the City of Hopkins Strategic Plan for Economic Development is to review the
multi-family zoned and guided property.
2. That the City has undertaken a detailed analysis of multi-family zoned and/or guided
sites in Hopkins, including the subject site.
3. That the proposed amendment to the Zoning Ordinance and Comprehensive Plan is
consistent with the goals/policies in the Comprehensive Plan, including:
0 The City will work to provide an overall mixture ofresidentialland use in the City.
0 The City will work to correct the disproportional amount of multiple family land uses
within the City.
0 The City will work to provide a balance of land uses within the City.
0 The City will seek to provide housing opportunities for people in all segments of the
life cycle.
4. That the proposed amendment to the Zoning Ordinance and Comprehensive Plan is
consistent with the future land use designation in the Comprehensive Plan for the
property in question.

. BE IT FURTHER RESOLVED, that application for ZN95-11 is hereby approved based on the
following conditions.
1. That the Metropolitan Council approves the Comprehensive Plan change.
