CR 95-236 PH Residential Street ImprovementsDecember 11, 1995 Overview. 1 Y 0 0 P K PUBLIC HEARING 1996 RESIDENTIAL STREET IMPROVEMENTS Council Report: 95 -236 Proposed Action. Staff recommends adoption of the following motion: "Move that Council adopt Resolution No. 95 -120 ordering 1996 Residential Street and Alley Improvements and Authorize the City Manager to enter into an agreement with MSA Consulting Engineers for preparation of plans and specifications." Council at its regular November 21st meeting accepted a feasibility study concerning 1996 Residential Street Reconstruction and ordered a public hearing for December 19th. Notices were sent to all affected property owners. A public information meeting was held on December 7th for the Peaceful Valley and Westbrooke East neighborhoods. The Campbell neighborhood meeting was December llth. At these meetings, residents didn't question the need for the project. Rather, they had concerns regarding the amount of the assessment, how the assessment policy would be used, consideration for retired on fixed incomes, and whether the 8th Avenue & 7th Avenue reconstruction had to include two foot subgrade excavation and backfill. MSA Consulting Engineers prepared the project feasibility report and topographic surveys of the project areas. Staff is now recommending MSA continue with construction plans and specifications. MSA has proposed a fee of $90,582. The total engineering fee for the project, including feasibility report and survey, would be $99,785 or 14.7% of the estimated construction costs. This is a very reasonable cost as engineering fees for previous street projects have averaged 20% of construction costs. Stadler, Director of Public Works Council Report: 95 -236 Page 2 Analysis of Issues o Staff recommendation on assessment policy Current City policy allows several options for determining assessments and allows some staff discretion in "certain unusual cases ". This project involves three separate assessment areas. One of these areas is 8th Avenue south from 6th Street to 7th Street and 7th Avenue south from 7th Street to 8th Street. Another assessment area is the alley east of 6th Avenue south, north of 8th Street. The third area is the Sweetbriar Lane and Burnes Drive area. The first area (8th Avenue South and 7th Avenue South) is a rectangular lot area. As such, staff recommends distributing assessable project costs using actual front footage with 75 foot maximum of each lot abutting the improvement. Lot frontages range from 50 feet to 100 feet. The assessable project costs of $166,635 are high for two blocks of reconstruction. The higher costs are due to a recommendation to remove two feet of existing subgrade and backfill with granular borrow. This adds $69,380 to the project cost and means an assessment fee of more than $70 /foot of frontage. This would mean an assessment of at least $5,250 for each 75' lot. If challenged, the city may find it difficult to show this amount of benefit to these properties. As such, staff is recommending this additional work be paid by the city. This would lower the assessment to approximately $50- $55 /frontage foot, or $3,750 - $4,150 per 75' lot. The city has set precedent in using a 75' maximum front footage in past alley reconstruction projects. The second assessment area is the alley east of 6th Avenue South. Reconstruction assessments would be approximately $14 /LF based on actual frontage, or about $840 per 60' lot. The Sweetbriar Lane /Burnes Drive area involves primarily 75' frontage rectangular lots on Sweetbriar and odd - shaped lots with 83' to 220' of frontage on Burnes Drive. As a result, staff is recommending using an adjusted front footage based on lot areas as a percentage of total project lot area. Further, we're recommending a 75' minimum and 125' maximum front footage. This formula results in assessments ranging from $3,056 for the predominant 75' front footage rectangular lots on Sweetbriar to $5,093 for the large 1/2 acre lots on Burnes Drive (see attached Estimated Assessments spreadsheet). This is consistent with previous assessments done in Hobby Acres and Knollwood. In both of these cases, an adjusted front footage based on relative lot sizes was determined and a minimum and maximum assessable footage was used. 2) asphalt pavement reconstruction of the alley east of 6th Avenue South between 7th Street and 8th Street; 3) asphalt pavement milling and overlay of 8th Avenue South from 7th Street to 8th Street and 7th Avenue South from 5th Street to 7th Street, and the Council deems it prudent to undertake these street and alley improvements, and ten days mailed notice and two weeks published notice of the hearing was given, and the hearing was held thereon on the 19th day of December, 1995, at which all persons desiring to be heard were given an opportunity to be heard thereon, THEREFORE BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF HOPKINS, MINNESOTA: 1. Such improvement is hereby ordered as proposed on the Council resolution adopted the 21st day of November, 1995. 2. As we have done for the feasibility report and preliminary surveying, we are suggesting these tasks be compensated on an hourly basis with a total maximum not -to- exceed figure for each work element. The basis for these estimates are project segments identified in the feasibility report, using an estimated budget of $678,000 for construction costs. You have recently approved additions to the feasibility report and preliminary surveying to include work on Sweet Briar and the alley, and also extra meetings. As we understand, these additions will be presented to the City Council for consideration on December 19th. If approved, the total feasibility report budget will be $6,170 and the surveying budget for preliminary surveying would be $3,033. This total figure of $9,203 would be added to the total estimated fee to complete the remaining services for the project, $90,582. The total engineering fee for the project would then be $99,785, or approximately 14.7% of the total construction cost for the project.
