AUTO SALES LOT - 2021 MAINSTREET

Proposed Action.
Staff recommends the following motion: Move to approve Resolution 95 -111, approving a
conditional use permit to operate an auto sales lot at 2021 Mainstreet.
At the Zoning and Planning meeting, Mr. Brausen moved and Mr. Johnson seconded a motion
to recommend approval Resolution RZ95 -32 for a conditional use permit to operate an auto
sales lot at 2021 Mainstreet. The motion carried unanimously.
Overview.
The applicant, Scott Duneman, is proposing to operate an auto sales lot at 2021 Mainstreet,
which is on the northeast corner of Mainstreet and Shady Oak Road. The Zoning Ordinance
requires a conditional use permit for auto sales in the B -3 zoning district.
The subject site was the former site of Smith Import Motor Supply. Smith Import Motor
Supply has now moved to the building to the east.

Primary Issues to Consider.
o How is the property zoned, and how has the Comprehensive Plan designated the
subject site?
The subject property is zoned B -3, General Business. The Comprehensive Plan has
designated the site as Commercial. The proposed use conforms with both of these
documents.
o What are the conditions for a conditional use permit for an auto sales lot?
1. the sales lot shall not be larger in square footage than the square footage of the
building devoted to the related business;
2. a 20 -foot front yard setback, in which there shall be no auto parking. Within
this 20 feet setback there shall be a permanent barrier of landscaping;
3. lighting of the sales lot shall be totally from indirect lighting;
4. should the lot abut an R district, an acceptable design of screening fence five
feet in height shall be constructed along the abutting lot line; and
5. the auto sales lot shall not include vehicles over 9,000 lbs. rated weight.
The site plan, as submitted by the applicant, meets the above requirements.
What are the specifics for the proposed auto sales lot?
Landscaping
The site plan details a landscaped area on the Mainstreet side of the lot. The landscaping will
be a planter made from raised railroad ties. The railroad tie area will be filled with crushed
rock and there will be three planters within this area. The large planters will have two bushes
and one bush in the small. Staff feels that the landscaped area could be upgraded. Because
of the time of year, the applicant will not be planting the area until the spring. Staff is
recommending that the applicant work with the staff regarding the landscaped area in the
spring to provide a quality landscaped area.

The site will be lit from rooftop- mounted lights. Most of the lighting will be on the Mainstreet
side of the site, away from the residential area to the north.
Parking
The site plan indicated nine parking spaces for sale vehicles. The building is 1721 square feet,
which allows for nine "for sale" parking spaces. The site is required to have four customer
parking and employee spaces. The plan shows five customer and employee parking spaces.
Trash
The trash area will be located on the east side of the building and screened from Mainstreet.
Access
Access to the site will remain the same. The existing access is from Mainstreet and Shady
Oak Road.
Fencing
The applicant is proposing a five-foot high cedar fence on the north side of the property for 68
feet of the northerly property line. The Zoning Ordinance requires a fence on the entire lot
line that abuts a residential district.
Setbacks
The Zoning Ordinance requires a 20 -foot front yard setback that is landscaped. The site plan
indicates a 20 -foot front yard landscaped area.
Surrounding uses
The site is surrounded by a residential area to the north, The Pines Mobile Home Park to the
south, and commercial uses to the east and west.

What occurred at the Zoning and Planning meeting?
Staff reviewed the applicant's proposal. Scott Duneman, the applicant, appeared before the
Commission. Mr. Blair was concerned with the landscaping location. Staff noted that the
landscaping was a requirement of the conditional use permit and that there is the boulevard
between the landscaping and the roadway. Mr. Duneman stated that he was flexible regarding
the landscaping. Mr. Blair also suggested that the fence is six feet high; the site plan indicated
a five -foot fence. Mr. Duneman stated that he would construct a six -foot fence. At the public
hearing, Verna Lundeen of 18th Avenue South, appeared before the Commission. Ms.
Lundeen stated that a used car lot was not a good use for this property. Several members of
the Commission indicated that the used car lot will be a less intense use than the previous use
of an auto repair lot.

1. Approve the conditional use permit. By approving of the conditional use permit, the
applicant will be able to operate an auto sales lot at 2021 Mainstreet.
2. Deny the conditional use permit. By denying the conditional use permit, the applicant will
not be able to able to operate an auto sales lot at 2021 Mainstreet. If the City Council
considers this alternative, findings will have to be identified that support this alternative.
3. Continue for further information. If the City Council indicates that further information is
needed, the item should be continued.

RESOLUTION NO: 95 -111
RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A CONDITIONAL USE
PERMIT FOR AN AUTO SALES LOT AT 2021 MAINSTREET
WHEREAS, an application for Conditional Use Permit CUP95 -10 has been made by Scott
Duneman; and
WHEREAS, the procedural history of the application is as follows:
1. That an application for a Conditional Use Permit, CUP95 -10, was made by Scott
Duneman on October 27, 1995;
2. That the Hopkins Planning Commission, pursuant to mailed and published a notice,
held a public hearing on the application and reviewed such application on
November 28, 1995: all persons present were given an opportunity to be heard;
3. That the written comments and analysis of City staff were considered; and
4. A legal description of the property is as follows:
Lots 18 and 19 also part of Lot 17 lying westerly of a line running from a point in
north line of Lot 17 distance 100 feet east from northwest corner of Lot 19 to a
point in south line of Lot 17 distance 28 feet east from southwest corner of said
Lot 17 excluding road, Block 13, West Minneapolis Third Division.
NOW, THEREFORE, BE IT RESOLVED that the application for Conditional Use Permit
CUP95 -10 is hereby approved based on the following Findings of Fact:
1. An auto sales lot is permitted with a conditional use permit in the B -3 zoning
district.
BE IT FURTHER RESOLVED that application for Conditional Use Permit CUP95 -10 is
hereby approved based on the following conditions:
1. That the site is allowed nine parking spaces for sale vehicles.
2. That the applicant can not store vehicles on the site in the drive aisles.
3. That the conditional use permit is reviewed by the Zoning and Planning
Commission and the City Council one year after approval.
4. That the fence on the north side of the property is extended along the entire
north side of the property.
5. That the fence on the north side of the property is six feet high.
Adopted this 5th day of December, 1995.
