Subject: Second Reading - Amendment to Nuisance Ordinance -
Enclosed for a second reading is an ordinance which amends the City's Nuisance Code
by adding the definition of graffiti. By adopting this ordinance, the City will be able to
use its Nuisance Abatement Code to compel property owners to remove graffiti from
their properties.
During the first reading of this ordinance a question was raised regarding the definition
of graffiti relating to graffiti being placed on permanent structures vs. items such as
garbage dumpsters, etc. To address this point, and to allow the City to enforce its
. ordinance for movable or semi permanent types of objects, the word permanent was
removed from the definition.
The action before the City Council is to approve Ordinance #94-741 for a second
reading.

. ORDINANCE NO. 94 - 741
An Ordinance relating to Nuisance Abatement; amending Section
615.02 of Chapter VI of the Hopkins City Code by adding a new
Subdivision 10 relating to deterioration of property arising from
the blight of graffiti and renumbering existing Subdivision 10 as
Subdivision 11.
THE CITY COUNCIL OF THE CITY OF HOPKINS DOES ORDAIN:
Subdivision 10. Graffiti. Any writing, printing, markings,
signs, symbols, figures, designs, inscriptions or other drawings
which are scratched, painted, drawn or otherwise placed on any
exterior surface of a building, wall, fence, sidewalk, curb or
other structure on public or private property and which have the
effect of defacing the property.
Subdivision 11. Statute and Common Law Nuisances. Any thing
or condition on property which is known to the common law of
theland as a nuisance, or which is defined or declared to be a
nuisance by the Statutes of Minnesota or the Hopkins Code of
Ordinances.
This Ordinance is effective subject to the following:
