FIRE PROTECTION SYSTEM

Proposed Action.
staff recommends approval of the following motion: Move that Council
adopt Resolution 94-35. Resolution approving petition for Fire
Protection System at Pipeline Supply Inc. . 620 - 16th Avenue South.
Hopkins. Minnesota. and Orderinq Improvements.
Adoption of this resolution will provide funding for a private fire
hydrant as an adjunct fire protection system at Pipeline Supply Inc.

subsequent to a recent submittal of building plans to the City's
I Inspection Department, the owner of Pipeline Supply Inc. learned he
needed additional fire protection for the proposed new building. It
is not feasible to provide a sprinkler system in the proposed free
stand.:j..ng storage building. The owner proposes to install a private
fire hydrant to provide the necessary protection.
The petitioner has received bids for a project that includes
installation of a six-inch hydrant main from an existing six-inch
service line, installation of a city approved fire hydrant, and
restoration of a bituminous parking lot. The bids total $14,501.00
and are presented to Council for approval. The petitioner will be
. installing the system as soon as possible and wishes to have the cost
assessed after completion and acceptance. section 429 of the State
Code permits installation of fire safety related devices and equipment
to be installed and assessed to benefited properties. The amount to
be assessed would be the total cost of the project plus an
administrative fee as outlined in the city's Legislative Policy.
Present city policy is to charge a% interest and to assess over a
ten-year period.

To date this is the first 1994 project of such nature. By policy
the city sets aside $200,000.00 for a given calendar year for
fire protection petitions. Ample funds are available.

PETITION AND WAIVER BY PROPERTY OWNER(S)
Gary Singer, hereinafter called the General Partner of Kant-Sing Partnership, states that he has
ownership interest in property at 620 - 16th Avenue South, Hopkins, Minnesota, more
particularly described as:
Lot 2, Block 2, South Hopkins Industrial Park, Section 25, Township 117, Range 22,
Hennepin County, Minnesota.
Said General Partner hereby petitions the City of Hopkins to make the arrangements necessary to:
1. Assess the costs of a private fire protection system against the above property.
The system shall be a hydrant as located on the attached plans. Materials and
installation shall be in accordance with attached specifications. The owner agrees
I to an installation deadline ofJune 1, 1994 as a condition for an occupancy
certificate for a new structure on the above property.
2. Allow the owner to contract privately for construction of the improvement per
e attached cost estimates. The construction cost financed shall not exceed the cost
estimates.
3. Assess the cost of improvements plus an administration fee over a ten-year period
at 8% per annum. Final payment by the City to the contractors shall be contingent
upon receipt of lien waivers.
General Partner hereby waives any right to notice or objection to said improvement as provided in
Chapter 429 of the Minnesota Statutes and any other provisions of municipal or state law
providing for notice or objections. General Partner understands that the aforesaid property will
be assessed for the costs for the aforesaid work.

RESOLUTION NO: 94-35
~ESOLUTION APPROVING PETITION FOR AND ORDERING IMPROVEMENTS
WHEREAS, the general partner of Kant-Sing Partnership located at
620 -16th Avenue South, Hopkins, Minnesota, has petitioned
for an improvement consisting of the installation of a fire
protection system pursuant to Minnesota Statute No. 429.031,
Subd. 3 . and
,
I WHEREAS, The petition and accompanying documents thereto
complies with the requirements of the aforementioned
statute.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
HOPKINS, MINNESOTA:
1. Such improvement is hereby ordered as proposed and
requested in the petition.
. 2. That the Engineering and Superintendent and Fire
Marshal be directed to review and approve the plans and
specifications accompanying the petition for the
construction and installation of the fire protection
system.
3 . That said installation and construction be in
conformance with Minnesota Statute Chapter 429 and all
state and minicipal codes, ordinances and regulations
pertaining thereof.
4. That periodic inspections be conducted by the City of
Hopkins to assure compliance with said codes and
requirements.
Adopted by the City Council of the City of Hopkins this 5th day
of April, 1994.
