Staff recommends the following motion: Move to approve Resolution 94-52 amending Resolution 94-25, which will not require a park dedication fee for the Steile Plat. Overview. In March Ed Steile received approval of a plat for the property at 1300 Second Street South (NAPCO). This plat essentially involved adjusting a lot line location between the two lots. At the time plat approval was granted, one condition of the Resolution was that Mr. Steile pay a park dedication fee. Upon looking at the Subdivision Ordinance a second time, the ordinance excludes simple lot line adjustments which do not create additional lots. In this case another lot was not created. . In this case the park dedication fee would have been approximately $9800. Primarv Issues to Consider. 0 What is the staff recommendation? CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO 94-52 A RESOLUTION AMENDING RESOLUTION 94-25 PLATTING THE LOT AT 1300 SECOND STREET SOUTH WHEREAS, the City of Hopkins, has adopted Ordinance No. 500 approving a subdivision ordinance, and WHEREAS, the City Council approved a plat of 1300 Second Street on March 15, 1994; WHEREAS, pursuant to the language in the city's park dedication requirements it has been determined that a park dedication fee is not required for the plat of the property at 1300 Second Street; NOW THEREFOR, BE IT RESOLVED, that Resolution 94-25 is hereby amended and . condition # 1 requiring a park dedication fee is not applicable. HENNEPIN COUNTY, MINNESOTA ORDINANCE NO. 91-694 k~ ORDINANCE AMENDING THE HOPKINS CITY CODE, ADDING SECTION 500.75 - PARK DEDICATION REQUIREMENTS BE IT ORDAINED by the Council of the city of Hopkins as follows: That section 500.75, Park Dedication Ordinance, be added to the Hopkins city code to read as follows: Subdivision 1 In every plat, replat or subdivision of land allowing development or redevelopment for residential, commercial, industrial or other uses or combination the:r-eof, or where a waiver of platting is granted (but excluding simple lot line adjustments which do not create additional lots) , a reasonable portion of such land be set aside and dedicated by the owner or owners to the , general public as open space for parks, playgrounds, trails, and public open space. It" is hereby found and declared that, as a general rule, it is reasonable to require dedication of an amount of land equal in value to that percentage of the undeveloped land set forth in Subdivision 2 . said land shall be suitable for public use for one of the aforedescribed purposes and the City shall not be required to accept land which '.. will not be useable for parks and playgrounds or which would require extensive expenditure on the part of the public to make them useable.
