Memo Garage Sale Signs - '" . - To: City Council From: Nancy Anderson Date: Thursday, June 2, 1994 Subject: Garage Sale Signs I. Purpose Along with the nice weather of summer comes garage sales and other signs that seem to appear from nowhere. There have been some complaints regarding the number of garage sale signs that are appearing in the City. The staff desires to review with the City Council the current procedure that is used to enforce our ordinances regarding garage sales and garage sale signs. . II. City Code. Attached is Section 800.01 of the City Code. This section subd. hand i do not allow any advertisement within the limits of any street of highway. Also, section 800.03 allows City employees to remove any unauthorized advertisements within a street. III. Enforcement. Currently the City employees usually remove advertisements in the streets when there is a complaint. Public Work employees do remove signs throughout the year if they are situated in such an area that creates a problem. Several corners in the City seems to attract a lot of signs. When there is a complaint the City employees pick up the signs and dispose of them. Also a follow-up letter is sent to the resident advising them not to place signs on the public right-of-way. The Zoning Ordinance also limits a resident to two garage sales per year for a period of three days. If an individual has a continuous garage sale, the neighbors usually notify the staff. The staff notifies the violator and up to now we have been successful in stopping the sale. This problem has only occurred a few times. . .-- -- ---- --- . . IV. Discussion. The enforcement process used relates to the allocation of manpower based on a prioritization of work activities. If the City Council desires some other type of enforcement procedure, staff desires to discuss this issue further with the Council. . . . . Hopkins City Code (Rev. ) , 800.01 , CHAPTER VIII . STREETS, ALLEYS, AND PUBLIC GROUNDS Section 800 - General Street Regulations 800.0l. General street regulations. Subdivision 1. Prohibitions. Except for the actions of road authorities as defined by law, their agents, employees, contractors, and public utilities, and commercial activities as regulated by 2005.31 and except as otherwise provided in this section, it is unlawful to: (Amended Ord. No. 88-606) a) obstruct any street or 4ighway; b) plow or perform any other detrimental operation within the road right-of - way except in the preparation of the land for planting a perennial hay crop, and the harvesting of the crop; c) erect a fence on the right-of-way of a trunk highway, county state aid highway or county highway; d) dig any holes in any street or highway; e) remove any earth, gravel or rock from any street or highway; f) obstruct any ditch draining any street or highway or drain any noisome materials ~nto any ditch; . g) place or maintain any building or structure within the 1 imi ts of any street or highway; h) place or maintain any advertisement within the limits of any street or highway; - i) paint. print. place. or affix any advertisement or any obj ect within the limits of any.~~reet;or highway; j) deface, mar. damage. or tamper with any structure, work, material, equipment, tools, signs, markers, signals, paving, guard-rails, drains, or any other highway appurtenance on or along any street or highway; k) remove, injure, displace, or destroy right-of-way markers, or reference or witness monuments, or markers placed to preserve section or quarter section corners; 1) improperly place or fail to place warning signs and detour signs as provided by law; m) drive over, through, or around any barricade, fence, or obstruction erected for the purpose of preventing traffic from pass ing over a portion of a street or highway closed to pub li c travel or to remove, deface, or damage any such barricade, fence, or obstruction; . . Hopkins City Code 800.03 t n) dump or store snow on public streets or boulevards. . 800.03. Removal of unauthorized advertisements, buildings, or structures. City employees and road authorities, with respect to streets and highways under their jurisdiction may take down, remove, or destroy any advertisement, building or structure in or upon any highway located in violation of this section. 800.05. Firearms, bows and arrows; discharge on street or highways prohibited. No person shall discharge any firearm or bow and arrow upon, over, or across any improved public street or highway or while such person is within the limits of the right-of-way of any improved public street or highway. 800.07. Protecting streets and alleys. No person shall erect, building, set up or maintain any house, store, shop or other building or structure in or upon any street, sidewalk, avenue, alley, lane or public ground within the limits of the ci ty . No person shall deposit or place and leave any box, merchandise, timber, plank, board, shingle, cask, barrel, hogshead, lumber, brick or stone in or upon any street, sidewalk, avenue, alley, lane or public ground within the limits of the city, nor shall any person suffer or permit any wood, stone or other substance to drop from trucks or wagons, or other vehicles, while trans- porting the same through any street in the city, and permit the same to remain therein or thereon, nor shall any person place, leave, throw, drop or deposit any offal, filthy water, garbage, crude petroleum, coal, rock, earth or other material or substance whatever in or upon any street, sidewalk, avenue. alley, lane or public ground within the limits of the city. 800.09. Occupying sidewalks or streets. A. person building or repairing any . building near any sidewalk, street, avenue. alley or public ground in the city, or desiring to remove any building along any street of the city, shall apply to the manager for a license to place building material upon such sidewalk, street, lane avenue, alley or public ground during the process of such building or repairing, or to remove such building. The manager may grant such license under such conditions and restrictions to be set forth in such license as will prevent needless inconvenienc e. No such permission shall be given to any person to occupy with such material more than one-third of the roadway of such street, nor to permit such obstruction to remain in said street or alley for more than three months. 800.11. Street fire. No person shall build or cause to be made any fire within the limits of any street, avenui or alley within the corporate limits of the city. 800 . 13 . Driving across sidewalks. No person shall drive any vehicle over or across any sidewalk from any street to any lot, or from any lot over or across sidewalk to a street or avenue, except over a regularly constructed driveway. .
