CR 94-121 Renew Towing Agreement June 28, 1994 ~ Council Report 94-121 . RENEW TOWING AGREEMENT Proposed Action Staff recommends that the Council approve the following motion: Authorize the City Manaqer to renew the City's towinq aoreement with Matt's Towino. This action will continue the City's agreement with Matt's Towing for another year. Overview The towing agreement with Matt's Towing was for one year with an option for two additional years. The first year has come to a close. Staff is recommending that the City exercise its option and extend the contract for another year. Primary Issues to Consider . Does Matt's Towing provide good service? . Matt's Towing has provided good service. Cars are towed in a timely manner. Matt's Towing is very responsive to the needs of the police and public works departments. The contractor has also paid all the administrative fees. Staff has received a few complaints. Although most concerned the snow emergency towing process. The customer service is very good especially compared to some of the contractors that have had this contract in the past. The terms of the agreement provide for renewal from year to year (Paragraph 2, Contract Specifications, "This agreement shall ....be subject to renewal from year to year." I am reviewing some ammendments submitted by the City Attorney's office which would ammend that paragraph to read, "...may be extended at the option of the City for two (2) consecutive one (1) year terms." I am not sure why the attorney wants this language change, (it is old contract language) but whatever wording is used, the agreement is up for renewal at this time. . The Police Department has received relatively few, minor complaints mostly related to the snow emergency towing process. The contractor has maintained good records and made timely payments of the administrative fees. When questions have come up, Matt has been responsive and completely professional in all his dealings with me. The Police Department recommends renewal of the contract for a one year term beginning July 1, 1994 - July 1, 1995. cc: Chief Johnson Matt's Towing . ~ e CITY OF HOPKINS REQUEST FOR PROPOSAL - TOWING SERVICES CONTRACT SPECIFICATIONS l. Contractor's Services. The Contractor agrees to provide all services required by the City for the towing ofvehicIes, as that term is defined in Minnesota Statute SSI69.01, subd.2. These services shall be provided in accordance with the terms of this contract. The Contractor shall furnish the equipment, personnel, supplies, and facilities sufficient to fulfill all the terms of this contract. 2. Agreement Period. This agreement shall commence on April 1. 1993 and end on June 30. 1994. recurring on a yearly basis thereafter. (July I 1994 - June 30 1995.) and subject to renewal from year to year. This agreement may also be terminated by either party upon 30 days written notice if the other fails to perform in accordance with the terms of this contract through no fault of the terminating party. 3. Personnel. All drivers provided for the towing vehicles shall be checked for driverts license and warrants by the City's Police Department prior to their assignment. Contractor agrees to train all drivers in the proper towing of vehicles containing hazardous materials in accordance with federal and state laws. . 4. Storage Facility. The Contractor shall provide for towed vehicles which shall be fenced and locked in a secure manner. The facility shall be within five miles of the City limits. 5. Operation. No vehicle shall be towed under this contract without specific authorization from an employee or agent of the City. All vehicles shall be towed, not driven (except when authorized) without damage to the vehicles, to the storage facility. Contractor shall maintain and provide a telephone answering service 24 hours a day for the purpose of receiving requests for service pursuant to this contact, and provide and maintain mobile radio service with all towing units. 6. Notification of Owner. Upon the deposit of a towed vehicle in the storage facility, the Contractor shall send, within 72 hours, by certified mail, to the registered owner a notice specifYing the date and place of the tow, the year, make, model, and serial number of the vehicle towed, and the procedure to reclaim the vehicle. A record of this notice shall be retained by the Contractor. 7. Release. No vehicle shall be released without proper proof of ownership. Vehicles ordered held by the Police Department shall not be released without authorization from said department. Vehicles not kept on a "police hold" shall be released by the Contractor after obtaining proper proof of ownership and proof of current insurance coverage if the vehicle is to be driven out of the impound lot. The Contractor reserves the right to specify the manner of . payment for all charges and fees. Contractor agrees to supply personnel and reasonable hours of Page: 1 .--
