Staff recommends the following motion: Move to approve Resolution 94-69 approving a conditional use permit for a bus facility. Mr. Hutchison moved and Mr. Racek moved to approved Resolution RZ94-9 recommending approval of a bus facility with conditions. The motion passed on a 4-1 vote. Mr. Day voting nay and Mr. Hutchison abstaining from voting, Overview, Fred Hanus, the applicant, is proposing to move his bus facility from Minnetonka to Hopkins. The site he is proposing to move to is located just west of the Venturian building on County Road 3. This site is currently vacant. The Hanus buses at this location will serve the Minnetonka area. Approximately 50-60 buses will be located on the Hopkins site. The proposal includes the construction of a storage, office, maintenance building and possibly a bus shed, The buses will be parked at the southern end of the site, . The biggest issue with this proposal is the traffic and access issues on County Road 3. Because of the staff concerns with the traffic and access issues, a traffic study was completed by Benshoof & Associates, Inc. The traffic study is attached, Among numerous other conditions, the Planning Commission recommended approval of the CUP subject to a new access point on County Road 3 to be a "right in/right out" only, Primarv Issues to Consider. 0 What is the zoning of the property? 0 What is the Comprehensive Plan designation for the subject site? 0 What does the zoning ordinance require? 0 What are the specifics of the development? 0 What was the recommendation of the traffic study? 0 What is the staff recommendation? 0 What occurred at the Zoning and Planning meeting? Primary Issues to Consider. 0 What is the zoning of the property? The subject site is zoned I-I, Industrial. A bus facility is permitted with a conditional use permit 0 What is the Comprehensive Plan designation for the subject site? The Comprehensive Plan has designated the subject site as Industrial. 0 What does the zoning ordinance require? Section 540.03 states the following: "Trucking or bus terminal provided said site shall have a landscaped front yard of 40 feet or more when any loading doors face the public right-of-way; the entire site other than required front yard shall be fenced; an off-street parking space for a 50 foot long, over the road trailer shall be provided for each loading bay; all storage outside of a building shall be considered an open sales lot and require a conditional use permit for same; lighting, if provided shall be so located and designed as to concentrate the light to prevent glare or direct rays of light from being visible from any public roadway or private property; should an outside public address system be installed, it shall be so designed and used that it shall not be heard from abutting property; provisions for trash shan be provided and . screened. " 0 What are the specifics of the development? Landscaping The plan shows landscaping surrounding the site. The site is required to have 48 trees. The landscape plan shows 42 trees. However, 20 of those trees are not the size required by the Ordinance, Staff is recommending the size is increased to comply with the Ordinance. The site also has existing trees that will remain. The existing trees count toward the requirements for number of trees. Staffis recommending that the site is irrigated along County Road 3, City Engineer The City Engineer has reviewed the plans and made the following recommendations: 0 locate all stann sewer structures on the site 0 Nine Mile Creek Watershed District approval needed 0 Regulate storm water runoff . Fire Marshal The site plan indicated that there are two ] 0,000 gallon above ground fuel tanks located on the west side of the site, The Fire Marshal noted that these tanks will have to be buried as per the City Code, The site plan indicates that they will be buried, Parking The employee parking is located on the north side of the site with the buses parked on the south side of the site, There are 73 parking spaces for the employees. The Zoning Ordinance does not have a specific parking requirement for the applicants use. However, based on the information supplied by the applicant 73 parking spaces should be more than adequate. The site plan shows a bituminous surface for the employee parking and a gravel surface for the bus parking area. The staff is recommending that the entire area used for bus parking and maneuvering is also a bituminous surface. At a future date the applicant will be requesting a waiver of plat for a small addition of property from the Hopkins Auto body property. Trash The garbage dumpster is proposed to be located behind the storage building, Staff is . recommending that the dumpster is screened. Access The site plan shows a joint access between NAPCa and the bus facility, The access issue will be discussed later is this report, Exterior The office building, which is the northerly most building, will have an exterior of cedar siding and masonry base, Behind and to the east of this building the applicant is proposing to have two metal buildings, The applicant will be covering the west and east sides of the metal buildings with a masonry base and cedar siding. All the sides of the buildings that will be visible from County Road 3 will have an exterior of cedar siding with a masonry base, The roof of the storage building wj]J be visible. Staff is recommending that the this roof is an earthtone color, Lighting The lighting plan shows pole lighting in the employee parking area, The site is also lit by . mounted lighting on the buildings. - - CR94-l63 Page 4 . Setbacks The Zoning Ordinance requires a front yard setback of 75 feet and 20 foot setback on all the other sides, The site plan shows a 75 foot front yard setback and the buildings aU have a 20 foot setback or greater. Surrounding Uses The site is surrounded by the following uses: 0 Central Park to the north 0 Venturian to the east 0 NAPCO to the west 0 Industrial area to the south 0 What was the recommendation of the traffic study? A traffic study was completed by Benshoof & Associates, Inc. regarding the applicants operation, The preferred recommendation was that there is a shared access with Hanus and Hopkins Auto Body located in the Venturi an building to the east.. However if this access is not possible the access shown on the site plan is acceptable provided there is a left turn lane for westbound traffic on County Road 3 and the access is designed as per the traffic study, . Any new access point will have to be approved by the County, Mr, Hanus has discussed the proposed access point on the site plan with the County. The County has indicated that an access permit will probably be given. Staff is recommending that the access on County Road 3 is designed as a joint access with the property to the east, the Hopkins Auto Body property, The second alternative of a new intersection on County Road 3, as proposed by the applicant would cause greater accident potential. Because of the greater chance for accident potential and associated health, safety and welfare concerns, the staff is recommending that an additional access point not be permitted and there be a joint access arrangement developed between Hanus and Hopkins Auto Body or Venturian Corp/NAPCO, 0 What is the staff recommendations? Staff is recommending approval of the conditional use permit with the following conditions: o that all storm sewer structures are located on the site. o that Nine Mile Watershed District approve the proposed project o that the stormwater runoff is regulated as per staff approval o that the site is irrigated adjacent to County Road 3 . o that there is no public address system on the site o that all garbage dumpster and recycling containers are screened o that the fuel tanks are buried as per the City Code o that the roof of the storage building is an earthtone color o that the entire bus parking and maneuvering area is bituminous CR94-163 Page 5 . o that the MPCA approve all improvements to the site o that the applicant secure a driveway permit from the County o based upon the Benshoof & Associates traffic study dated 6/14/94 and due to health and safety concerns associated with the applicants proposed access arrangement, that no additional access point be allowed on County Road 3 to service this site. Instead access to the Hanus site shall be provided through a joint access arrangement, The City shall be provided a copy of any joint access agreement between Hanus & the other property owner, Furthermore, the applicant shall provide revised site plan to the City staff for approval which illustrates the joint access arrangement and other necessary changes to the site. 0 What occurred at the Zoning and Planning meeting? The staff briefly described the applicants proposal. Staff noted that the access to the site is the major issue with the proposed development Mr, Hanus, the applicant and Mr. Orlin, the applicants attorney appeared before the Commission. Mr, Odin stated that they had been unable to work out a joint access with Mr, Stiele. There was considerable discussion on the access Issue. Mr. Day suggested that if there is a new access it is a right-inlright-out only. There was considerable discussion on this option. The Commission was concerned about the buses making a left turn on County Road 3, Jon Wertjes from Benshoof and Associates was at the meeting. Mr, Wertjes stated that the right-in/right-out access would work. The Commission approved the conditional use permit with one of the conditions being that there . would be a new access on County Road 3, but this access would only be a right-in/right-out. Alternatives }, Approve the conditional use permit to operate a bus facility. By approving the conditional use permit to operate a bus facility, the applicant will operate a bus facility, 2, Approve the conditional use permit to operate a bus facility with the conditions as recommended by the staff, By approving the conditional use permit with the conditions a recommended by the staff, the applicant will be able to operate a bus facility with conditions. 3, Deny the conditional use permit to operate a bus facility. By denying the conditional use permit to operate a bus facility, the applicant will not be able to operate the bus facility as proposed. If this alternative chosen by the City Council, the City Council will have to state findings of fact which recommend denial of the conditional use permit. 4. Continue for further information. Hennepin County, Minnesota RESOLUTION NO: 94-69 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A CONDITIONAL USE PERMIT FOR HANUS BUS COMPANY - EAST OF 1600 SECOND STREET SOUTH WHEREAS, an application for a conditional use permit, CUP94-2, has been made by Hanus Bus Company; and WHEREAS, the procedural history of the application is as follows: 1. That an application for a conditional use permit CUP94-2 was filed with the city of Hopkins on June 24, 1994. 2. That the Hopkins Planning Commission, pursuant to mailed and published notices, held a public hearing on the application and reviewed such application on July 26 and August 30, 1994: all persons present were given an opportunity to be heard. 3. That the written comments and analysis of the city staff were considered. . 4. That the report prepared by Benshoof and Associates, dated 6/14/94 was considered. 5. The legal description of the subject property is as follows: Lot 1 Block 1 Stiele Addition NOW THEREFORE, BE IT RESOLVED that the application for conditional use permit CUP94-2 is hereby approved based on the following Findings of Fact: 1. That a bus facility is permitted in an 1-1 district with a conditional use permit. BE IT FURTHER RESOLVED, that application for CUP94-2 is hereby approved based on the following conditions: 1. That all storm sewer structures are located on the site with this information to be provided to the City. 2. That Nine Mile Watershed District approve the proposed project. 3. Based upon the Benshoof & Associates traffic study dated 6/14/94 that there is a joint access between the proposed bus facility and the NAPCO property. This access will be designed by Benshoof & Associates. Furthermore, when a median is constructed on County Road 3 the applicant agrees I to an access of a right-in/right-out at the new access location and will not request a full access (left and right turn movements) from Hennepin County. 11. That the applicant shall secure a driveway permit from Hennepin County for the new access. 12. All other City Code requirements relating to the proposed use shall be met. 13. That the entire bus parking lot and maneuvering area is . bituminous. The applicant shall provide a plan acceptable to the city 14. The the conditional use permit is reviewed by the Planning Commission every 12 months until a median is constructed on County Road 3. 15. There will be no left turns entering and exiting for all vehicles from the new access on County Road 3 between the NAPCa and the Hanus property. 16. That the MPCA approve all improvements to the site. 17. While this new right in/out only access is not the preferred solution identified in our . June 14, 1994 memorandum, Benshoof & Associates is in agreement that this right in/out only driveway access for the Hanus/NAPea properties can function safely with limited impact to through traffic on County Road 3. Each of the traffic parameters/items cited in the resolution are discussed as follows: . Items 10 and 15 - Acces$ to County Road 3 Benshoof & Associates has reviewed and is in agreement to the right turn in and out only for the proposed Hanus Bus Facility. Since this right in/out only access is a site plan change from the June 14, 1994, minor revisions to driveway layout are needed. a) The driveway layout presented in Figure 3 of the June 141 1994 memorandum needs to be revised. The driveway width should be reduced from 40 feet to 30 feet for its entire length from the proposed Hanus building north to County l<.oad 3. This width reduction eliminates the northbound left turn Jane from the site w Coumy Road 3. I would suggest that this 30 foot driveway be centered on the properl~ line between Hanus and NAPea sites. This driveway position s auld be confirmed with Hanus and NAPeO. b) The existing County Road 3 is an undivided roadway. For this proposed right in/out driveway to or:rate with the existing undivided County Road 3 situation, "No Le t Turn" signs should be installed for westbound County Road 3 traffic. Item 14 - Review of CUP This condition will allow for the monitoring and compliance of the no left turn provisions at the Hanus/NAPeO access until the county Road 3 median is constructed. This item of on-going monitoring and compliance will assist the above recommended naffic signing to prevent left turn movements prior to reconstruction of County Road 3. Bensh~Pand Jon Wertj~ RE: Traffic Study for the Hanus Bus Facility This memorandum documents the traffic study for the proposed Hanus bus facility located along County Road 3 in the City of Hopkins. The key traffic issues addressed were: . How would the bus facility gain access to/from County Road 31 . Can County Road 3 accommodate traffic to and from the bus facility without . incurring any significant adverse effects? To effectively address these key issues, the following work tasks were completed: 1) Obtained background information regarding existing roadway and traffic characteristics, including roadway as-builts, traffic volumes, and observations regarding existing operations on this segment of County Road 3. This task also included meetings with City and County staffs to discuss the access issues. 2) Developed traffic forecasts for the proposed bus facility and the adjacent Napco and Hopkins Auto Body properties. 3) Analyzed the driveway access detailed in the site plan received April 6 and the ability of County Road 3 to accommodate the projected development traffic volumes. These analyses accounted for expected traffic increases on County Road 3 and the planned future upgrading of this roadway. Preliminary results were discussed with City staff and the applicant. 4) Prepared this memorandum which documents the traffic analyses and recommendations. Based on the above tasks, this document presents the traffic study work efforts and resultant conclusions. . Ms. Nancy Anderson -2- June 14, 1994 BACKGROUND INFORl\1A TION . The existing conditions and the preliminary plans for upgrading this roadway segment were obtained from work presently being completed for the County Road 3 Corridor Study. Existing traffic volumes were collected along County Road 3 at the two existing driveways to the Napco/Venturian properties. The traffic counts were collected from 2:00 to 5:30 p.m. on April 28, 1994. The site plan for the development proposed by the Hanus Bus Company is presented in Figure 1. The proposed bus facility will be able to accommodate 54 buses with future spaces for 10 additional buses. There are 78 employee parking spaces located just south of County Road 3. The existing conditions of the Napco facilities were obtained from Gary Rappaport. Napea presently has 80 employees, 50 people in the office complex and 30 people in the warehouse. Mr. Rappaport indicated that Hopkins Auto Body will initially use one- half of the office complex building and Napco office will remain in the remaining half, or approximately 15,000 sq. f1. for each use. Hopkins Auto Body does have the opportunity to use the entire office building, and if that occurs Mr. Rappaport has indicated that Napco offices would move to the warehouse. Also, Gary Rappaport indicated that Napco is a low intensity user and traffic generator of their buildings. If use of the Napea buildings would change in the future, higher traffic generation could rcsul t. TRAFFIC FORECASTS The traffic forecasts were developed based on the following three steps: . 1) Established existing traffic volumes 2) Accounted for planned Hopkins Auto Body and Napea land uses 3) Added the Hanus site traffic 4) Added steps 1,2 and 3 to determine the post development traffic volumes For the Hopkins Auto Body use, trip generation rates were based on expected traffic generation for similar auto repair uses. The estimated p.m. peak hour trip generation is 54 inbound and 53 outbound trips. If repair uses were to occupy the entire Napea office building, the estimated p,m. peak hour trip generation would be 110 inbound and 108 outbound trips. All auto repair land use trips were assigned 50 percent each to the east and west directions on County Road 3. For the Napca uses, the two trip generation scenarios are: 1) existing driveway volumes using the appropriate driveways, and 2) future potential of a more intense use of the Napco warehouse building, Under the more intense use scenario, it is expected that the 123,400 sq. [1. warehouse could be used at a ten percent office and 90 percent warehouse use. Mr. Hanus said that most bus trips would be oriented to/from the west on County Road 3. Table 2 identifies the expected trip generation for the planned and the potentIal land uses. The potential land . uses include the proposed Hanus bus facility, auto body and repair uses occupying the entire existing Napco office building, and the more intense use of the Napeo warehouse building. To be in a conservative posture, the traffic analysis has been based on the higher trip generation associated with the potential land use scenario. Based on the above traffic forecast data, the projected traffic forecasts are presented in Figure 2 for the access plan proposed by the Hanus Bus Company in which the Hanus and Napea developments would share a new full access driveway on County Road 3. County's 2010 Traffic Forecasts2, Future traffic growth on this County Road 3 segment is expected to be 1.] percent compounded annually. This annual increase equates to approximately a 20 percent overall growth from 1994 to 2010. Applying the 20 percent growth to the existing County Road 3 p.m. peak hour through volumes results in an additional 150 eastbound and 190 westbound through trips (two to four additional vehicles per minute per direction) during the year 2010 p. m. peak hour. TRAFFIC ANALYSIS The traffic analysis focuses on two basic types of traffic questions - the first addressing the specific plan proposed by the Hanus Bus Company and the second addressing basic access provisions along County Road 3. TRAFFIC IMPLICATIONS OF HANUS PLAN The principal purposes of this section are: 1) to determine the specific traffic effects that would occur if a new full access driveway were constructed on County Road 3 to provide shared access for the Napco and Hanus sites and 2) if any difficulties are identified through the preceding step, to determine possible mitigating measures, Using the traffic forecasts presented jn Figure 2, capacity analyses were conducted for the driveway access intersections serving the Hanus, Napco, and Auto Body sites. The analyses indicated that levels of service would be D or better for the post development . p.m. peak hour conditions at the two existing driveways and the new driveway proposed by Hanus. Gaps in the traffic flow along County Road 3 would be created by the traffic signals at 1 1 th and 17th A venues allowing traffic to exit from the Napeo, Hanus, and Auto Body sites. A preliminary result from the Coullty Road 3 Corridor Study, which is nearing completion, is that this portion of County Road 3 should be upgraded to provide a raised center median and a left turn lane. In the context of this plan, a left turn lane could be created to serve the new full access driveway included in the Hanus plans. However, such a left turn lane would reduce the opportunity for landscaping in this ~enter median, which would be contrary to one of the objectives for the County Road 3 Improvements. The last analysis item regarding the Hanus site plan involves driveway dimensions and internal circulation. The purpose of this section is to address basic access provisions along County Road 3, including whether it would be desirable to create a new full access driveway to serve the Hanus site. In addressing this point, it is important to recognize that County Road 3 is a minor arterial. The Metropolitan Council's Transportation Development Guide Chapter/Policy Plan3 presents the following statement regarding mobility versus land access for urban minor arterials: "Emphasis Oil mobifity rather than on land access. Direct land access within the MUSA restricted to concentrations of commercial/industrial land uses. " Figure 4 illustrates the roles of various categories of roadways, including minor arterials, regarding mobility versus land access. It is important to limit access to minor arterials to maintain their ability to serve inter-regional trips and to provide adequate safety, Applying this transportation planning principle to County Road 3, it is our understanding that Hennepin County has not established specific access spacing standards. Dakota and Scott Counties have established specific standards for minor arterials such as COUTlty Road 3 that allow for full access at one-quarter mile (1320') spacing and limited right turn only access at one-eighth mile (660') spacing. Existing access spacing conditions on County Road 3 from 11th to 17th A venues are shown in Figure 5, together with the changes in spacing that would result from the plan . proposed by the Hanus Bus Company. Major findings regarding access along County Road 3 between II th and 17th A venues that have been established from this figure and olher pertinent considerations include: . The existing condition involves three full access locations and one right turn only driveway. The average spacing between the full access locations is 500 feet. . Under the Hanus plan one additional full access driveway would be created, with the resultant average spacing between full access locations being reduced to 400 feet. . The spacing between full access locations along this segment of County Road 3 is less than desired, both under existing conditions and with the proposed Hanus plan, One frame of reference for making this comment is the 1320 foot spacing standard established by Dakota and Scott Counties. Another frame of reference is that the average spacing between full access locations along County Road 3 between 11th Avenue and the west ramp intersection with T.H. 169 IS 1000 feet. . CONCLUSIONS Based on the items presented in this report, the preferred traffic solution is to meet the access needs for the Hanus development without creating additional access on County Road 3. Two specific options would be: I) to utilize the existing driveway for Hopkins Auto Body to also provide access for the Hanus development or 2) to relocate the existing Hopkins Auto Body driveway slightly to the west in a manner that it would serve both the Hanus and Auto Body sites. Further work is needed to develop an access layout that would effectively serve both properties, An advantage of this shared access arrangement is that it would enhance the potential for traffic signal control. Specifically, the projected post-development volumes for this shared access scenario would meet the peak hour warrants to install traffic signal control. Signal control would be especially beneficial for buses making left turns onto County Road 3. The plan proposed by the Hanus Bus Company to create a new full access intersection on County Road 3 is less desirable than the preferred solution because it would cause greater accident potential. If full access is approved, the following two actions should be taken as minimum mitigation measures - 1) construct a left turn lane for westbound traffic the full distance between the Hanus and Hopkins Auto Body sites and 2) construct the Hanus driveway in accordance with Figure 3. . .
