Authorize utility Easement
Hopkins School District
Proposed Action.
Staff recommends adoption of the following motion: Move that
Council authorize the qrantinG of a non-exclusive utility
easement to Independent School District No. 270 across City
property for purposes of an underGround telecommunications
facility.
Authorization will place an easement on the City owned parcel
south of County Road 3 from 11th Avenue to T.H. 169.
Overview.
Recently staff has been negotiating with C & L Communications,
the school district's contractor who is installing buried fiber
optic cable throughout the city. Most of the cable is being
installed in public rights-of-way, however a major link
paralleling County Road 3 will need to be buried on city
property. An easement is proposed to accommodate the facility.

4It · Location of proposed cable.
C & L Communications proposes to install a buried fiber optic
cable on the City owned parcel immediately adjacent to the
south side of County Road 3 from 11th Avenue to T.R. 169. It
appears the most feasible location for the cable on this site
is a ten-foot utility corridor that parallels the southerly
and southeasterly line of the parcel. (See attached location
map.)
· Impact of buried cable on City property.
Of particular interest to the City is that portion of the
property between 11th Avenue and 9th Avenue. This segment
has the potential to enhance the development of adjacent R.L.
Johnson property. Currently the common line between the city
property and R.L. Johnson property from 11th Avenue to 9th
Avenue is encumbered with a utility easement. A large water
main to Well Site No. 1 is found within this easement from
11th Avenue to the water tower. North of the common property
line one finds a 12 inch backwash pipe from the well site
facility draining to a sanitary sewer in 11th Avenue.
Because the common property alignment appears to be
encumbered with other utilities, because all R.L. Johnson
site development proposals to date do not show any building
structure use of the city parcel, and because no one can
. ascertain the future south right-of-way line of County
Road 3, it appears the proposed cable location will have the
least detrimental impact on the site.
Between 9th Avenue and T.R. 169 there are several locations
where County Road 3 roadway literally encroaches on the city
parcel. This is an issue to be resolved at a future date,
perhaps during reconstruction of the roadway sometime at the
end of this century. Even though it is preferable to place
such a fiber optic facility off the edge of the roadway,
present conditions and an unknown future solution make it
difficult to create a utility corridor along the south edge
of County Road 3. The expedient solution is to keep the
cable consistently along the south line of the City's parcel.
· Terms of easement.
staff, with the City Attorney's advice, proposes that the
school district be granted a 10 foot non-exclusive easement
for the construction, repair and maintenance of underground
telecommunications facilities with reasonable right of access
across adjoining city property.
