MEMORANDUM Confidential DATE: September 15, 1994 TO: Honora9~ Mayor and City Council - \, \ ' FROM: Tom Harmening, Community Development Director SUBJECT: CLOSED DOOR MEETING - GARBER LITIGATION As the Council was informed some time ago, the judge reviewing this case ruled in favor of the City of Hopkins. However, subsequent to the judge's order, Garber's attorney filed a motion requesting that the judge vacate her previous decision and reconsider the case. This motion was based on a claim by Garber's attorney that there was recent case law which supported Garber's claim. In addition, Garber's attorney claimed that our attorney, as designated by the League of Minnesota cities Insurance Trust, did not act properly as a part of the judge's . review of the case. Please note that in regards to both arguments, staff and our city attorney feel the city is on good ground. Be that as it may, the judge did vacate her previous decision and is going to reconsider the case. In addition, the judge has encouraged that both parties reopen settlement discussions to resolve this matter. Staff and its attorney, Torn Scott, desires to discuss with the City council its interest in attempting to settle this case. Attached is a possible settlement agreement for the Council's consideration. Please note that this settlement agreement is essentially identical to the one which staff last proposed to Garber which he did not accept. The only difference is that the current proposed settlement agreement requires Garber to pay for the relocation of the driveway. The previous proposed settlement suggested that the city, through its insurance company, would pay for the driveway relocation. Lighting of the sales lot shall be totally from indirect lighting. d.
