WAIVER OF PLAT -1023 MAINSTREET
Proposed Action.
Staff recommends the following motion: Move to approve Resolution 94-98 approving a
waiver of plat to divide 1023 Mainstreet into two lots.
At the Zoning and Planning meeting Mr. Day moved and Mr. Gullickson seconded a motion
to approve Resolution RZ94-I3 recommending approval of a waiver of plat at 1023
Mainstreet. The motion was approved unanimously.
Overview.
The applicants are proposing to divide the lot at 1023 Mainstreet into two lots. The proposed
division line will be north of the space occupied by Boston Subway and Community Credit.
The City has signed a purchase agreement to purchase the "dome" portion of the building on
the property. Thus the need for the lot split. The City currently plan on removing the "dome"
. and constructing public parking. It is not anticipated the dome would be actually removed for
some time until additional details are resolved on the grocery store project.
Approximately 24 parking spaces are expected to be added with the removal of the building,
These new parking spaces will serve Taits grocery store and the businesses in this area,
Last month this item was continued because of the moratorium on subdivisions. As of
October 18th the moratorium expired.

0 What is the zoning of the property?
The zoning of the subject property is B-2.
0 Do the proposed lots meet the requirements of the B-2 zoning district?
The following is the lot requirements for the B-2 zoning district and the proposed lots
B-2 north lot south lot

lot width 20 feet 68 feet 62 feet
The existing building on the south lot will conform with the zoning requirements.
0 Does the proposed division meet the requirements for a waiver of plat?
The following are the requirements for a waiver of plat in the new ordinance:
. I. In certain circumstances a waiver of plat may be more appropriate than a subdivision to
divide a property if the subject property has been platted. An applicant may apply for a
waiver of plat if the following circumstances exist:
a) the lot(s) involved in the proposed division are platted
b) the division requested is a substantially single line
c) that the division will not create more than one additional lot
d) that the division will not require the dedication of a public right of way or
extension of utilities in a public right of way
e) that the new lots created conform to all standards of the appropriate district
The proposed division meets the requirements for a waiver of plat. With respect to item d, no
new public right-of-way is required to be dedicated. Dependent on the outcome of a possible
grocery store expansion project it may be necessary to extend storm sewer along 11th Avenue
to drain a new parking lot. At this point the question remains unresolved and in fact may not
be an issue in the future.

. 0 What happened at the Zoning and Planning meeting.
Staff reviewed the request with the Commission. Tom Harmening reviewed the time schedule
for removing the "domell. Mr, Harmening stated that they would be closing on the property
on November 2nd and the dome would probably be removed next summer. He also stated
that there has been no specific official proposal at this time to expand the grocery store.
There was no one in the audience that spoke on this issue at the public hearing.
0 Is a Park Dedication fee required?
In is case the staff would recommend that there is no park dedication fee required because the
new lot will become public parking. Under the park dedication ordinance, the City Council
has the ability to waive the fee. Staff would recommend that the fee is waived in this case.
Alternatives
1. Approve the waiver of plat. By approving the waiver of plat, the applicant will be able to
divide the subject property into two lots.
2. Deny the waiver of plat. By denying the waiver of plat, the applicant will not be able to
divide the subject property into two lots. If the City Council chooses this alternative
. findings of fact will have to be stated that support this decision.
3. Continue for further information. If the City Council indicates further information is
needed, the item should be continued,

RESOLUTION MAKING FINDINGS OF FACT AND
APPROVING A WAIVER OF PLAT FOR 1023 MAINSTREET
WHEREAS, an application for a waiver of plat WVR94-3, has been made by Don Perk! & Jean
Mason to allow a waiver of plat at 1023 Mainstreet; and
WHEREAS, the procedural history of the application is as follows:
1. That an application for a variance, WVR94-3, was filed with the City of Hopkins on
August 30, 1994.
2. That the Hopkins Planning Commission, pursuant to published and mailed notices, held a
meeting on the application and reviewed such application on October 25, 1994: all
persons present were given an opportunity to be heard,
3. That the written comments and analysis of the City staff and the Planning Commission
were considered.
. 4. A legal description of the parcels is as follows:
Northerly Parcel:
That part of Lots 13,14, and 15, Block 69, West Minneapolis Second Division, according
to the recorded plat thereof, which lies northerly of the southerly 62.00 feet of said Block
69.
Southerly Parcel:
The southerly 62,00 feet of Lots 13, 14 and 15, Block 69, West Minneapolis Second
Division, according to the recorded plat thereof.
NOW THEREFORE, BE IT RESOLVED that the application for waiver of plat WVR94-3 is
approved based on the following Findings of Fact:
1. That the proposed lots meet the requirements for the B-2 zoning district.
2, That the proposed waiver of plat meets the requirements for a waiver of plat.
