Staff recommends the following motion: Move to approve Resolution 94-101 approving a conditional use permit to operate an auto storage lot. At the Zoning and Planning meeting, Mr. Day moved and Mr. Racek seconded a motion to approved Resolution RZ94-16 recommending approval ofa conditional use permit to operate an auto storage lot. The motion carried unanimously. Overview. Matt's Auto Service, Inc. is proposing to move to the rear of the parking area of Hopkins Auto Body at their new site at 1300 Second Street South. Matt's Auto Service is proposing to occupy the back parking area and occupy 58 parking spaces. A conditional use permit is required for any use that is not totally conducted within a building. The applicant is not proposing to have a building within the parking area, This lot will only be used for snow e emergency towing for Hopkins residents. At this point the applicant only has a one year lease and may only occupy the space for one year. MattIs Auto Service has the contract for towing for the City, There is currently not an impound lot for the residents in the City. The impound lot will not be visible from County Road 3. The Hopkins Auto Body building will shield the impound lot from County Road 3. The property is zoned I -1. 0 What has the Comprehensive Plan designated the subject site? The Comprehensive Plan has the subject site guided for industrial. uses. 0 What are the specifics of the development? Parking The area used for parking can accommodate approximately 58 cars. The Ordinance requires the parking area to be a bituminous surface. Staff is recommending that the parking area has a bituminous surface by June 1, 1995, By June 1, 1995 the applicant will be in a better position to determine if this lot worked for the snow emergency towing and if his operation will be there for more than one year. The site has an additional 130 parking spaces for the other uses on the site. Access e Access to the site will be from County Road 3. The applicant will use the existing access point on the property. Fencing The applicants area will be fenced with a 6 foot chain link fence. Staff is recommending that the entire site is screened. This will require the applicant to put slats in the chain link fence. Surrounding uses East - Nine Mile Creek West - Proposed Hanus Bus Facility North - Hopkins Auto Body Building South - Proposed Hanus Bus Facility Signage The applicant has not detailed any signage for the impound lot. If signage is desired in the future, any sign will have to meet the requirements of the Zoning Ordinance. . CR94-204 Page 3 . 0 What will be the impacts to the existing business? The impacts to the existing business at most times should be minimal. The applicants business does not generate a great deal of traffic with employees and customers at most times. During the snow removal period the cars are towed from 11:00 p.m. to 3:00 a.m. The only busy time may be when the car owners pick up their cars. Staff is recommending that if the applicant remains on the site past November I, 1995, the conditional use permit is reviewed for any negative impacts. 0 What are the staff recommendations? Staffis recommending approval of the conditional use permit to operate an auto storage facility with the following conditions: 0 That if the applicant intends to remain as a tenant for more than one year, the area used by the applicant must have a bituminous surface by June 1, 1995. 0 That there are no buildings constructed on the applicants site. 0 That the entire site has a screened fence 0 That there are no demolished cars stored on the site. 0 There shall be no dismantling of cars on the site. 0 That the conditional use permit is reviewed one year after approval. . 0 What happened at the Zoning and Planning meeting? Staff reviewed the applicants request with the Commission Gene Ross and Jim Ferris representing the applicant appeared before the Commission. They stated that this lot was only to be used for Hopkins vehicles towed during a snow emergency. They have other lots for the other towing they do. There was some discussion regarding a building on the site. At this time there will not be a building on the site. No one at spoke on this issue at the public hearing. Alternatives I. Approve the conditional use permit. By approving the conditional use permit, the applicant will be able to operate an auto storage lot. 2, Deny the conditional use permit. By denying the conditional use permit, the applicant will not be able to operate an auto storage lot. If the City Council chooses this alternative, findings of fact will have to be stated that support this decision. 3. Continue for further information. If the City Council indicates that further information is needed, the item should be continued. . -------- ------ . CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 94-101 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN APPLICATION FOR A CONDITIONAL USE PERMIT FOR AN AUTO STORAGE FACILITY WHEREAS, an application for a conditional use permit CUP94-5, made by Matt's Towing for an auto impound lot at 1300 Second Street South is approved. WHEREAS, the procedural history of the application is as follows: 1. That an application for a conditional use permit CUP94-5 was filed with the City of Hopkins on September 23, 1994. 2, That the Hopkins Planning Commission, pursuant to published and mailed notices, held a public hearing on the application and reviewed such application on October 25, 1994: all e persons present at the hearing were given an opportunity to be heard, 3. That the written comments and analysis of the City staff and the Planning Commission were considered. 4. A legal description of the subject property is as follows: Block I, Lot 2 Stiele Addition NOW THEREFORE, BE IT RESOLVED that the application for conditional use permit CUP94-5 is hereby approved based on the following Findings of Fact: 1. That the applicant meets the requirement for a conditional use permit. BE IT FURTHER RESOLVED, that application for CUP94-5 is hereby approved based on the following conditions: I.
