JOSEPH GARBER - SETTLEMENT
Proposed Action,
Staff recommends the following motion: Move to approve the settlement agreement between
the City and Joseph Garber to operate an auto sales lot at 525 Mainstreet.
Overview,
The City and Joseph Garber have been in negotiations regarding the operation of the auto
sales lot a 525 Mainstreet. It appears the City and Mr. Garber have resolved the issues. The
main issues of the settlement are as follows:
o The City of Hopkins will close the existing south curb cut on 6th Avenue and
construct a new curb cut 37 feet from the Mainstreet curb line.
o Mr. Garber will landscape the front yard by May 15, 1995
. o Mr. Garber will make a cash escrow of $2000.00 to insure compliance of the
landscaping requirement.
o Mr. Garber will be allowed a maximum of 10 display cars on the site
o Mr. Garber will comply with all the requirements for a conditional use permit for an
auto sales lot.
Alternatives
1. Approve the settlement between the City and Joseph Garber. By approving the
settlement, Mr. Garber will operate an auto sales lot at 525 Mainstreet.
2, Deny the settlement between the City and Joseph Garber By denying the settlement, the
issue will return to the courts for resolution.
3. Continue for further information. If the City Council indicates that further information is
needed, the item should be continued.

Based upon the Stipulation of the parties,
IT IS HEREBY ORDERED:
e 1. The Defendant shall forthwith issue to Plaintiffs a Conditional Use Permit
for the operation of an auto sales lot at 525 Mainstreet, Hopk:i.ns, in Hennepin County,
Minneso~ and legally described as follows:
Lots 9, 10 and 11, Block 64, West Nfinneapolis Second Division and that
part of Lot 3, Auditor's Subdivision Number 242, Hennepin County,
"Minnesota, lying South of an extension across said lot of the North line of
Lot 4 of said subdivision, according to the plat thereof on file or of record
in the office of the Registrar of Deeds in and for said County.
(Certificate of Title No. 793619)
2. The City of Hopkins shall close and repair (including curb and sidewalk)
the Southerly Sixth Avenue driveway now existing on Plaintiffs' property, and construct a
new concrete driveway, curbs, and sidewalk along Sixth Avenue commencing at a point
37 feet North of the Mainstreet curb line and extending 28 feet Northerly therefrom.
. This work shall be completed within thirty (30) days of the entry of this Order at the
City's expense.

"'" The Conditional Use Permit shall contain the following conditions:

. a. The sales lot shall not be larger in square footage than the square
footage of the building devoted to the related business, which at
present is 1835 sq. ft. allowing 10 display cars (one car for each 180
sq. ft. of building).
b. lighting of the sales lot shall be totally from indirect lighting.
c. Prior to the commencement of the auto sales lot operation, a 5'0"
high opaque wood fence shall be constructed along the complete
North property line.
d. The auto sales lot shall not include vehicles over a 9,000 lb. rated
weight.
e. The use of the property is subject to all applicable City ordinances,

inducting parking requirements.
f. Garbers shall at their expense, landscape and maintain the front
yard area shown on the site plan attached hereto as Exhibit "I" and
more particularly described as: an area Southwesterly of a straight
line bevnning at the westerly edge of the Mainstreet driveway
extended Northwesterly to a point on the West boundary of
Garbers' property 20 feet North of the South line of the property.
u The area described in Paragraph f above shall be landscaped in the

same fashion as sbown on Garbers' site plan prepared by Bachman's
dated March, 1993, utilizing the same type) size, and spacing of
. perennial, low-growing shrubs, with the 2'0" high concrete north wall
as shown on the Bachman's plan..

h. The landsc3.ping described in Paragraph f and g above shall be
. completed by May 15, 1995. Garbers will make a cash escrow
deposit with the City at the time of issuance of the conditional use
permit in the amount of Two Thousand and No/lOa Dollars
($2,000.00) to insure compliance with this landscaping requirement.
The funds shall be deposited in an interest-bearing account and
returned to Garbers with interest upon completion or the
landscaping work. If the landscaping is not completed by May 15,
1995, the City shall bave the right to use the escrowed funds to
complete the landscaping, with any balance returned to Garbers.
Garbers authorize the City and its authorized agents to enter the
. property to perform. this work.
1. The location of the display cars and customer parking shall be in
accordance with the site plan attached hereto as Exhibit "1",
provided that the total number of display cars shall not exceed the
number permitted under subparagraph a herein.
LET JUDGJ\1ENT BE ENTERED ACCORDINGLY FORTHWITI-I AND WITHOUT
COSTS AWARDED TO EITHER PARTY.
