Proposed Action.
Staff recommends adoption of the following motion: Move that Council
adopt Resolution 93-02, Resolution Approving Minnesota Department of
Transportation Agreement # 70109.
Overview.
The State Aid for Local Transportation Division requires that
municipal engineering technicians working on state aid projects
beginning January 1, 1994 be certified technicians. MN /DOT has
determined that the tuition cost for certification classes is eligible
for reimbursement from the Administrative Account for any classes
after November 1, 1992 and before July 31, 1995. Each local agency
will be limited to a total reimbursement of $5000.

Analysis.
Terms of agreement
MN /DOT agrees to reimburse the City in an amount not to exceed
$5000 in tuition costs incurred by the City as payment for the
successful completion of classes taken between November 1, 1992
and July 31, 1995. These classes are those offered to the City's
qualified personnel for the express purpose of attaining
certified status through MN /DOT's Technical Certification
Program.

The City agrees to submit participant's name, title, course taken
and amount to be reimbursed out of the City's MSA allotment.
Benefits to the City
The City stands to improve the quality of its staff with
reimbursement for cost's of training out of MSA funds instead of
the General Fund.

THIS AGREEMENT is made by and between the State of Minnesota, acting by and
through the Commissioner of the Minnesota Department of Transportation
(hereinafter referred to as "MN /DOT ") and HOPKINS (hereinafter referred to
and "Recipient ").
WHEREAS the State is authorized to administer the State Aid Administrative
Account pursuant to MN Statute 162.06, Subd. 2;
WHEREAS the - Division of State Aid requires all personnel working on State
Aid work be certified;
OH EREAS the certification of technicians will ensure consistent inspection
nd high quality roads and bridges;
NOW, THEREFORE, in consideration of the mutual covenants and agreements as
hereinafter set forth, the parties to this Agreement mutually agree as
follows:
I. Term of Agreement
This agreement shall be effective upon such date as it is executed as
to encumbrance by the Commissioner of Finance, and shall remain in
effect until all obligations set forth in this agreement have been
satisfactorily fulfilled or December 31, 1995, whichever occurs first,
by which time all requests for reimbursement must be received in the
State Aid Office.
II. Conditions of Agreement
All ersonnel working on State Aid work, including but not limited to
construction inspectors, and field testers, must be certified through
the Technical Certification Program on all work beginning on or after
January 1, 1994.
III. Reimbursement by MN /DOT
MN /DOT agrees to reimburse the Recipient an amount not to exceed more
than $5 total tuition costs incurred for personnel working on
State Aid work fcr the successful completion of classes taken between
November 1, 1992, and July 31, 1995. Recipient agrees to pay all costs
not included in, or which exceed, said amount.
A: Recipient mustsubtiit a resolution from the County Board /City
Council approving the agreement.
B: Request for reimbursement must be submitted on Recipient's
letterhead indicating each participant's name, title of each course
taken, and amount to be reimbursed for each course.
C: Recipient must submit a copy of payment voucher or a copy of the
canceled check as proof of payment for each course.
D: Request must be submitted to:
Audits
IV. All records, books, documents, and accounting , rocedures,and•practices
relevant to this a reement are subject to audit and examiniation by
MN /DOT and either the Legislative Auditor or State Auditor as
appropriate.
Termination of this Agreement
V. MN /DOT may withhold payment or terminate this Agreement at any time if
the Recipient does not comply with the provisions of this Agreement.
General Provisions
VI. The Recipient agrees to indemnify and save and hold the State, its
agents and employees harmless from any and all claims or causes of
action arising from the performance of this agreement by Recipient's
participants or employees. This clause shall not be construed to bar
any legal remedies Recipient or its participant's have for the State's
failure to fulfill it's obligation pursuant to this agreement.
VII. Any amendments to this agreement shall be in writing and shall b
approved by MN /DOT and the Recipient.

The City Engineer and City Clerk are hereby authorized to
enter into agreement with the Commissioner of the Minnesota
Department of Transportation, Agreement # 70109.
Adopted by the City Council of the City of Hopkins, Minnesota,
this 5th day of January, 1993.
