APPROVE ORDINANCE #93-721 FOR SECOND READING
Proposed Action
Staff recommends that the Council approve the following motion: Move to apprQve Ordinance #93-721 for
second reading and order that it be published.
This action will complete the process of amending Section 1325 of the Hopkins City Code to remove the
requirement that the towing contract be bid.
Overview
The City Council approved Ordinance #93-721 for first reading at its January 5th meeting. Since that time the
Ordinance has been modified in order to address some other issues in Section 1325.
Issues to Consider
. What additional changes are made to Section 1325?
1) In Section 1325.09 the term "fireman" is changed to "firefighter".
2) Section 1325.13 is amended by deleting the sentence that requires one copy of the police report be
delivered to the Finance Director.
3) In Section 1325.29 the number of release forms is changed from three to two and a release form
will no longer be sent to the Finance Director.
4) Section 1325.31 has been deleted in its entirety. This Section has language concerning the
prohibition of soliciting tows by the towing contractor. The same language is in Section 1325.23,
Subd. 4. The rest of this Section authorizes the impounding of damaged vehicles which obstruct a
street. This authority is already granted in other parts of Section 1325 which deal with vehicles that
are public nuisances.

BE IT ORDAINED by the Council of the City of Hopkins as follows:
SECTION 1. That Section 1325.23, be revised asfollews:
1325.23 Designatien of City Towing Contractor; contract
Requirements
Subd. 1. BidO for Towing Contractor. The City Manager
shall o.dvertioe for bide by recommend to. the City Council that a
contract be made. with a person, firm, or corporation desiring to
act as towing contractor for vehicles impounded under this
Ordinance. a-fl:€i the City Council may by motion or resolution

enter into a contract with the recommended person, firm, or

. SECTION 2. That Sectio.n 1325.09 be amended to. replace the term

SECTION 3. That Sectio.n 1325.13 be amended as follo.ws:
1325.13 Report o.f Police Officer. Any po.lice efficer o.r ether
authorized person directing the impounding of any motor vehicle
shall prepare a written report o.f the descriptio.n ef such
vehicle, which report shall, amo.ng o.ther things, include the
following: make of car; license number; number ef tires; to.ols
and other separate articles of perso.nal property; general
description of the car with regard to condi tio.n, damaged parts,
and such other informatio.n as may be necessary to. describe
adequately the vehicle and pro.perty delivered to the towing
co.ntractor. A co.py of such report, signed by the officer, shall
be delivered to. the tewing contracter at the time o.f impounding.
The towing contracto.r shall receipt fo.r such report, and shall
check such repo.rt, and his signature thereo.n shall be co.nsidered
a receipt for the vehicle and property described in said report.
The o.riginal and one copy o.f said report, and tewing co.ntracto.r's
receipt shall be filed in the Police Department. The Police

.. SECTION 4. Section 1325.29 shall be amended as follows:
.~. 1325.29. Release Form. At the time of return of the vehicle the
official towing contractor shall release the same by a release in
writing which shall state the dat.e of such release together with
the charges enumerated thereon and the purpose for which such
charges were made. Then release. shall be made in one original and
thrcnc ntwo copies, all of which shall be signed by the towing
contractor and the person to whom such release is made. The
official towing contractor shall retain the original of such
release and shall deliver one copy thereof to the owner of the
vehicle and two copies to the police department. The. police
department ohall deliver one copy to the director of finance.
SECTION 5. Section 1325.31 shall be deleted in its entirety.
