Prooosed Action.
Staff recommends adoption of the following motion: Move that
Council adopt Resolution 93-83. Resolution Acceotinq Petitions
por Private Imorovements and Orderinq Preoaration of Assessment
Roll - 1993 Miscellaneous Soecial Assessments.
Adoption of this resolution will begin the assessment process for
various small projects and delinquent invoices.
OVerview.
In addition to assessing delinquent invoices and maintenance of
the parking ramp, the Council will need to consider small
projects undertaken during the past year: installation of public
sidewalk at the Sonoma Apartments, repair of broken water service
utility at 910 Mainstreet in conjunction with Mainstreet
reconstruction, excavation of a private pond at 707 Oakridge Road
in conjunction with the Knollwood neighborhood street
reconstruction project, certain parking lot improvements at
. Alliant Techsystems in conj4nction with the 2nd street N.E.
Sidewalk project.
An assessment roll will be calculated and presented to the
Council for its review ~t the September 7 meeting.
Primary Issues to Consider.
. Petitions for Private Improvements
The four attached petitions are for private improvements that
were performed in conjunction with larger public improvement
projects. The petitions are valid and concern improvements
expressly covered by M.S.S. 429. Staff recommends acceptance
of the petitions before their project costs are entered on an
assessment roll.

. Should assessment procedures begin now?
Although final certification of special assessments is
scheduled for November 30, staff feels it is prudent to begin
the process now and allow ample time to carry out the full
assessment procedure.

PETITION BY PROPERTY OWNERS
We, the undersigned property owners in the city of Hopkins,
petition the Honorable City Council to:
Excavate approximately four feet of soil from our pond on
herein described property in conjunction with the Knollwood
street improvement proj ect. Pond excavation to be
approximately four feet in the middle and tapered evenly up
the side slope. We agree to be assessed ($9,500) nine
thousand five hundred dollars for this work and agree to
restore the boulevard area between the pond and new street
with landscaping and sod prior to November 30, 1992. The
ci ty will assume all other costs associated with this pond
excavation as payment for the property owner performing the
boulevard restoration that was originally a part of the
pUblic street improvement project, and for easement rights
,across the pond. We further understand that the city will
not be held liable or participate in any repair costs if
this pond fails to hold water subsequent to the excavation.
We furthermore agree that if we fail to install sod and
landscaping as described above, the city will install such
items and assess the cost against our property.

RESOLUTION ACCEPTING PETITIONS FOR PRIVATE
IMPROVEMENTS AND ORDERING PREPARATION OF
ASSESSMENT ROLL - 1993 MISCELLANEOUS
SPECIAL ASSESSMENTS
WHEREAS, certain private improvements in conjunction with larger
pUblic improvements have been petitioned for, and
WHEREAS, certain improvements have been completed, agreements
fulfilled, and costs of delinquent invoices have been
incurred,
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
HOPKINS, MINNESOTA:
1. The following petitions for private improvements are
declared to be valid and in conformity to Minnesota
Statutes, section 429.035 and are hereby accepted:
. a) Installation of public sidewalk at 44 5th Ave.
South, Sonoma Apartments,
b) Repair of broken water service utility at 910
Mainstreet in conjunction with Mainstreet
reconstruction,
c) Excavation of a private pond at 707 Oakridge Road
in conjunctiqn with the Knollwood neighborhood
street reconstruction project,
. d) Parking lot improvements at Alliant Techsystems in
, conjunction with the 2nd street N.E. sidewalk
project.
2. The engineering superintendent shall forthwith
calculate the proper amount to be specially assessed
for each such improvement, agreement, or delinquent
invoice against every assessable lot, piece or parcel
of land abutting on the streets affected, without
regard to cash valuation, as provided by law, and he
shall file a copy of such proposed assessment in the
city office for inspection.
3. The engineering superintendent shall, upon completion
. of such proposed assessments, notify the Council
thereof.
