ORDINANCE TO AMEND CITY CODE
PROCEDURES FOR COLLECTION AND DEFERMENT
OF SPECIAL ASSESSMENTS
Proposed Action.
Staff recommends approval of the following motion: Move for adoption
of first reading of Ordinance 93-724 amendina Section 703.03 of the
city Code.
Overview.
council in June 1990 adopted a new ordinance establishing provisions
for pre-payment and deferment of special assessments. since that time
several property owners have taken advantage of the provisions when
faced with assessments. Wording within section 703.03 concerning the
mechanics of prepayment has been found ambiguous and staff wishes to
clarify provisions.

o How does the amendment clarify the code?
The new paragraph spells out clearly the minimum amount of pre-
payment and the term over which pre-payment can be made, with or
without interest. The old section left one with the impression
that pre-payments had to be made within thirty days of adoption

AN ORDINANCE AMENDING SECTION 703.03
OF THE HOPKINS CITY CODE
RELATING TO PROCEDURES FOR THE COLLECTION
AND DEFERMENT OF SPECIAL ASSESSMENTS
THE CITY COUNCIL OF THE CITY OF HOPKINS DOES ORDAIN:
SECTION 1. The Hopkins City Code Section 703.03 is hereby amended by
substituting a new paragraph to read as follows:
703.03 Pre-payment. At any time prior to certification of the
assessment by the City to the County Auditor, an owner may pre-pay not
less than 25% of the assessment with interest accrued to the payment
date, exce~t that no interest shall be charged if such partial payment
is made within 30 days from the adoption of the assessment. The
balance remaininq shall be paid in accordance with the schedule
adopted bV the city Council or as provided in Minnesota Statute
Section 429.061, Subd. 3.
SECTION 2. This Ordinance is effective on June 29, 1993.
