AMEND CONTRACT FOR HOUSING REHABILITATION PROGRAM
INSPECTION SERVICES

staff recommends approval of the following motion: Amend
contract for 9rofessional services with Firmus Opitz to
increase the inspection/"scope of work" fee to $250 per
~roject.
with approval of this motion, the contract will be amended
and the fee increased.
Overview
Inspection and Scope of Work preparation for the City's
Housing Rehabilitation Loan/Grant Program is currently
being completed by Firmus Opitz, a former City Housing
Inspector, under a contract for professional services.
Under the current contract, Mr. Opitz is paid $200 per
inspection/"scope of work" preparation. He has requested an
increase of $50 per inspection as he feels the current fee
does not adequately compensate him for his time.
Staff is recommending that the inspection fee be increased
to $250. Staff is, however, in the process of reviewing our
inspection contracts and may be soliciting bids for this
service in the near future.
Primary Issues to Consider
Why does the City contract with an independent inspector?
Legal counsel has advised staff that the City Inspectors
should not be involved in rehabilitation program inspections
due to the fact that code deficiencies witnessed by the
inspector would have to be corrected whether or not the
applicant received assistance through the program.
Therefore, an independent inspector is required who must be
familiar with the City's codes and the rehabilitation
program guidelines. Staff is comfortable with Mr. Opitz's
qualifications for this position.

CITY OF HOPKINS
CONTRACT FOR PROFESSIONAL SERVICES
IT IS HEREBY AGREED THAT, Firmus Opitz is to furnish
services as herein stated for the CITY OF HOPKINS,
MINNESOTA. It is further agreed that said services are to
be rendered as an independent contractor and not as an
employee of the city of Hopkins. Accordingly, the above
named contractor shall not be entitled to or receive any
benefits, such as vacation or sick leave pay, pension and
insurance contribution, or holiday or overtime pay. This
agreement shall take effect upon its execution by both
parties and shall remain in effect until termination by
either party by 30 days notice, in writing, to the other
party.
SERVICES TO BE PERFORMED UNDER TERMS OF THIS AGREEMENT SHALL
BE:
Inspection (s) and preparation of "Scope of Work" for
eligible rehabilitation projects
CONSIDERATION TO BE PAID FOR SERVICES SHALL BE:
$250 per Inspectionj"Scope of Work"
$50 per bid reviewal
