Overview. The applicant, Parkway Tree vacant lot at 630 11th Avenue of the lot is 100' x 130'. Service is proposing to South for a storage lot. use the The size Parkway Tree Service is currently located at 700 16th Avenue South. This is the location of Pipeline Supply. Pipeline Supply is expanding their operation and Parkway Tree Service needs a new location. The applicant's business does tree trimming, tree removal and stump removal. The lot will have a 12' x 22' foot moveable utility building on the site. The lot will be used for the storage of trucks, firewood, small planting trees, and black dirt. The staff reviewed the applicants proposal. Leo Esget, the applicant, appeared before the Commission. The Commission discussed various issues regarding the site. Dust control of the site was the main issue. It was decided that a Class 5 surface treated with calcium chloride would be acceptable. Richard Gay, the abutting property owner to the north, appeared before the Commission. Mr. Gay was satisfied with the proposed dust control measures for the site. Primary o o o o Issues to Consider. The site is zoned I-1, Industrial. An open storage lot is permitted with a conditional use permit. The Comprehensive Plan has designated the subject site as industrial. o What are the requirements for a conditional use permit? The Zoning Ordinance requires the following for open storage: 1. the lot is graded and surfaced according to a plan submitted and approved by the City Engineer that will adequately provide for drainage and dust control; 2. that the storage on such lot be so organized that a space of 15 feet for vehicular accessible open space remain between storage area with such areas not to exceed 40 feet in width; 3. that the height of such open storage shall not exceed 15 feet; 4. that the storage area shall be fenced in such a way as to screen from the street right-of-way; and 5. that the area shall be landscaped and maintained according to a plan submitted and approved by the building inspector. 6. that a side yard setback is required for fences that abut a right-of-way 50 feet or more in width, the setback shall be the required setback for a building in said industrial district. The fence ordinance also requires any fence in the front yard to have the same setback as required for a building. In this case the setback is 20 feet from the property line. The applicants site plan shows 16 feet from the curb. The fence will have to be setback further. o What are the specifics of the site plan? Landscaping The front yard of the site will be landscaped. The plan submitted by the applicant shows 10 evergreen trees plus 12 mint junipers. This plan was acceptable to the Commission. Drainaqe The applicant has proposed to grade the lot and place Class 5 surfacing on the site. staff is concerned with the dust control CR93-68 Page 3 wi th Class 5 surfacing on the site. The other al ternati ve to Class 5 is paving the lot with asphalt, which will be expensive for the applicant. The staff has contacted the Watershed District to see if they have a surface requirement. The Watershed District does not have a requirement for the surface of the lot. However, Bob Obermeyer would recommend a surface of Class 5 rather than the asphalt. Acc ss Access to the site will be from the alley in the rear of the site. There will be no access from 11th Avenue to the site. The alley is currently not improved, but several of the abutting properties have paved some of the alley. Staff is recommending that the alley behind the applicants lot is hard surfaced with a plan approved by the City Engineer. Fencing The applicant is proposing to erect a six foot chain link fence with slates. This fence will surround the site. staff is recommending that the applicant construct a wood fence along the front yard on 11th Avenue and on the south and north side of the property. Building The applicant is proposing to place a 12' x 22' building on the site. The height of the building is 12 feet. Any building on the site will have to meet any applicable building codes. Also, it should be understood that this structure may not be used for office purposes. o What is the staff recommendation? Staff is recommending approval of the conditional use permit, with the conditions as outlined in the Resolution. Alternatives 1. By approving the conditional use permit, the City Council will allow the applicant to use the lot for storage for his tree service business. 2. By denying the conditional use permit, the City Council will not allow the applicant to use the lot for storage for his tree service business. 3. Continue for further information. WHEREAS, the procedural history of the application is as follows: 1. That an application for a conditional use permit CUP 93-4 was filed with the City of Hopkins on March 26,1993. 2. That the Hopkins Planning Commission, pursuant to published and mailed notices, held a public hearing on the application and reviewed such application on April 27, 1993: all persons present at the hearing were given an opportunity to be heard. I~ ~_. . 3. That the written comments and analysis of the city staff and the Planning commission were considered. 4. That the legal description of the property is as follows: Lot 6 and 7, Block 57 West Minneapolis. NOW THEREFORE, BE IT RESOLVED that the application for conditional use permit CUP 93-4 is hereby approved based on the following Findings of Fact: 1. That the applicant's use is permitted in the 1-1 zoning district with a conditional use permit. 2. That the applicant's proposed use complies with the requirements for a conditional use permit. BE IT FURTHER RESOLVED, that application for CUP 93-4 is hereby approved based on the following conditions: 1~ That the fence along 11th Avenue is set back 20 feet from the property line. 2. That the applicant comply with the requirements of 540.03M of the zoning Ordinance which are the requirements for a storage lot. ", . . '. -" RESOLUTION NO: 93-41 Page 2 3. That the applicant provide a letter of credit, bond or cashier's check, 1 1/2 times greater than the cost of the landscaping and fencing. This bond, letter of credit or cashier's check shall be valid for two - growing seasons. 4. That the fencing must be installed by July 1, 1993. 5. That the landscaping ,must be installed by August 1, 1993. 6. Any buildings on the site will comply with building codes if applicable. 7. That the building on the site may not be used for office purposes. 8. That the entire lot is surfaced with Class 5 with the applicant to provide dust control measures on an ongoing basis as dictated by the city Engineer. 9. That the fence1along the east, north, and south sides of the site is a 6 foot wood fence. 10. That the applicant get approval from the watershed district, if approval is required. 11. That the alley behind the applicant's property is hard surfaced pursuant toa plan approved by the city Engineer. 12. That any storage of materlalscin the lot is covered. 13. That materials stored in the lot are not stacked or piled higher than 6 feet. 14. That the applicant provide a grading plan for the site. Furthermore, when the lot is graded, dust control measures are to be used to control the dust. Adopted by the City council of the City of Hopkins this 4th day of May, 1993. Nelson W.
