PRELIMINARY/FINAL PLAT - WESTBROOKE HILLS
Proposed Action.
staff recommends the following motion: Move to approve
Resolution 93-65 approvinq the preliminary/final plat for
Westbrooke Hills.
Mr. Winship moved and Mr. Day seconded a motion to approve
Resolution RZ93-12 recommending approval of a
preliminary/final plat for westbrooke Hill.
Overview.
Three S Properties, owners of the Fortress Mini-storage, is
proposing to re-plat an outlot south of the mini storage
site at 1144 7th street South. The outlot was part of the
Westbrooke Patio Homes plat and is vacant.
The applicant is proposing to re-plat this lot by dividing
it into two sections. The northerly 75 feet will be joined
with the mini-storage site and the southerly 70 feet will
become Lot 2. Lot 2 is proposed to be purchased by the
Westbrooke Patio Homes Association for their use.
Westbrooke is proposing to construct a maintenance building
on the east side of their property in the future.
The applicant has also applied for a rezoning of the outlot
and an amendment to their conditional use permit to
construct an addition. The outlot is presently zoned B-3
and is proposed to be rezoned to I-1 and R-2.
Staff reviewed the proposed plat with the Commission. Todd
Jones, representing the mini-storage owners appeared before
the Commission. There was little discussion on this item.

primary Issues to consider.
o Is the outlot needed for the Westbrooke Patio Homes?
The outlot is not needed as open space for the Westbrooke
Patio Homes. The Patio Homes have the required open space
without this outlot.
o Do the proposed lots meet the minimum lot requirements?
The north section of the outlot, which is Lot 1, will be
added to the existing mini-storage site. The additional
land will increase the size of the existing lot. Lot 2,
which will be used by the Patio Homes will be rezoned R-2.
Lot 2 will meet the minimum requirements for a lot in the R-
2 district.
A maintenance building is proposed to be constructed on Lot
2 for the patio homes in the future.
o What is the action being requested?
The applicant is requesting approval of both a preliminary
and final plat. The Ordinance allows both a preliminary and
final plats to be approved a the same time. The plat
details the specifics of how the lots will be divided and
the location of the required easements.
Alternatives.
1. By approving the preliminary/final plat, the applicant
will be able to subdivide the plat.
2. By denying the preliminary/final plat, the applicant
will not be able to subdivide the property.
3. Continue for further information. If the city Council
indicates that further information is needed the item
should be continued.

RESOLUTION NO: 93-65
RESOLUTION MAKING FINDINGS OF FACT AND
APPROVING AN APPLICATION FOR A PRELIMINARY/FINAL PLAT
FOR WESTBROOKE HILLS
WHEREAS, an application for a subdivision SUBD93-1, made by Three
S Properties to re-plat an outlot south of the mini storage site at
1144 Seventh Street South is approved.
WHEREAS, the procedural history of the application is as follows:
1. That an application for a subdivision SUBD93-1 was filed
with the City of Hopkins on May 26, 1993.
2. That the Hopkins Planning commission, pursuant to published
and mailed notices, held a public hearing on the application
and reviewed such application on June 29, 1993: all persons
present at the hearing were given an opportunity to be
heard.
3. That the written comments and analysis of the City staff and
the Planning Commission were considered.
NOW THEREFORE, BE IT RESOLVED that the application for
subdivision SUBD 93-1 is hereby approved based on the following
Findings of Fact:
1. That the Westbrooke Hills plat meets the subdivision
requirements.
2. That the Westbrooke Hills plat meets the minimum lot
requirements for the zoning district in which the plat
will be located.
BE IT FURTHER RESOLVED, that application for SUBD 93-1 is hereby
approved based on the following conditions:
1. That the Westbrooke Patio Homes Association and/or the
applicant provide the City with a license agreement for
the monitoring wells on Lot 2.
2. That the berm as shown on the site plan is maintained
as a berm.
