Proposed Action.
Staff recommends the following motion: Move that Council accept
the feasibility report as ordered on March 2. 1993.and adopt
Resolution 93-48. Resolution Orderinq Improvement After Public
Hearinq.
This action will continue an assessable project on the block
between 11th and 12th Avenues North between Mainstreet and 1st
Street North. Plans and specifications will be developed and
bids solicited for construction in August 1993.
Overview.
council at its regular April 6 meeting considered a feasibility
study concerning the reconstruction of the above-referenced alley
and ordered a public hearing for May 18. This hearing date was
subsequently amended by Council action to June 1. Notices have
. been sent to all affected property owners. A public information
meeting was conducted with the residents on March 23 for
discussion of all improvement issues, estimated costs, and
assessment policies.

Analvsis.
· What are the current conditions of the alley?
The alley in its current status is considered unimproved.
Its surface consists of 1"-1 1/2" of bituminous in
deteriorated condition with poor drainage patterns. The thin
asphalt layer and bad drainage have contributed to the many
potholes and have sUbstantially increased maintenance costs.
· What are the estimated costs of an improvement?
Reconstruction with concrete pavement is estimated at
approximately $27,000. The lots on this block are
substantially uniform in width. The fairest method to assess
this project is on the per lot basis. This policy translates
into an average assessment of $1,200 per lot. The Hennepin
County Library and u.s. West properties total 6 lots each
and, although not all lots in both cases front directly on
the alley, the properties as a whole are deemed to benefit
from the improvement. The estimated assessments for the two
properties are $7,200 each.
Assessments will be based on the city's policy of 80% project
cost to be funded by the residents, 20% will be funded by the
city. The additional cost of refurbishing the alley storm
sewer will be borne by the storm sewer utility. This cost is
estimated at $1,200.
. Staff recommendation
Staff has encountered mostly positive reaction to this
project at the neighborhood information meeting. These
sentiments coupled with deteriorated conditions of the alley
lead staff to recommend adoption of the resolution ordering
plans and specifications.

WHEREAS, the City Council of the city of Hopkins, Hennepin
County, Minnesota, deems it necessary and expedient that the
improvement hereinafter described be made,
NOW, THEREFORE, notice is hereby given that the City Council will
hold a public hearing on said improvement at the following
time and place within the said City.

The general nature of the improvement is the construction of a
concrete alley and storm sewer improvements, City Project 92-11,

THE TOTAL ESTIMATED COST OF SAID IMPROVEMENT IS $28,235.
It is proposed to assess every lot, piece or parcel of land
benefitted by said improvement whether abutting thereon or not,
based upon benefits received without regard to cash valuation.
Persons desiring to be heard with reference to the proposed
improvement should be present at this hearing.
This Council proposes to proceed under the authority granted by
Chapter 429 MSA.

Introduction
The 1993-97 Capital Improvement Plan (C.I.P.) includes an alley paving
project for each year of the five year plan. The 1993 plan identified
two alleys that staff determined were necessary to upgrade with
concrete paving due to the high maintenance and drainage problems
associated with them. The city Council reviewed these proposed alley
paving proj ects during their review of the C. I . P., and subsequently
authorized staff to begin the initial analysis of these projects upon
their adoption of the C.I.P. .
Backqround
The alley bounded by 11th Ave N/12th Ave N/1st st N/400' south is
presently considered an unimproved alley. Its surface consists of a
1" - 1.5" asphalt layer that has poor drainage characteristics. The
combination of the thin asphalt layer and the poor drainage patterns
have resulted in this alley developing many potholes over the years
thereby substantially increasing maintenance and other associated
problems.
Proposed Design
The proposed alley improvement project provides for the construction
of a concrete pavement surface 12 feet wide and six inches thick in
accordance with the City of Hopkins' improvement policy. New alley
aprons will also be constructed on 1st st N and on 12th Ave N to
better match existing grades on these streets. Driveway aprons will
be paved between the new alley surface and the paved driveways with
similar material as the top surface of the driveway. Gravel will be
placed in driveway openings in all situations other than matching
concrete or asphalt driveways. There will be no sod restoration on
this proj ect. Black dirt and seed will be placed in all disturbed
turf areas along the alley.
The pavement will include a "V" design, slightly depressed in the
middle, to channel water towards the middle of the alley instead of
towards adjacent properties. It is also proposed that the pavement
grades be established to direct the drainage to an existing storm
sewer catch basin located on the south end of the alley.

Proposed Fundinq
It is proposed that the concrete pavement portion of the project
be
assessed in accordance with city policy, 80% against
abutting
benefitted properties and 20% against the City of
Hopkins. It is
further proposed that the storm sewer portion of the project be paid
entirely from the storm sewer utility fund, and also
the 20%
assessment against the City of Hopkins.
It has been determined that the fairest method to assess this project
is on a per lot basis. The Hennepin County Library will be assessed
for 6 lots as a direct benefit. U.S. West will be assessed for 6 lots
as an indirect benefit. A summary of the estimated
costs and
assessments are provided below. Assessments per lot are shown on the
attached site plan.

RESOLUTION NO. 93-48
RESOLUTION ORDERING IMPROVEMENT AFTER PUBLIC HEARING
WHEREAS, a resolution of the city Council adopted the 20th day of
April, 1993, fixed a date for a Council hearing on the
proposed improvement of an alley on the block between
11th/12th Avenues North, Mainstreet and 1st Street North,
and
WHEREAS, the Council deems it appropriate and expedient to
reconstruct the alley with concrete pavement, and
WHEREAS, ten days mailed notice and two weeks published notice of
the hearing was given, and the hearing was held thereon on
the first day of June, 1993, at which all persons desiring
to be heard were given an opportunity to be heard thereon,
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
HOPKINS, MINNESOTA:
1. Such improvement is hereby ordered as proposed in the
Council resolution adopted the 20th day of April, 1993.
2. RCM Associates, Inc. is hereby designated as the
engineer for this improvement and shall prepare plans
and specifications for the making of such improvement.
Adopted by the City Council of the City of Hopkins this 1st day
of June, 1993.
