HOTEL REGISTRATION ORDINANCE
Proposed Action
Staff recommends that the Council approve the following motion: Move to approve Ordinance #93-726 for
first reading.
Approval of this motion will begin the process of adding Section 1170 to the Hopkins City Code relating to
hotel registration.
Overview
The Hopkins Police Department has had discussions with the Hopkins House concerning the number of police
calls involving the Hopkins House. Management of the hotel suggested that it might be helpful to establish a
City ordinance making it a crime to register under a false name.
The police department found an ordinance from the City of Golden Valley which they feel would serve. The
attached ordinance is modeled upon Golden Valley's ordinance.

ORDINANCE NO. 93-726
HOTELS AND LODGING HOUSES
The City Council of the City of Hopkins does hereby ordain:
SECTION 1. That a new Section 1170, Hotels and Lodging Houses, be added to the
City Code and to read as follows:
1170.01 Definitions. Subdivision 1. For the purpose of this Section, the following
terms have the meanings stated:
Subd. 2. "Hotel" is a building containing guest rooms (i) in which lodging is
provided with or without meals for compensation, (ii) which is open to transient or
permanent guests or both, (iii) where no provisions are made for cooking in any guest
room, and (iv) in which principal access to and from all rooms is made through an
inside lobby or office supervised by a person in charge.
Subd. 3. "Motor court, motor hotel or motel" is a building or group of buildings
other than a hotel or lodging house used primarily as a temporary residence.
Subd. 4. "Lodging House" means every building or structure or any part thereof,
kept, used as, maintained as, advertised as, or held out to be a place where sleeping
accommodations are furnished to the public as regular roomers for periods of one week
or more and having five or more beds to Jet to the public.
1170.03 License Required. It is unlawful for any person to keep, maintain or
operate a hotel, motel, or lodging house without a license therefor from the City.
1170.05 Requlations Incorporated by Reference. Regulations of the Minnesota
Department of Health relating to hotels, motels, and lodging houses are hereby
incorporated herein and made a part hereof as though set forth verbatim. One copy of
such regulations shall be kept on file in the office of the City Clerk and open to
inspection during regular office hours. It is unlawful to violate any provision of such
regulations.
1170.07 Inspection. The City may inspect all hotels, motels, and lodging houses
to determine compliance with laws and regulations relating hereto.
1170.09 Animals. It is unlawful for any guest to keep, or any operator of a
hotel, motel, or lodging house to permit keeping, any wild or domesticated animal in
any room therein. This section does not apply to trained seeing-eye, hearing-ear, or
guide dogs, provided, that the guest is responsible for any damage done by the dog.
1170.11 Hotel Reqistrations. Subdivision 1. For the purpose of this section a
hotel includes motels and lodging houses.
Subd. 2. Reqistration Required. It is unlawful for any person to register at any
hotel, or cause any other person or persons to be registered in any hotel, under any
false name or address, or assumed name or address or under any other than their true
name or address; and it is also unlawful for any person or persons, who are not in fact
husband and wife, to register or cause or permit themselves to be registered as
husband and wife at any hotel.
Subd. 3. Falsifyinq Number in Party. It is unlawful for any person to register at
any hotel in such manner as to incorrectly designate the number and names of other
persons in the party who will also be occupying the room for which registration is being
sought; nor shall any person registered at any hotel permit or allow any other persons
who have not been designated in the registration, as persons intended to occupy such
room, to occupy the same.
Subd. 4. Hotel Duties. Every person operating a hotel shall provide and keep
there a suitable guest register, or equivalent, for the registration of all guests provided
with sleeping accommodations or other overnight stopping accommodations therein,
and every such guest shall be registered therein. The hotel operator shall cause to be
registered in ink in such register book, or equivalent, the name and address of the
guest and every person, if any, with such guest as a member of the party; the
designation of the lodging unit occupied by each person staying at such hotel; and if
traveling by motor vehicle, the make of such vehicle, and the license plate number
carried on the vehicle, including the name of the state issuing such official plate. In
addition at the time of registrant's first registration and in all subsequent events where
the registrant is unknown to the operator at the place of registration the hotel operator
shall verify the name and home address of the guest by requiring that the guest display
to the operator a valid driver's license, current identification card, or identification
sufficient to verify the guest's name and home address and the operator shall enter in
the guest register the identification number and issuing authority of the driver's license
or identification card.

Subd. 5. Guest Reqistration. Every person, upon arriving at any hotel and
applying for guest accommodations shall furnish to the operator or other attendant in
charge of such hotel, the registration information necessary to complete this
registration in accordance with the requirements of Subdivision 4, above. The
registrant shall be responsible for room charges, and any damages incurred by the
hotel because of the registrant's or the registrant's guest behavior during the period
listed for occupancy.
Subd. 6. Reqistration Records. Inspection. The registration records provided in
this Subdivision shall be open to the inspections of all law enforcement officers of the
City and State.
SECTION 2. The effective date for compliance with this ordinance will be August 1,
1993.

I have read through the Golden Valley Hotel and Lodging House
Ordinance and its contents make sense to me. I though we had
a hotel ordinance that referred to items contained in the
Golden Valley Ordinance that I reviewed.
Since hotels are a licensed activity, the
accompanying
ordinance containing the Golden.. Valley clauses would be
recommended. You may w~t.l run this by the Inspection
Department and Nancy Anderson r their thoughts.
