CR 93-85 Dow Towers Parking Lot May 25, 1993 Council Report 93-85 DOW TOWERS PARKING LOT Proposed Action. staff recommends adoption of the following motion: Approve award of contract for construction of parking lot south of Dow Towers to Frana and Sons Inc. and authorize execution of the necessary contract documents subject to staff conditions. Overview The HRA recently solicited bids for construction of a new parking lot to address the increased parking needs of Dow Towers. As a result of this process three bids were received. Staff is recommending award to the low bidder, Frana and Sons Inc. They are the contractor that is presently building the Sonoma Apartment Project for National Handicap Housing Institute Inc. Frana and Sons bid was in the amount of $12,450. Staff originally estimated the cost of the project to be $15,000. It is anticipated that construction of this parking lot facility will begin in summer or early fall. The overall construction will be coordinated with various activities taking place in the Sonoma Apartment Project. Staff has reviewed the recommended award with RLK and Associates. RLK prepared the bid specifications and they feel comfortable that Frana will be able to complete the project in conformance with the detailed specifications. As discussed previously with the City Council, Community Development Block Grant funds will be used for this project. Primary Issues to Consider 0 What are the staff's conditions? The only condition staff recommends is that language be inserted in the contract which outlines that "proceeding with the work as detailed in the contract is contingent upon receipt of 1993 Community Development Block Grant dollars by July 1, 1993 and that if such funds are not received by the city of Hopkins, the HRA has the ability to terminate the contract with ten (10) days written notice prior to an authorization to proceed." As community Development Block Grant dollars are going to be used to pay for this project, Hennepin County requires that such language be detailed in the contract. Supporting Information 0 site Plan 0 Summary of bids ~ Development Director hereinafter referred to as the "Redevelopment Property"; and WHEREAS, in order to achieve the objectives of the Redevelopment Plan the Authority is willing to assist the Redeveloper through the acquisition of the Redevelopment Property and the conveyance of such property to the Redeveloper at a cost which would make the Redeveloper's development financially feasible; and WHEREAS, in order to achieve the objectiyes of the Redevelopment Plan the Authority has determined to provide substantial aid and assistance to the Project through the acquisition of the Redevelopment Property, its sale to the Redeveloper for an amount less than the amount paid by the Authority for such acquisition and certain other covenants and undertakings of the Authority hereunder; and WHEREAS, the Authority has created within the projects two tax increment financing districts, one of which was created pursuant to Section 469.042 (formerly section 462.585) of the Act, and one of which was created pursuant to Minnesota Statutes, Sections 469.174-.179; and WHEREAS, the Authority intends to reimburse itself for a portion of its costs of acquiring the Redevelopment Property utilizing tax increment generated from the Redevelopment Property and the improvements to be constructed thereon; and WHEREAS, the Authority believes that the redevelopment of the Project Areas pursuant to this Agreement, and fulfillment generally of this Agreement, are in the vital and best interests of the City and the health, safety, morals, and welfare of its residents, and in accord with the public purposes and provisions of the applicable state and local laws and requirements under which the Projects have been undertaken and are being assisted. NOW, THEREFORE, in consideration of the premises and the mutual obligations of the parties hereto, each of them does hereby covenant and agree with the other as follows: 2 .
