. Adoption of Assessment Roll
1993 Miscellaneous special Assessments
and
certain Private Improvements
Proposed Action.
Staff recommends adoption of the following motion: Move that
Council adopt Resolution 93-101, Resolution for Adoption of
Assessment Roll, 1993 Miscellaneous Special Assessments and
Certain Private Improvements.
Overview.
The proposed special assessments as described in Exhibit A are
for unpaid utility bills, delinquent invoices, parking ramp
maintenance and small improvement projects. All of these are
charges that can become a lien against the properties involved.
Notices of this public hearing and statements of assessment have
been mailed to all affected property owners.
Primary Issues to Consider.
. What are the details concerning the assessments?
Refer to attached Exhibit A.
. . What is the appeal process?
Residents are given the opportunity to approach Council with
their appeals during the public hearing. Standard appeal
forms have been available at city Hall and need to be
submitted no later than the public hearing date.
.
. Specific Appeals/Recommendation
The owner/developer of the Sonoma Apartments has submitted
appeals to cancel the assessment for the sidewalk
construction project at that site and requests that the
assessment be reheard and adopted by March 1994. The appeal
is by reason that the project is incomplete and certification
of the assessment now places undue hardship on the
owner/developer. Staff concurs and recommends cancellation
until a rehearing in March 1994.

CITY OF HOPKINS
MEMORANDUM
Date: September 21, 1993
To: Jim Gessele
From: Jerre Miller
Re: Sonoma
I After our c;nversation, I called Mike Bjerkset. According to him,
they will close on Sonoma in February 1994. If there is an
assessment then levied against the property, it must be satisfied
in full.
Because Sonoma \)Till have an operating budget but will not be
~ affunded to handle the assessment until after closing, the amount
\', then due would have to be paid off by NHHI' s own resources.
Apparently, HUD regulations will allow Sonoma to pay a subsequent
levied assessment from its own operating budget rather than
requiring it to be paid from the mother company. This is the
reason why the assessment must be deferred.
I told Bj erkset that he would be obliged to pay accumulated
interest and an application for deferment or postponement would
need to be presented to the Council for its consent which he will
do. /'~'/
The City would then certi~y it~;fevy in November 1994.
