P K \ Adoption of Assessment Roll Alley Reconstruction - Alleys A & B Project 92-11 Alley Reconstruction - Alley C Project 93-13 Pro'Oosed Action. staff recommends the following motion: Move that Council adoot Resolution 93-104, Resolution for Adootion of Assessment Roll, Proiect 92-11 (Allev Reconstruction A & B) and proiect 93-13 (Allev Reconstruction C) . Overview. Council at its September 7 meeting considered the preliminary assessment roll for the three alley reconstruction projects this past summer. This hearing sets in motion special assessments to be levied against the properties involved in the attached exhibits. H__'_. . .. . Analvsis. · Public Hearing Process Council should be aware that it needs to consider the three alley projects in distinct and separate hearing procedures. The hearings should be opened, appeals heard and then closed before moving on to remaining projects. council then should take action on the appeals before voting on the resolution for adoption of the assessment roll. · Appeal Process Property owners are given the opportunity to approach Council with their appeals during the public hearing. standard appeal forms have been available at city Hall and need to be submitted no later than the hearing date. Council may need to act on additional appeals submitted subsequent to the writing of this report. . Specific Appeals A. Alley "A" #10 Block 11th/12th Avenues North Appeal Request: Owner of property at 21 12th Avenue North requests cancellation of assessment by reason that the alley in question is not used by the residents, that garage access . is from 12th Avenue. Staff Recommendation: Staff recommends denial of the appeal on the basis that the property abuts the improved alley, that the potential exists for a future access from the alley to the garage and therefore the property derives benefit from this project, that police and .fire protection may depend on use of the alley as a means of access to the property, that the alley affords improved storm drainage to all abutting lots. As far as staff is able to ascertain, council has not granted appeals of this nature in past alley assessments. B. Alley "B" #200 Block 12th/13th Avenues North Appeal Request: Owner of property at 225 13th Avenue North requests cancellation of assessment by reason that the alley in question is not used by the residents, that garage access is from 13th Avenue. Staff Recommendation: Staff recommends denial on the basis as stated above in A. . . . c. Alley "c" #200 Block 9th/l0th Avenues North, Appeal Request: Owner of property at 238 9th Avenue North requests cancellation of assessment by reason that the alley in question is not used by the residents, that garage access is from 9th Avenue. CITY OF HOPKINS Hennepin County, Minnesota NOTICE OF ASSESSMENT HEARING NOTICE IS HEREBY GIVEN that the city Council of Hopkins, Minnesota, will meet in the Council Chambers of the Hopkins city Hall, 1010 1st Street South, Hopkins, Minnesota at 8:00 p.m. on Tuesday, October 5, 1993, to hear all persons concerning the adoption of the assessment roll for Public Improvement Projects 92-11 &, 93-13 and to adopt the assessment roll as presented or amended. This hearing is scheduled pursuant to Minnesota ,statutes Chapter 429. The assessment roll as herein described is on file in the office of the Assessment Clerk. The amount to be assessed is: $19,728.00 Alley "A" Project 92-11 $25,376.19 Alley "B" Project 92-11 $22,216.95 Alley "C" Project 93-13 AREA TO BE ASSESSED: Alley "A" - Between 11th-12th Avenues North of Mainstreet Alley "B" - 200 Block between 12th-13th Avenues North i. Alley "C" - 200 Block between 9th-10th Avenues North All persons who wish to be heard, or to object with reference to this matter may present their cases at this hearing either orally or in writing. No appeal may .be taken as to the amount of any assessment adopted unless a written objection signed by the property owner is filed with the Assessment Clerk prior to the assessment hearing or presented to the presiding officer at the hearing. Even though appeals are due by the hearing date on October 5, 1993, the city Clerk strongly recommends that appeals be submitted to the Assessment Clerk's office by September 27, 1993. Appeal forms will be available at the assessment hearing or at the Assessment Clerk's office at the Hopkins City Hall, 1010 1st Street South, Hopkins, Minnesota. An owner may appeal an assessment to district court pursuant to MSA Section 429.081 by serving notice of the appeal upon the Mayor or City Clerk of the City of Hopkins within thirty (30) days after the adoption of the assessment and by filing such notice with the district court within ten (10) days after service upon the Mayor and City Clerk. The city Council is to adopt the final assessment roll at its October 5, 1993 meeting. Under provisions of Minnesota Statutes Section 435.193 to 435.195 the City may, at its discretion, defer the payment of assessments for any homestead property owned by a person 65 years . of age or older for whom it would be a hardship to make the payments. The procedures for apply for such deferment are available from the Assessment Clerk. Deferment applications should be submitted to the Assessment Clerk by September 27, 1993. >, The following information shall also apply: . 1. The property owner shall have the right to prepay the entire assessment. Your assessment may be paid without interest , from October 5, 1993 to November 4, 1993, to the Assessment Clerk . at City Hall, 1010 1st street South, Hopkins, Minnesota. You may at any time thereafter, pay to the Assessment Clerk the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made by November 29, 1993 or interest will be charged through December 31 of the succeeding year. 2. Partial prepayment of the assessment in excess of 25 percent of the total assessment has been authorized by ordinance. A partial prepayment can only be made prior to November 29, 1993 with interest accrued to the payment date, except that no interest shall be charged if such partial payment is made by November 4, 1993. 3. The rate of interest to be accrued, if the assessment is not prepaid within the required time period, is proposed to be 8 percent commencing on the date of adoption by the, City Council. 4. Such assessment shall be payable over a period of ten years. 5. The amount to be specially assessed against your . property is shown on the statement of assessment sent to you by mail. This is an important hearing because this is your last opportunity to be heard on the matter of this assessment which affects your property. Hennepin county, Minnesota RESOLUTION NO. 93-104 ADOPTION OF THE ASSESSMENT ROLLS PROJECT 92-11 ALLEY A AND B PROJECT 93-13 ALLEY C ALLEY RECONSTRUCTION WHEREAS, pursuant to proper not,ice duly given as required by law, the city Council has met and heard and passed upon all objections to the proposed assessments for alley reconstruction in the #10 Block Ilth/12th Avenues North, #200 Block 12th/13th Avenues North, and #200 Block 9th/10th Avenues North as described in the files of the City Clerk as projects 92-11 and 93-13, and has amended such proposed assessments as it deems just, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HOPKINS, MINNESOTA: 1. Such proposed assessments, as amended, copies of which are attached hereto and made a part hereof, are hereby accepted and shall constitute the special assessment against the. lands named therein, and each tract of land therein included is hereby . found to be benefited by the proposed improvements in the amount of the assessment levied against it. 2. Such assessments shall be payable in equal annual installments extending over a period of 10 years, the first of the installments to be payable on or after the first Monday in January, 1994, and shall bear interest at the rate of 8 percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from October 5, 1993 until December 31, 1994. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. It is hereby declared to be the intention of the Council to reimburse itself in the future for the portion.of the cost of these improvements paid for from municipal funds by levying additional assessments, on notice and hearing as provided for the assessments herein made, upon any properties abutting on the improvements but not made, upon any properties abutting on the improvements but not herein assessed for the improvements, when changed conditions relating to such properties make such assessment feasible. 4.
