V ACA TION OF 14TH AVENUE - THERMOTECH
Proposed Action.
Staff recommends the following motion: Move to approve Resolution 93-123 approving
Ordinance 93-731 vacating the east 1/2 of 14th Avenue for first reading
Mr. Hutchison moved and Mr. Gullickson seconded a motion to approve Resolution RZ93-22
recommending approval of Ordinance 93-731, vacating the east 1/2 of 14th Avenue. The
motion carried unanimously.
Overview.
Thermotech is proposing to construct a 68,000 square foot addition to their building at 1320
5th Street South. In conjunction with this proposed addition Thermotech is also requesting to
vacate the east half of 14th A venue, The west half of 14th is in the process of being vacated
for the abutting property owner, Cliff Lambert. The east half of 14th Avenue is 33 feet wide.
. 14th Avenue is located on the west side of the site and is proposed to be used for parking,
14th Avenue in this location is only 248 feet in length and is vacated to the south to the rail
road right-of-way.
Staff reviewed the applicants request with the Commission, There was little discussion on this
item.

Primary Issues to Consider.
0 Is the right-of-way needed for a public purpose?
14th Avenue in this area abuts most of the west side of the applicants property, South of the
applicant's property, 14th A venue has been vacated. It would be difficult to construct this
roadway at future date because of the previous vacations of 14th Avenue. The City
Engineering Department has reviewed this request and determined that there appears to be no
future need to construct or extend 14th Avenue.
0 Does the right-of-way provide access to the abutting property?
Due to prior vacations, 14th Avenue in only 248 feet in length, 14th Avenue does not provide
access to. the applicants property nor does it provide access to the property to the west or any
other properties. Access to the applicant site and the abutting property. to the west is from 5th
Street.
0 Are there any utilities in the right-of-way?
To the sta:fPs knowledge there are no utilities in the right-of-way, The utility. companies were
. notified of the vacation when Cliff Lambert, the abutting property owner requested a vacation
of 14th A venue, The utility companies did not object to the vacation, Staff is requesting that
if 14th Avenue is vacated, the City retain an easement for utilities in the future. Mr. Lambert
furnished the City with similar easements.
Alternatives.
1. Approve the vacation. With, approval of the vacation Thermotech will be able to
construct their addition as proposed.
2. Deny the vacation. With denial of the vacation Thermotech will not be able to
construct their addition as proposed.
3, Continue for further information. If the City Council indicates that further information
is needed the item should be continued,

5TH STREET SOUTH BLOCK 2, L.P. CREVIER'S FIRST ADDITION, WEST
MINNEAPOLIS
THE COUNCIL OF THE CITY OF HOPKINS DOES HEREBY ORDAIN AS
FOLLOWS:
That the following described thoroughfare in the following designated area of the City of
Hopkins:
That part of the east half of vacated 14th A venue South lying between the extensions westerly of
the north line of Lot 19 and the north line of Lot 24, Block 1, L.P. Creviers First addition to
West Minneapolis:
. be and the same is hereby vacated as a public thoroughfare.

RESOLUTION MAKING FINDINGS OF FACT AND .
APPROVING A VACATION OF THE EAST 1/2 OF 14TH AVENUE
WHEREAS, an application for a vacation VAC93-1 made by
Thermotech, a division of Menasha Corporation,. to vacate the east 1/2
. of 14th Avenue is approved.
WHEREAS, the procedural history of the application is as follows:
1- That an application for a vacation VAC93-1 was filed with
the City of Hopkins on September 24, 1993.
2. That the Hopkins Planning Commission, pursuant to mailed and l
published notices~ held a public hearing on the application
and reviewed such application on October 26, 1993: all
persons present at the hearing were given an opportunity to
be heard.
. 3. That the written comments and analysis of the City staff and
the Planning commission were considered. .
NOW THEREFORE, BE IT RESOLVED that the application for vacation
VAC93-1 is hereby approved based on the following Findings of Fact:
1. That the east 1/2 of 14th Avenue abutting the.
applicant's property is not needed for a public
right-of-way.
BE IT FURTHER RESOLVED, that application for VAC93-1 is hereby
approved based on the following conditions:
1. That the applicant provide utility easements for the vacated
east 1/2 of 14th Avenue.
