Staff recommends the following motion: Move to approve Resolution 93-125 approving as foot side yard variance to construct an addition toa garage. Mr. Day moved and Mr. Gullickson seconded a motion to approve Resolution RZ93-24 approving a 5 foot side yard variance at 510 Sweetbriar., The motion carried unanimously, Overview. The applicant is proposing to construct an addition to the existing garage at 510 Sweetbriar. The proposed addition is 1 0 fe~t wide and ,narrows to 7 feet at the back. The building length is 25 feet. The applicants property is located abutting State Hwy~ 7 and the sound barrier. The applicant's property is located in the R-1-D zoning district. A 10 foot side yard setback is required. The applicant currently has a 10 foot side yard setback and is requesting a 5 foot . variance to facilitate this construction. If the variance is granted, the applicant will have a 5 foot side yard setback. Staff reviewed the applicants request with the Commission. The applicant, Mr. Story, appeared before the Commission. He stated that no one in the neighborhood was opposed to the variance. There was little discussion on the variance. The Zoning Ordinance defines a variance as the following: "a modification or variation from the provisions of this code or variation from its. provisions granted by the board and applying. to a specific parcel of property because of undue hardship. due to circumstances peculiar. and unique to such parcel. " The applicant's situation is different than most other lots in Hopkins. The applicant's property abuts State Hwy, 7 and the sound barrier is located adjacent the side of the property on which he is requesting a variance. The sound barrier is located approximately 30 feet from the applicant's home, but the applicant only has 10 feet to the property line, One of the basic intents of the zoning ordinance as relates to setbacks is to provide adequa~e distance between homes for light, air, privacy, fire protection etc. In this case the applicant does not.have a home on the side .that the variance is being requested and probably never will. Also, the applicant's home is situated on the lot in such a manner that prohibits construction of a detached garage in the rear yard. Both sides of the home are located 10 feet.from the side lot. lines, which would make construction of a driveway to secure access to the rear yard very difficult. 0 Does the applicant have reasonable use of the property? . The applicant in the purest sense does have reasonable use of the property, However, there are really no alternatives available to secure additional garage space without building in the setback area. 0 What is the staff recommendation? Staff is recommending. approval of the variance due to the unique and special circumstances associated with this property and its relationship to Highway 7/sound barrier located on the north side of the. property and that such construction will not violate the intent of the zoning ordinance. Alternatives, 1. Approve the variance. With approval. of the variance, the applicant will be able to construct the proposed addition, 2. Deny the variance, By denying the variance, the applicant will not be able to construct the proposed addition. If this alternative is chosen, the City Council will.have to detail findings of fact to support this decision. . .3. Continue for further information, If the. CITY OF HOPKINS ' , . ~ Hennepin County, Minnesota RESOLUTION NO: 93-125 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A SIDE YARD VARIANCE AT 510 SWEETBRIAR WHEREAS, an application for a variance VN93-6, made by Gerald Story to allow a 5 foot side yard variance to construct an addition to the garage is hereby approved. . . ,WHEREAS, the procedural history of the application is as follows: 1. That an application for a variance VN93-6 was filed with the City of Hopkinson September 20, 1993. . 2. That the Hopkins 'Planning Commission, pursuant to mailed notices, held a meeting on the application and reviewed'such application on October 26, 1993: all persons present were given an opportunity to be heard. 3. That the written comments and analysis of the City staff and .d" the Planning Commission were considered. '- NOW THEREFORE, BE IT RESOLVED that the application for variance VN93-6 is hereby for approved based on the following Findings of Fact: 1. That the applicant has an undue hardship due to the unique and special circumstances associated with this property and its relationship to Highway 7 and the sound barrier located on the north side of the property ~ ' Adopted this 2nd day of November, 1993.
