WAIVER OF PLAT.. 234 18TH A VENUE NORTH
ProDosed Action.
Staff recommends the following motion: Move to approve Resolution 93-137 approving a waiver of
plat at 234 18th Avenue North.
Mr. Winship moved and Mr. Racek seconded a motion to approve Resolution RZ93-26 recommending
approval ofa waiver of plat at 23418th Avenue North. The motion carried unanimously.
Overview,
The applicant currently owns three, fortyfoot lots on 18th Avenue North. There is an existing home on
the middle lot. The applicant is proposing to construct a single family home on the northerly lot and a
zero lot line twin home on the two southerly lots.
The subjec~ site is zoned R-I-A. The minimum allowable side yard setback is eight feet, In order to
maintain the minimum side yard setback for the proposed single family home, the applicant is proposing
to move the southerly lot line four feet further south, By moving the lot line four feet to the south the
proposed home will have the. required eight foot side yard setback and the applicant will be able to
undertake the project as proposed.
It has been the policy of the City that in the case of simple division of properties that meet the zoning -
.
and subdivisions ordinances, the City will waive the plat. Re-platting and a waiver of plat produce the
same results, but a waiver of plat is a less costly and less time consuming procedure.
Staff reviewed the applicant's request with the Commission. The applicant, Phil Hines, appeared before
the Commission, Mr. Hines stated that he plans to construct 3 homes and to sell all of the homes.
Several of the surrounding neighbors appeared before the Commission, The neighbors were concerned
with the homes being rented, snow removal, access to the alley, trees on the site, and the cost of the
homes. It was noted that three homes could be constructed on the lots with or without the waiver of
plat.

Primary Issues to Consider.
. 0 What are the specifics of the applicants request?
The applicant currently owns three, forty foot lots, The applicant is proposing to divide the lots in the
following manner:
0 one 44' x 134' lot (5896 square feet) Exhibit A (single family home)
0 one 37.95' x 134' lot (5085 square feet) Exhibit B (twin home)
0 one 38' x 134' lot (5092 square feet) Exhibit B (twin home)
The applicant is proposing to construct a single family home on the 44 foot lot, and a twin home with a
zero lot line on the two other lots,
The plans for the single family home are included in this report. The proposed home will be a four level,
three bedroom two bath home with a two stall attached garage. The proposed twin home units will be
very similar to the single family home. The applicant may change the plans to add a forth bedroom for
the two units in the twin home, The footprint of the single family home is shown on Exhibit A and the
footprint of the twin home is shown on Exhibit C.
The existing home on the middle lot will be razed after the construction of the home to the north. With
the waiver of plat, the existing home intrudes on the other lots, One requirement of the waiver is that
. the applicant will not get the certificate of occupancy for the single family home, until the existing home
is razed,
0 What are the zoning requirements for the lot?
The subject site in zoned R-1-A. Single and two family homes are allowed in the R-I-A zoning district.
The current requirements for the R-1-A district is a 50 foot lot width and 6000 square feet. However,
because the lot is a lot of record it can have 2/3 of the required lot requirements. The lot can be a
minimum of 33.5 feet in width and 4020 square feet. The applicant is proposing one 44 foot lot, a
37.95 foot lot, and a 38 foot lot. All the lots will be over 5000 square feet The lots will meet the
minimum requirements.
The applicant will meet all the subdivision requirements with the waiver of plat.
Alternatives.
1. Approve the waiver of plat. By approving the waiver of plat, the applicant will be able to
construct the homes as proposed.
2. Deny the waiver of plat. By denying the waiver of the plat, the applicant will have to redesign
the homes as proposed, If the City Council chooses this option, the City Council will have to
. state findings of fact which supports this alternative.
3. Continue for further information. If the City Council indicates that further information is needed
the item should be continued.
