CHARTER AMENDMENTS
Proposed Action
Staff recommends that the Council.approve the following motion: Approve Ordinance #93-732 for.
first readinq.
This action will continue the process of amending the City Charter.
Overview
The Hopkins City Charter was adopted in 1947. It was last updated in 1993. The Hopkins
Charter Commission met on September 28, 1993 and voted to make two changes in the City
Charter.
Ordinance #93-732 was drafted by city staff and distributed to the Charter Commission in October.
. The Commission met again on October 26, 1993. The Commission revised the ordinance and
. voted to recommend the adoption of Ordinance #93-732 by the Hopkins City Council.
The City Council must approve the Ordinance unanimously and may not change any of the
language contained within the Ordinance.

. What changes are being recommended. in the. Charter?
1. Section 3.01 of the Charter is amended by changing the following language to bring the
Charter into conformance with State law: /\11 meetings of the Council shall be public, and
any citizen shall have access to the minutes and records thereof at all reasonable times,
Meetings of the City Council shall be open pursuant to the Minnesota Open Meetinq law.
Minutes and records of open meetings shall be available to any individual duringreqular
business hours.
2. Section 4.01 is amended by. deleting the following language which only pertained to the,
election immediately following the original adoption of the City Charter:
Section 4.01. MUNICIPAL ELECTrONS. Subdivision 1. The regular election for the choice
of the elected officials of the City shall be held on the third Tuesday in May in odd
numbered years. In the event this Charter should be adopted at any timo between April 1 st
of any odd numbered year and' April 1 st of any even numbered year, a special election
shall be held on the third Tuesday in May of such oven numbered year, at whi,ch special
election all of the elected officials provided for by this Charter shall be elected for terms of
one year only. The City Manager shall give notice of all elections in the manner prescribed
. by the laws of Minnesota for cities of the same classification as Hopkins, but failure to give
such notice shall not invalidate such election.
Alternatives
1. Approve Ordinance #93-732 for first reading. This action would continue the process of
amending the City Charter,
2. Return Ordinance #93-732 to the Charter Commission with suggestions for changes, This
action would require at least one more meeting of the Charter Commission where the
Commission could review the Council's suggestions.
3. Vote to not adopt Ordinance #93-732. This would end the process of the amending the
City Charter.
Staff recommends Alternative #1.

AN ORDINANCE AMENDING THE CHARTER OF THE CITY OF HOPKINS
UPON RECOMMENDATION OF THE HOPKINS CHARTER COMMISSION
PURSUANT TO M.S.A. CHAPTER 410.12, SUBD. 7
The City Council of the City of Hopkins, upon recommendation of
and from the Hopkins City Charter Commission does hereby ordain
and thus amend and adopt the following changes, deletions, and
amendments of or from the following chapters and sections of the
Hopkins City Charter:
Section 1. Section 3.01 is amended as follows:
Section 3.01. COUNCIL MEETINGS. The Council shall meet at such
time as may be prescribed by ordinance or resolution, except that
they shall meet not less than once each month. The Mayor or any
two members of the Council may call a special meeting. The rules
for calling a special meeting; as set out in the Laws of the state
of Minnesota, shall bef6l1owed. 1\11. meeting:J of the Council
:Jhall be pUblic, and any citizen :Jhall have acce:J:J to the minuteo
and record:J thereof at all rCQ:Jonable time:J. Meetings of the City
