Public Hearing - Special Assessments
Prooosed Action.
Staff recommends the following motion: Move that Council
continue the oublic hearinq concerninq 1992 miscellaneous
soecialassessments to October 6, 1992. at which time it will
consider adootion of Resolution 92-77, Resolution for Adootion
of 1992 Miscellaneous Assessment Roll.
Overview.
The proposed special assessments. as described in Exhibit A are
for unpaid utility bills, delinquent invoices, parking ramp
maintenance and small improveme~t projects. All of these are
charges that can become a lien on the properties involved.
Notices of this public hearing and statements of assessment have
been mailed to all affected property owners.
Primary Issues to Consider.
· What are the details concerning the assessments?
Refer to attached Exhibit A.
. · Do residents have right to appeal?
, . Residents are given the opportunity to approach Council with
their appeals during the public hearing. Standard appeal
forms were available at City Hall and need to be submitted no
later than~the evening of the hearing. To this date, one
appeal has been submitted. staff anticipates other appeals
that may require some research before final recommendations
are made to the Council. That is the basis for staff's
recommendation that this hearing .be continued to October 6
when final action on the roll will be taken. If owners have
not received satisfaction in this manner they may still
appeal an assessment to district court pursuant to MSA
Section 429.081 within 30 days after adoption of the
assessment.

NOTICE IS HEREBY"GIVEN that the City council of
Hopkins, Minnesota, will meet in the Council Chambers of the
Hopkins City Hall, ,,1010 1st Street South, Hopkins Minnesota
at 8:00 p.m. on Tuesday, September 15, 1992, to pass upon
the proposed special assessments of costs of certain
improvements in the CitY~of HOpkins, for the costs of false
fire"alarms, for the costs of delinquent bills and invoices
(utility, storm sewer, No Trespassing sign, diseased tree
removal, and for the costs of maintenance of a parking
ramp), all more particularly described in Exhibit A hereto
attached and hereby made a part hereof.
All persons who wish to be heard, or to object with
reference to this matter may present their, cases at this
hearing, either orally orin writing. No appeal may be ,
. taken as to the amount of any assessment adopted unless "a
. written objection signed by the property owner is filed"with
the Assessment Clerk prior to the assessment hearing or
presented to the presiding officer at the hearing. Even
though appeals are due by the hearing date on September 15
1992, the City Clerk strongly recommends that appeals be
submitted to the Assessment Clerk's office by September,8,
1992. Appeal forms will be available at the assessment" "
hearing or at the Assessment Clerk's'office at the Hopkins
City Hall, 1010 1st Street South, Hopkins, Minnesota. "
An owner may appeal an assessment to district court
pursuant to MSA Section 429.081 by serving notice of the
appeal upon the Mayor or City Clerk of the City of Hopkins
within thirty (30) days "after the adoption of the assessment'
and by filing such notice with the district court within
ten (10) days after service Upon the Mayor and City Clerk.

Under" provisions of Minnesota Statutes Section 435.193
to 435.195 the City may" at its discretion, defer the
payment of assessments for any homestead.property owned by a
person 65 years of age'or older for whom it would be a.
hardship to make the payments. The procedures for applying
for such deferment are available from the Assessment Clerk.
Deferment applications should be submitted to the Assessment
Clerk by September 8, 1992.

. 1. The property owner shall have the right to prepay
the entire assessment. Yo'ur assessment may be paid without
interest from October 6, 1992 to November 9, 1992, to the
Assessment Clerk at City Hall, 1010 1st street South,
Hopkins, Minnesota. You may at any time thereafter, pay to
the Assessment Clerk the entire amount of the assessment
remaining unpaid, with interest accrued to December 31 of
the year in. which such payment is made. Such payment must
be made by November.27, 1992 or interest will be charged
through December 31 of the succeeding year. .
.2. Partial prepayment of the assessment in excess oe
25 percent of the total assessment has. been ,authorized by
ordinance. If partial prepayment is used, then payment must
be paid within 30 days following the adoption of the
assessment roll~
In the case where accrued interest applies,
interest to be a'ccrued., if the assessment. is
wi thin' the required time period, is' 'proposed to
,percent commencing on the date of adoption by the City.

WHEREAS, pursuant to proper notice published and given as
required by law, the City Council of the City of Hopkins has
met and heard on Tuesday, October 6, 1992, and passed upon.
all objections to the proposed assessments.for.miscellaneous
projects, delinquent utility bills and delinquent invoices,
all as more fully set forth and described in Exhibit A
attached to Resolution No. 92-68 adopted.the 18th day of
. August, 1992, and
NOW THEREFORE BE IT RESOLVED
. Hopkins as follows:
1. Such proposed assessments,
2~ Such assessments shall be payable in equal, annual
installemtns extending over the periods of years set forth
in Exhibit A, the first of the installments to be paid with
the real estate taxes due and payable in 1993. Any deferred
installments shall bear interst at the rate as set forth in
said Exhibit A from November 1, 1992. To the first
installments shall be added interest on the entire
respective assessment from November 1, 1992 until December
31, 1993. To each Subsequent installments, when due shall
be added interest for one year on all unpaid installments.
3. The owner of any. property so assessed may at anytime after
the adoption of the assessments and by November 27, pay the
whole of the assessments against any parcel to the City
Manager, and no inter~st shall be charged if the entire
t assessment is paid by November 9. Also, the owner of the
property may at anytime thereafter, except between November

.the entire amount of the assessment remaining unpaid.
