Staff recommends the following motion: Move that Council continue the oublic hearinq concerninq 1992 miscellaneous soecialassessments to October 6, 1992. at which time it will consider adootion of Resolution 92-77, Resolution for Adootion of 1992 Miscellaneous Assessment Roll. Overview. The proposed special assessments. as described in Exhibit A are for unpaid utility bills, delinquent invoices, parking ramp maintenance and small improveme~t projects. All of these are charges that can become a lien on the properties involved. Notices of this public hearing and statements of assessment have been mailed to all affected property owners. Primary Issues to Consider. · What are the details concerning the assessments? Refer to attached Exhibit A. . · Do residents have right to appeal? , . Residents are given the opportunity to approach Council with their appeals during the public hearing. Standard appeal forms were available at City Hall and need to be submitted no later than~the evening of the hearing. To this date, one appeal has been submitted. staff anticipates other appeals that may require some research before final recommendations are made to the Council. That is the basis for staff's recommendation that this hearing .be continued to October 6 when final action on the roll will be taken. If owners have not received satisfaction in this manner they may still appeal an assessment to district court pursuant to MSA Section 429.081 within 30 days after adoption of the assessment. NOTICE IS HEREBY"GIVEN that the City council of Hopkins, Minnesota, will meet in the Council Chambers of the Hopkins City Hall, ,,1010 1st Street South, Hopkins Minnesota at 8:00 p.m. on Tuesday, September 15, 1992, to pass upon the proposed special assessments of costs of certain improvements in the CitY~of HOpkins, for the costs of false fire"alarms, for the costs of delinquent bills and invoices (utility, storm sewer, No Trespassing sign, diseased tree removal, and for the costs of maintenance of a parking ramp), all more particularly described in Exhibit A hereto attached and hereby made a part hereof. All persons who wish to be heard, or to object with reference to this matter may present their, cases at this hearing, either orally orin writing. No appeal may be , . taken as to the amount of any assessment adopted unless "a . written objection signed by the property owner is filed"with the Assessment Clerk prior to the assessment hearing or presented to the presiding officer at the hearing. Even though appeals are due by the hearing date on September 15 1992, the City Clerk strongly recommends that appeals be submitted to the Assessment Clerk's office by September,8, 1992. The property owner shall have the right to prepay the entire assessment. ' , WHEREAS, pursuant to proper notice published and given as required by law, the City Council of the City of Hopkins has met and heard on Tuesday, October 6, 1992, and passed upon. all objections to the proposed assessments.for.miscellaneous projects, delinquent utility bills and delinquent invoices, all as more fully set forth and described in Exhibit A attached to Resolution No. 92-68 adopted.the 18th day of . August, 1992, and NOW THEREFORE BE IT RESOLVED . Hopkins as follows: 1. Such proposed assessments, 2~ Such assessments shall be payable in equal, annual installemtns extending over the periods of years set forth in Exhibit A, the first of the installments to be paid with the real estate taxes due and payable in 1993. Any deferred installments shall bear interst at the rate as set forth in said Exhibit A from November 1, 1992.
