CONDITIONAL USE PERMIT - CELLULAR ONE OF MINNESOTA
Proposed Action.
staff recommends the following motion: Move to ap-prove
Resolution R9,2-1 approving a conditional use permit for a
commercial transmission tower at 215 Excelsior Avenue East.
The Commission unanimously approved Resolution RZ91-26
recommending approval of locating a commercial transmission
tower at 215 Excelsior Avenue East.

The proposed site for the new tower is on the west part of
the old Red Owl site abutting Highway 169. The tower will
be a 75' high self-supporting monopole. Also on the site
will be a 12' x 38' building. This building will have an
exterior of exposed aggregate.
Commercial transmission towers are allowed in industrial
districts with a conditional use permit. The proposed site
is located in an 1-2 zoning district.
Warren Dunlap representing Cellular One appeared before the
Commission. Mr. Dunlap explained the need for a tower in
the area. The Commission was concerned with the landscaping
near the base of the tower. The Commission decided that ivy
and 5 evergreens would screen the base sufficiently.

Primary Issues to Consider.
o What type of tower will be constructed?
The tower will be a self-supporting monopole with panel type
antennas placed on top of the pole. The monopole will look
similar to the light pole along the highway.
o Does the proposed tower meet the conditions of the
commercial tower ordinance?
Attached to the report are the conditions for a commercial
transmission tower.

The tower will be located 15 feet lower than Highway 169.
Between the tower and 169 is a grassy area with trees. The
applicant will be constructing a 2 foot timber wall at the
base of the tower to blend in with the existing topography
and vegetation.
The applicant did state they would be willing to do more
landscaping. staff is recommending that landscaping is
added in the area of the tower base to screen the base of
the tower. The applicant did submit 3 landscape plans. The
Commission recommended ivy and evergreens to screen the area
around the base of the tower.
Alternatives.
1. Approve the conditional use permit to allow a
commercial transmission tower. By approving, the
applicant will be able to construct a commercial
transmission tower.
2. Deny the conditional use permit to allow a commercial
transmission tower. By denying the conditional use
permit, the applicant will not be able to construct the
commercial transmission tower
3. Continue for further information. If the City Council
indicates that further information is needed, the item
should be continued.

WHEREAS, the procedural history of the application is as
follows:
1. That an application for a conditional use
permit CUP 91-8 was filed with the City of
Hopkins on November 12, 1991.
2. That the conditional use permit for a
commercial transmission tower is located on
the following described property:
Tracts A, Band C, RLS No. 1465 and SEly 20 ft of
Lots 5, 6 and 7, Blk 12, West Minneapolis Center,
Also Lots 16 thru 26, incl, Block 4, last said
addition and that part of Lots 14 and 5, said
Block 4 lying west of East 16 feet thereof, also
Block 13, including adjacent 1/2 of streets and
alleys vacated except street and that part of Lots
1, 2 and 3, Block 9, West Minneapolis Center and
that part of former r/w of Burlington Northern
R.R. and that part of vacated Adams Avenue and
First street North all described as beginning at
the intersection of Westerly line of Tract A, RLS
No. 1465 with south line of North 180 feet of
Northwest Quarter of Southwest Quarter of section
19, Township 117, Range 21 thence South 89 degrees
35 min. 39 sec. West along ssaid South line a
distance of 97.29 feet, thence South 20 deg. 22
min. 42 sec. West distance 153.29 feet thence
Southerly 410.71 feet along a tangential curve
concave to East radius of 914.93 feet, thence

3. That the Hopkins Planning Commission reviewed
such application on December 30, 1991.
4. That the Hopkins Planning Commission,
pursuant to published and mailed notice, held
a public hearing on December 30, 1991: all
persons present at the hearing were given an
opportunity to be heard.
5. That the written comments and analysis of the
City staff and the Planning Commission were
considered.
NOW THEREFORE BE IT RESOLVED, that application for CUP 91-8
is hereby approved subject to the following
Findings of Fact:
1. That a commercial transmission tower is permitted
with a conditional use permit in the industrial
districts.
2. That the proposed tower meets the requirements for
a commercial transmission tower as outlined in the
zoning ordinance.
BE IT FURTHER RESOLVED, that application for CUP 91-8 is
hereby approved subject to the following
Conditions:
1. That a landscaping of ivy is planted to screen the
fence and 5 evergreens, with the size to be
approved by staff, are planted on the south and
southwest corner of the tower base.
2. That all conditional use requirements pertaining
to commercial transmission towers, as outlined in
the Zoning Ordinance, are adhered to.

560.01. Additional requirements. subdivision 1. Heiqht. Height limitations as set
fOl:t.h in all zoning districts may be increased by 50% when applied to the following:
a) antennas in residential districts (Amended Ord.91-672)
b) belfries
c) church spire and steeples
d) cooling towers
e) elevator penthouse
t) flag poles
g) smoke stacks
h) water towers
Subd. 2. Excess. Heights in excess thereof for such purposes may be permitted
only by a conditional use permit. (Amended Ord. 91-672)
it,,-,--jEO. 02. Transmission Tower - Commercial. Conunercial transmission towers shall be
~permitted with a conditional use permit in the industrial districts subject to the
fallowing conditions:
a) commercial transmission towers shall be in compliance with all city
building and electrical code requirements;
b) verification that the structural design has been approved by a
professional engineer;
c) verification that the mounting system and installation have been
approved by a professional engineer;
d) submission of written authorization from the property owner;
e) no advertising message shall be on the tower structure;
f) shall comply with setback requirements for principal structures and
in no event shall be located between the principal structure and the front lot
line;
g) transmission towers that are not self-supporting shall be supported
by objects within the property lines but not in any front-yard areas;
...
h) the base of transmission towers, including guy wires, supporting and
accessory structures shall be screened to the greatest extent practicable to
minimize visual impacts on surrounding properties. Screening shall include
landscape materials or architectural features that harmonize with the elements
and characteristics of the property for ground mounted towers and materials
compatible with those utilized. on the exterior of the building for roof mounted
antennas;

i) towers located closer to a property line than the height of the
tower shall be designed and engineered to collapse progressively within the
distance between the tower and the property line except if there.is a use that
the City Council indicates will not be affected by a tower collapse; (Le.
railroad right-of-way, lake, creek, unbuildable land);
j) tower shall be in compliance with
communications commission (FCC) requirements;
all

k) towers shall be in compliance with all applicable federal aviation
administration (FAA) requirements;

towers shall require security fencing of 10 feet in height around

until the existing transmission tower is fully utilized;
q) that one commercial transmission tower is allowed per site;
r) that the maximum height of a commercial transmission tower is 75

560.03. Antennas. Antennas used for a commercial use may be attached to existing
structures in residential, business and industrial districts providing no antenna is
20 ,~eet taller than the existing structure. Only two antennas may be allowed on an
existing structure. (Ord. 91-672)
560.04. Front yard variance. In any R district, wherever a platted block or
otherwise subdivided area has dwellings located on 50% or more of the parcels located
between two streets, the front yard set-back line may be reduced below the minimum
which would be therein required, but shall in no case be less than either the average
front set-back lines already established by the dwellings located in such block or
area or 15 feet which ever is greater.
560.05. Frontaqe. No residence shall hereafter be erected upon any lot unless such
lots abut upon a street for at least 20 feet unless located within an approved P.U.D.
or C.U.P.
560.07. Farminq operations. All farms in existence on August 11, 1966 may continue
operation subject to the following conditions:

a) Agriculture, except commercial animal farms, fur farms, kennels and
poultry farms, but including truck gardening and other horticultural uses is a
permitted use in any district in which such existing operation is located.
b) Sale of products produced may be conducted on the premises from a
roadside stand, which stand may be located within the front yard during harvest
season only.
