CR 92-36 Tax Forfeiture Property January 28, 1992 council Report 92-36 TAX FORFEITURE PROPERTY Proposed Action. staff recommends adoption of the following motion: Approve Resolution No. 92-14 "Releasing Tax Forfeiture Property and Recommendinq Private Sale bY County to Adjacent Property Owners and for Public Auction." ' overview. The County has notified the City of two pieces of property which are available for acquisition by the City because of tax forfeiture. One of these properties, PID# 19-117-21-22- 007 would not be useful to the City because it is an irregular shaped lot and unbuildable as it does not meet the minimum lot size for the zoning district in which it is located. Staff recommends that the City release this property so it can be sold to adjacent property owners. The second parcel, PID# 25-117-22-0684 would not be useful to the City because it is a garage unit for Westbrooke Park Condominiums. Staff recommends the City release this property so it can be sold at public auction. Primary Issues to Consider. o Should the City release the property? (~9-~~7-2~ 22 0007) This parcel is excess right-of-way land from the Highway #~69 construction. It is a small triangular parcel of approximately 4,000 square feet and was purchased along with 109 E. Wayside Road from Hennepin County in 1986. It is zoned R-1-D, single family low density. Due to it's unbuildable state (minimum 20,000 square feet) I would recommend approval for sale to adjacent property owners. (25-~~7-22 3~ 0684) This parcel is a garage unit for Westbrooke Park Condominiums. It is an inside unit west of 9th Avenue South and North of Westbrooke Way. I would recommend approving this parcel for public auction. There are no levied or pending assessments on either parcel and to the best of my knowledge there are no existing wells. I have attached maps, a draft of the resolution and a copy of the cover letter that is sent to Gordy Ramm at Hennepin County with a certified copy of the resolution. RESOLUTION RELEASING TAX FORFEITURE PROPERTY AND RECOMMENDING PRIVATE SALE BY COUNTY TO ADJACENT PROPERTY OWNERS AND FOR PUBLIC AUCTION WHEREAS, Hennepin County has notified the City of Hopkins of certain real estate described under PID Nos. 19-117-21 22 0007 and 25-117-22 31 0684 which are located within the city and which have been forfeited to the State of Minnesota for non-payment of real estate property taxes; and WHEREAS, the City has determined that the parcels described would be of no benefit to the city for public purposes; and WHEREAS, the parcels have been determined to be non- conservation land as provided for in Minnesota Statutes 282.01, WHEREAS, the parcels comply with the prov1s10ns of Minnesota Statutes 85.012, 92.461, 282.01, Subd. 8 and 282.018, and other statutes that require the withholding of tax forfeited land from sale, WHEREAS, PID No. 19-117-21 22 0007 is approximately 4,000 square feet which does not meet the required 20,000 minimum buildable lot size, NOW, THEREFORE, BE IT RESOLVED by the city Council of the City of Hopkins: That the city hereby releases that certain parcel from Hennepin County described under PID No. 19-117-21 22 0007, and That the City hereby recommends that the parcel be made available for private sale by the County to adjacent property owners. That the city hereby releases that certain parcel from Hennepin County described under PID No. 25-117-22 31 0684 and, That the city hereby recommends that the parcel be made available for public auction.
