Memo Special Assessments Fire Protection Systems I, . CITY OF HOPKINS MEMORANDUM DATE: March 31, 1992 TO: Honorable Mayor and City Council FROM: Jim Gessele, Engineering Superintendent SUBJECT: Public Hearing - Special Assessments Mainstreet Service utilities, Fire Protection Systems, Private Improvements 5th to 11th Avenues At Council's March 17 session a public hearing convened concerning special assessments for service utilities and private improvements in conjunction with Mainstreet reconstruction. Upon staff's recommendation Council continued the hearing to April 7 to allow ample time for staff to examine any appeals of serious nature. The following appeal has been received and a brief summary with staff's recommendation is outlined. Appeal Request: Owner of property at 919 Mainstreet requests cancellation of assessment for a sanitary sewer service by reason that the property is served by an existing operative system and the new sanitary stub provides no real benefit to the property. Staff Recommendation: Staff recommends Council cancel this particular assessment due to the city's oversight in not discovering the existing sanitary service at a time when the city's consultant was making an inventory of all utility services on Mainstreet and their condition. Subsequent televising of the existing service reveals the service to be in good repair with no loose joints. Two independent contractors have attested to the service condition. Council should be aware that if in the future the property owner deems it prudent to connect to the new service stub, he will by virtue of section 705 of the city Ordinance need to pay a fee equal to the cost of the service plus interest from the date of construction to the date of connection permit issuance. (See attachment) Council in its motion to cancel the assessment should reaffirm the authority of section 705 of the City Ordinance. Attachment JG/rr \ . Donald Perkl. His appeal is based upon the fact that his building is already served by a sanitary line, so a new stub wasnot necessary and the one installed is of no benefit. Our firm first became aware of a potential problem with this building during our property owner meetings in the Spring of 1991. At that time, Paul Moseby of Preferred Travel informed us that he shared a sanitary sewer connector with both Berry Towne Variety and Tax Man, Inc. He felt that this was a potential maintenance hazard, and asked us to look into this. Subsequent testing of lateral connectors by Midwest Underground confirmed Me. Moseby's information. Dye was flushed down the toilets in both the Tax Man (923 Mainstreet) and Berry Towne Variety (917 Mainstreet). Both of these tests revealed that the three services ran into one wye connection. Mr. Moseby was informed of these results, as were Me. Perkl and the owners of 923 Mainstreet. Mr. Moseby indicated that he was going to attempt to secure an easement with both parties. This issue was not raised again until sewer repair work began between 9th and 10th Avenues. At timr rime, RLK Associates s;Joi.:~ with Mr. Moseby, who indicated he had not obcainoo an easement. He was still very concerned and wanted the other two properties to have their own sanitary service. At this point, RLK Associates brought this problem to the City staff. After much discussion, we were instructed to stub out new services to 917 Mainstreet and 923 Mainstreet. Both property owners were notified by telephone of this decision and the work was completed. The first indication of a problem with the assessment on these hires was raised in early February. Donald Perkl called our office and said that Root-A-Matic had discovered a separate sewer line from a toilet in the basement of 917 Mainstreet. Midwest Underground was . summoned to retest the building. The tests revealed that, although the upstairs toilet does indeed share sewer line with 921 Mainstreet, the toilet downstairs runs straight out to Mainstreet. · Civil Engineering · Transportation · Infrastructure Redevelopment · Landscape Architecture · Construction. Management -2- With all of this before us, it is our recommendation thatthe assessment for sanitary service for Mr. PerId be deferred until such time as he might use this new sanitary stub. Section 70S - Sanitary sewer system 705.01. Tap; license required. No person may tap or make any perforation or opening of any kind in a sanitary sewer pipe, or make connection to a sanitary sewer main or building sewer in the city, without first having obtained the licenses and permits and paid the fees required by this code. 705.03. Sewer connection. Subdivision 1. Permit . No public sewer in any right-of-way shall be tapped or connection made thereto from any lot, piece or parcel of land without first securing a written permit to do so from the building official upon proper written application therefor. Subd. 2. Application for permit. Applications shall be made upon forms to be provided therefor by the city and require the follo~ing information: (a) exact legal description of premises for which sewer connection is applied, including plat and parcel number; (b) address of premises; (c) name and address of plumber or other contractor; (d) name and address of owner of premises; (e) date of opening and installation of connection; (f) general description of type and me thod of connection to be used or made; and (g) such other pertinent information as the building of ticial may require. Subd. 3. Fees: charges. The following fees and charges shall accompany the application: (a) the fees set by chapter X; (b) if, for the parcel described in such application, the city has not been reimbursed or otherwise secured for said parcel's proportionate beneficial share of the special benefit and total cost of the construction and installation of the public sewers within the project district or area in or from which the parcel is to be served, the applicant shall pay an additional sure equal to that proportionate share of such special benefit and cost which said parcel bears to such entire area or district and which was specially assessed or charged for said public improvement, plus interest on said sum at the rate of seven percent per annum from the date or dates of the original construction or installation of such public improvements to the date of the issuance of the connection permits. CITY OF HOPKINS Hennepin County, Minnesota NOTICE OF ASSESSMENT HEARING Amended Date NOTICE IS HEREBY GIVEN that the City Council of Hopkins, Minnesota, will meet in the Council Chambers of the Hopkins City Hall, 1010 1st Street South, Hopkins, Minnesota at 7:30 p.m. on Tuesday, March 17, 1992, to hear all persons concerning the adoption of the assessment roll for Public Improvement project 90-04B and to adopt the assessment roll as presented or amended. This hearing is scheduled pursuant to Minnesota Statutes Chapter 429. The assessment roll as herein described is on file in the office of the Assessment Clerk. The total amount to be assessed is $128,935.43. AREA TO BE ASSESSED: Mainstreet from 5th Avenue to 11th Avenue - Water and Sanitary Sewer Services, Fire Protection Systems, Other certain Private Improvements All persons who wish to be heard, or to object with reference to this matter may present their cases at this qearing, either orally or in writing. No appeal may be taken as to the amount of any assessment adopted unless a written objection signed by the property owner is filed with the Assessment Clerk prior to the assessment hearing or presented to the presiding officer at the hearing. Even though appeals are due by the hearing date on March 17, 1992, the Assessment Clerk strongly recommends that appeals be submitted to her office by March 9, 1992. Appeal forms will be available at the assessment hearing or at the Assessment Clerk's office at the Hopkins City Hall, 1010 1st Street South, Hopkins, Minnesota. An owner may appeal an assessment to district court pursuant to MSA Section 429.081 by serving notice of the appeal upon the Mayor or City Clerk of the city of Hopkins within thirty (30) days after the adoption of the assessment roll and by filing such notice with the district court within ten (10) days after service upon the Mayor and City Clerk. The City Council is to adopt the final assessment roll at its April 7, 1992 meeting. Under provisions of Minnesota Statutes Section 435.193 to 435.195 the city may, at its discretion, defer the payment of assessments for any homestead property owned by a person 65 years of age or older for whom it would be a hardship to make the payments. The procedures for applying for such deferment are available from the Assessment Clerk. Deferment applications should be submitted to the Assessment Clerk by March 9, 1992. . The following information shall also apply: 1. The property owne~ shall have the right to prepay the entire assessment. Your assessment may be paid without interest from April 7, 1992 to May 7, 1992, to the Clerk at City Hall, 1010 1st street South, Hopkins, Minnesota. You may at any time thereafter, pay to the Clerk the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the succeeding year. 2. Partial prepayment of the assessment in excess of 25 percent of the total assessment has been authorized by ordinance, and can be paid within 30 days following the adoption of the assessment roll (April 7, 1992 to May 7, 1992) . 3. The rate of interest to be accrued, if the assessment is not prepaid within the required time period, is proposed to be 8 percent commencing on the date of adoption by the City Council. 4. Such assessment shall be payable over a period of fifteen years. 5. The amount to be specially assessed against your property is shown on the statement of assessment sent to you by mail. This is an important hearing because this is your last opportunity to be heard on the matter of this assessment which affects your property. CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO. 92-30 ADOPTION OF THE ASSESSMENT ROLL PROJECT 90-04B MAIN STREET SERVICE UTILITIES AND PRIVATE IMPROVEMENTS WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the proposed assessment for the construction of water and sanitary sewer services, fire protection systems, and other certain private improvements, as described in the files of the city Clerk as project 90- 04B, Mainstreet, and has amended such proposed assessment as it deems just, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HOPKINS, MINNESOTA: 1. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of 15 years, the first of the installments to be payable on or after the first Monday in January, 1993, and shall bear interest at the rate of 8 percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from April 7, 1992 until December 31, 1993. To each subsequent installment when due shall be added interest from one year on all unpaid installments. 3. It is hereby declared to be the intention of the Council to reimburse itself in the future for the portion of the cost of this improvement paid for from municipal funds by levying additional assessments, on notice and hearing as provided for the assessments herein made, upon any properties abutting on the improvement but not made, upon any properties abutting on the improvement but not made, upon any properties abutting on the improvement but not herein assessed for the improvement, when changed conditions relating to such properties make such assessment feasible. 4. To the extent that this improvement benefits '""'"" nonabutting properties which may be served by the improvement when one or more later extensions or improvements are made, but which are not herein assessed, therefore, it is hereby declared to be the intention of the Council, as authorized by Minnesota statutes Section 420.051, to reimburse the city by adding any portion of the cost so paid to the assessments levied for any of such later extension or improvements. 5. The clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of the county, and such assessments shall be collected and paid over in the same manner as other municipal taxes.
