Proposed Action.
Staff recommends the following motion "Move that Council adopt
Resolution 92 -31, Resolution for Adoption of Assessment Roll -
Knollwood Street Improvements, Project 90 -01 ".
This action sets in motion special assessments to be levied against
the properties involved in the attached exhibits.
Overview.
Council at its March 17 meeting, considered the assessment roll for
this project, and set a public hearing date for April 7. The Council
at the April 7 meeting opened the public hearing and continued, it
until April 21 due to the assessment roll needing to be revised, and
an odd appeal that needed to be investigated. Council did approve a
senior citizen deferment appeal for the property owner at 208 Wilshire
Walk at the April 7 meeting.
Notices of this public hearing continuation have been mailed out to
all affected property owners.

Residents /owners are given the opportunity to approach the
Council with their appeals during the public hearing. Standards
appeal forms are available at City Hall and need to be submitted
no later than this hearing date. Staff will be prepared to make
recommendations on any appeals that have been submitted prior to
the hearing date.

that was presented to Council on March 17?
The assessment roll that was presented to Council on March 17
included assessing out all past engineering fees paid to TKDA.
RLK gave the city credit for half of these fees, $25,000,
inasmuch as it was information that they could use and did not
need to duplicate. The other $25,000, or non - usable portion of
the fees paid to TKDA was also proposed to be assessed out in
accordance with the funding schedules. This amounted ;to $10,500
being assessed out to the property owner, and the remaining
$14,500 being funded by the city.
Staff has subsequently researched the engineering fee issue, and
is now recommending not to assess out the non - useable portion of
past engineering fees to the property owners. The reason for a
recommendation change is that it would be hard to prove benefit
to each property for engineering fees that do not improve the
value of property.
Other changes to the assessment roll include splitting out the
mobilization and traffic control charges for the project amongst
the utility funds. Previously, these charges were only in the
street portion of the project, and the utility funds were not
being charged their fair share of these costs.
The last item that was changed on the assessment roll was adding
cost to change, and add street lighting in this area. The
neighborhood submitted their request for lighting after the first
assessment roll was prepared, and we now need to modify the roll
to reflect adding these costs.

construction to begin within a few days.

ADOPTION OF THE ASSESSMENT ROLL
PROJECT 90 -01
KNOLLWOOD STREET IMPROVEMENTS
WHEREAS, pursuant to proper notice duly given as
required by law, the City Council has met and heard and
passed upon all objections to the proposed assessment for
the construction of streets and concrete curb and gutter on
Cottage Downs, Park Terrace, Bridle Lane, Valley Way,
Wilshire Walk, Edgemoor Drive and Alleyway, as described in
the files of the City Clerk as Project 90 -01, and has
amended such proposed assessment as it deems just,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
HOPKINS, MINNESOTA:
1. Such proposed assessment, as amended, a copy of
which is attached hereto and made a part hereof, is hereby
accepted and shall constitute the special assessment against
the lands named therein, and each tract of land therein
included is hereby found to be benefited by the proposed
improvement in the amount of the assessment levied against
it.
2. Such assessment shall be payable in equal annual
installments extending over a period of 20 years, the first
of the installments to be payable on or after the first
Monday in January, 1993, and shall bear interest at the rate
of 8 percent per annum from the date of the adoption of this
assessment resolution. To the first installment shall be
added interest on the entire assessment from April 21, 1992
until December 31, 1993. To each subsequent installment
when due shall be added interest from one year on all unpaid
installments.
3. It is hereby declared to be the intention of the
Council to reimburse itself in the future for the portion of
the cost of this improvement paid for from municipal funds
by levying additional assessments, on notice and hearing as
provided for the assessments herein made, upon any
properties abutting on the improvement but not made, upon
any properties abutting on the improvement but not made,
upon any properties abutting on the improvement but not
herein assessed for the improvement, when changed conditions
relating to such properties make such assessment feasible.

4. To the extent that this improvement benefits
nonabutting properties which may be served by the
improvement when one or more later extensions or
improvements are made, but which are not herein assessed,
therefore, it is hereby declared to be the intention of the
Council, as authorized by Minnesota Statutes Section
420.051, to reimburse the City by adding any portion of the
cost so paid to the assessments levied for any of such later
extension or improvements.
5. The clerk shall forthwith transmit a certified
duplicate of this assessment to the County Auditor to be
extended on the property tax lists of the County, and such
assessments shall be collected and paid over in the same
manner as other municipal taxes.
Adopted by the City Council of the City of Hopkins this 21st
day of April, 1992.
