WAIVER OF PLAT - RAMSGATE
proposed Aotion.
Staff recommends the following motion: Move, to approve
Resolution 92-75approvina a waiver of plat/reaistered land
surveY to di vide the property at 'the corner of Hiawatha
Avenue and Cambridge street.
Mr. Day moved and Mr. Gullickson seconded a motion to
approve Resolution RZ92-21 recommending approval of a waiver
of plat for the property at the corner of Hiawatha and
cambridge street. The motion carried unanimouSly.
overview.
The subject property is a vacant strip of land located along
Hiawatha Avenue and was owned by Mark Jones. This property
is the site where the proposed townhome project was to be
constructed. The property is now owned by the City.
The City was qnly going to purchase Tract B as shown on the
attached survey, but because of .a time constraint concerning
the payment of property taxes, the City purchased the
, property made up of Tract A and B with the--condi tion that
. the west 37 feet (Tract A) would be di videdand combined
, , wi th the Ramsgate property. Tract A is currently used by
Ramsgate for parking and snow storage.
Track C is right-of-way arid will continue to be used for
right-of-way purposes.
staff reviewed the proposed waiver. Irene Ibson appeared
before the Commission. Ms. Ibson was concerned with three
trees that may be removed. The City Attorney and staff were
not aware of any trees to be removed. There was Ii ttle
discussion on this matter.

primary Issues to Consider.
o What is the zoning of the property?
The subj ect property is zoned R-2,. Low Density Multiple
Family. 2 family dwellings, 2;"'4 family dwellings and
Townhomes are permitted uses.
o Does Traot B meet the minimum requirements for a lot in
the R-2 distriot?
The R-2 district requires a minimum lot size of 12,000
square feet and a minimum width of 100 feet. Tract B will
have a width of 66.94 feet and over 40,000 square feet.
However, this land is ~wned by the City and is intended to
be used for passive park purposes.
o What is the proposed use for Traot A?
Tract A will continue to be used or parking and snow
storage purposes. Tract A also does not meet the minimum
lot size requirements. As a result, the city should require
. that this be combined with the Ramsgate property to the
west.

o Why is a wavier of the plat being proposed?
A waiver of the plat is being proposed because it is less
expensive and easier than doing a formal plat. It has been
the past practice of the city to do a waiver of the plat if
the division of property ,involves a simple split.
Alternatives.
.
1. Approval the waiver of plat. By approving the waiver of
plat, the applicant will be able to divide the
property.
2. Deny the waiver of plat. By denying the waiver of plat
the applicant will not be able to divide the property.
3. continue for further information. If the City Council
indicates that further information is needed, the item
should be continued.

RESOLUTION NO: R92-75
RESOLUTION MAKING FINDINGS OF FACT AND
APPROVING AN APPLICATION FOR A WAIVER OF PLAT
WHEREAS, an application for a waiver of plat entitled WVR 92-3 made by
City of Hopkins is approved.
WHEREAS, the procedural history of the application is as follows:
1. That an application for a waiver of plat WVR 92-3 was
filed with the City of Hopkins on July 24, 1992.
2. That the Hopkins Planning Commission reviewed such
application on August 25, 1992~
3. That the Hopkins Planning commission, pursuant to
mailed notice, held a hearing on August 25, 1992: all
persons present at the hearing were given an
opportunity to be heard.
4. That the written comments and analysis of the city
Staff and the Planning Commission were considered.
., NOW THEREFORE BE IT RESOLVED, that application for WVR 92~3 is hereby
approved based on the following Findings of Fact:
1. That Tract B will be a passive park, a nature area.
BE IT FURTHER RESOLVED, that application for WVR 92-3 is hereby
approved based on the following Conditions:
1. That Tract A is combined with, the Ramsgate property to the
west.
