easement and with the structure presently built over it, it will not
be necessary for future utilities.

A new easement will be required for the relocated watermain that runs
around the building addition. This requirement for a new easement was
a condition for the approval of the 1987 conditional use permit, a
copy of which is at the City Attorney's office awaiting filing.

VACATING UTILITY EASEMENTS
The Hqpkins city Council will hold a public hearing on
Tuesday, June 2, 1992, at 7:30 p.m., in the Council Chambers of
City Hall to consider vacating a utility easement at 101
Jefferson Avenue South, the present site of Super Value The
following is a legal description of the utility easements to be
vacated:
The utility easement originally reserved in that part of
vacated Second street South, lying between the southerly
extension of the east line of Block 31, West Minneapolis
Center, according to the recorded plat thereof, and a line
distant 225.00 feet easterly of, measured at a right angle
to and parallel with said east line of Block 31.

RESOLUTION NO: 92-36

RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A
VACATION OF UTILITY EASEMENT
WHEREAS, a request by Super Valu to vacate a utility
easement at 101 Jefferson Avenue South is hereby
approved.
WHEREAS, the procedural history of the vacation is as
follows:
1. That Super Valu requested vacation of utility
easement from the City of Hopkins in 1987.
2. That the Hopkins City Council reviewed such
application on June 2, 1992.
:3. That the Hopkins City Council, pursuant to
published and mailed notices, held a public
hearing on June 2, 1992; all persons present at
the hearing were given an opportunity to be heard.
4. That the written comments and analysis of the City
staff were considered.
NOW, THEREFORE, BE IT RESOLVED, that vacation is hereby
approved subject to the following Findings of
Fact:
1. That the utility easement is not needed.
CONDITIONS:
1. That Super Valu give the city a utility easement
for the relocated watermain.
Adopted this 2nd day of June, 1992.

OF 2ND STREET SOUTH AT 101 JEFFERSON AVENUE SOUTH
THE COUNCIL OF THE CITY OF HOPKINS DOES HEREBY ORDAIN
AS FOLLOWS:
That the following described utility easement in
the following designated area of the City of Hopkins:
The utility easement originally reserved in that part of
vacated Second Street South, lying between the southerly
extension of the east line of Block 31, West Minneapolis
Center, according to the recorded plat thereof, and a line
distant 225.00 feet easterly of, measured at a right angle
to and parallel with said east line of Block 31
